Seg 1- Personal news from each participant (when you are done with your segment please ask the next person what has been up with them)

Gary – What training do you have coming up?

John – No gun shows or shooting this week. However, I did do a bit of blogging including an important post entitled Every Picture Tells a Story, Part Three. More on this post at the show close segment of the show.

We are spending the weekend with our granddaughter and her parents. Olivia has a lot of theme-related outfits like UNC Tar Heels and the Carolina Panthers. It got me to thinking I need to find a NRA tee shirt for a toddler. Just imagine how a picture of her in a NRA shirt would drive the anti-rights crowd mad!

On a more serious note, I had my hearing checked this week. I have moderate 4000 hertz notch hearing loss. It along with my tinnitus can be traced to shooting in my younger years without hearing protection. My audiologist made the recommendation to use both foam plugs and muffs when shooting indoors. Given her boyfriend shoots 3-gun, I think she may know what she is talking about. I would urge all of our listeners – and especially the younger ones – to really make an effort to protect your hearing. Hearing loss is irreversible. This is just another reason that suppressors need to come off the NFA list. It is a safety issue.

Rob- Mailed in the last paperwork for my CCW.  More dry practice.  I’m excited to go to Florida next weekend.

Paul- Not a lot of news as I unexpectedly got a student on Tuesday and that turned a 70 hour work week into a 100 plus hour work week.

Training – We just booked a training class for next year and I am HUGELY excited about this. May 12th through the 15th of 2016 will be the Polite Society Podcast MAG 40 in Sioux Falls, SD

Hillary Declares the NRA an Enemy

In the first Democrat debate, Hillary Clinton proudly claimed the NRA as her enemy. In the following days she continued her demonization of the organization, equating it with terrorists, communists and Iranians. She  promoted the Australian Model of gun control, deliberately hiding it’s jack-booted door-to-door confiscation of guns. Clinton has announced her gun control plan, promising that when she’s elected, she’ll ban some guns and impose restrictive gun control laws on all others, even without Congress.

Clinton has chosen to make an enemy of the hundred million law-abiding gun owners; making them the problem instead of the drug gangs, criminals and the insane who are the real source of crime. Constitutional protections apparently mean little to her and she has openly challenged the Supreme Court’s pro-rights gun decisions. Her election would mean a direct assault on the rights of free men and women.

As such, we’re proud to be Hillary’s Enemy.

RM – If the NRA was truly the same as terrorist, communists and Iranians, It would probably be a good thing, as the ‘Boma administration and Clinton have a long history of rolling over for them.

John – I would also note that Hillary, in a New Hampshire town hall, advocated using a “cash for clunkers” approach to achieve her Australian style gun control. OK, just whose money is going to pay for that? Hers or ours?

CNN Money says NRA funded by small donors

If you watched the democrat debates then you heard the chant that the NRA is funded by the gun manufacturers.  Journalists at CNN Money did their homework and looked at the public record.  None of the donations to the National Rifle Association Institute for Legislative action come from corporate interests.  You and  I gave 85 million dollars over the last ten years.  The largest donation was 50 thousand dollars.  We gave 22 million dollars during the 2014 election.  As one NRA official said ‘politicians don’t listen to the NRA, but they listen to the NRA’s 5 million members.’  There is a reason.  The NRA has been effective in getting its members to donate their money, their time for campaigns, and in getting their members to the polls on election day.

John – Hillary just gave the NRA a gift. It will make fund raising that much easier.

Rob – It is all good publicity.

Harvard Study: More Guns – Less Crime
Always good to have some facts to offset the emotional drivel of the politicians. Especially when they come from the Dear Leader’s own school.  A Harvard University study thoroughly refutes the anti’s long held belief that more guns means more crime.

According to the news site Belief-net, a study in the Harvard Journal of Law & Public Policy said the more guns a nation has, the less criminal activity they find.  The study collected data from the Centers for Disease Control, the U.S. National Academy of Sciences and the United Nations International Study on Firearms Regulation.

Now, where have we heard those same results before?  Could it be…. John Lott?

John – the anti’s are also trying to inflate the number of deaths.

Gary –

Rob- that is why I compared the rate of violence, not simply violence with a handgun.

Gun Violence Decreasing – Guns Sales Increasing
Refuting the scare-mongering of Clinton and the Obama administration, National Shooting Sports Foundation reported that, “Historical data from FBI Uniform Crime Reports show significant decreases in both the number of annual violent crimes committed as well as the violent crime rate in the United States.” The figures show a 35.2 percent decline in violent crimes over the past 20 years and a 16.2 percent decline over the past 10 years. The continuing decrease in violent crime comes at a time when firearms ownership has increased significantly across America, a fact that utterly contradicts the mantra of anti-gun groups that more guns equals more crime.

With the Left’s demonization of the firearm, it is no small coincidence that last month’s adjusted National Instant Criminal Background Check System (NICS) figure of just over a million inquiries is the highest September on record for the 17-year-old system, with an increase of 4.7 percent compared to the September 2014 NSSF-adjusted NICS figure. Obama continues his record as the best gun salesman ever.

For our new listeners, the National Instant Criminal Background Check System is run by the FBI.  The system reports to gun dealers and local law enforcement if a gun buyer is a prohibited person.

The Creepy Ballerina Blames Deadliest September in 13 Years On Police Being Afraid to do Their Jobs

Years of Progressive policies have come home to the Windy City with a spike in murders.  You heard that right; rabidly anti-gun Chicago is bucking the nationwide trend of diminishing murder rates. Chicago mayor Rahm Emanuel blames Chicago’s deadliest September in 13 years on police being afraid to do their jobs.  Rahm said “We have allowed our police department to get fetal and it is having direct consequence.  (The police) have pulled back from the ability to interdict … they don’t want to be a news story themselves, they don’t want their career ended early, and it’s having an impact (on crime).”

The so-called Ferguson Effect is causing police officers to fear for their freedom, families and careers if they aggressively go after criminals of a protected class. They can see that their police commanders and political leaders will happily throw them to the wolves if their actions excite the professional activists or sensation-hungry media.  As a result, the street officers are deciding to play it safe, get their 20 years in, and retire. Criminals on the street are reacting to the withdrawal of enforcement.

If you demonize and demoralize the cops, and disarm the populace, what did the politicians think would happen?  Congratulations Chicago — and Baltimore, Washington DC, St Louis, Frisco, LA… all cities with radically increased murders rates — you are reaping what you’ve sown.

Rob- That is sad news.  The people being hurt the most are poor minorities.  I’m sorry, but we tried to tell you that elections have consequences.

John – Rob you are absolutely correct. When I was looking at the CDC mortality statistics, a combination of African Americans and Latinos comprised the majority of deaths.

John W. – Camen NJ and what is the real cost of this policy in terms of residents lives.

Rob – We have 15 black people killed every day by black people.. and the news media ignores it as if black lives don’t matter.

Texas Police Offering Free CCW Course
Not all police are retreating from the criminals. The police department in Aransas Pass, Texas is offering free concealed handgun license classes. Police Chief Eric Blanchard says he wants people in the community to be educated when it comes to guns. “The bad guys don’t care about the rules. If they want to be armed they are going to be armed. If we can offset those numbers with good people being armed out there. I think the odds are in favor of the good people winning when a disastrous lunatic decides to strike.” The first three classes are full. But they plan to offer more classes in the coming months.

Yah gotta love Texas.

Rob- I do.  Many sheriffs across the country do this.

John – I just wish more police ranges were available to the general public.

Gary –

Indiana Sheriff Vows to Ignore Obama’s Executive Actions on Gun Control
Not all police are retreating from the politicians. Elkhart County Indiana Sheriff Brad Rogers appeared on a local PBS panel discussion about gun rights and gun control in the wake of recent college shootings. He went on to say that he wouldn’t obey orders from on high that went against his constitutional oath.  Quote “We’ve always had this conversation that we need more reasonable gun control put in place.  But we (already) have what is reasonable, in my opinion, and in fact it’s probably overdone. I think people are tired of being victims and a firearm is a great equalizer. Whether it’s a female, whether it’s an 80-year-old, the guy who’s kicking in your front door after he knocked and you don’t answer — that is a very scary event.   You can call 911, but I’m telling you, we’re not gonna make it in time to neutralize the threat … the people of this nation [have got] to take responsibility for their own safety.”

Another guest, a local radio host, said gun registration is a “feel-good” measure that actually “works” only when the government moves against the people. He added that following England’s gun restrictions that there is now a “knife culture” there. That’s absurd, It’s not the tool, it’s the bad guy.

Sounds like Indiana has a hot-spot of common sense in media and law enforcement.

Constitutional Carry Takes Effect in Maine

We have some great news this week as Maine became a Constitutional Carry state.  According to a poll in the Bangor Daily News, a clear majority like the idea. Maine citizens have flocked to gun stores in order to exercise their Constitutionally guaranteed right. Blood is not running in the streets, despite the usual hyperbolic claims of the anti-rights groups. that the sky is falling.

Maine State Senator Erik Brakey sponsored the new law.  He said, “A criminal is not going to get a permit. He’s going to break the law. The same goes for gun-free zones. Criminals are not going to obey these zones.” Likewise, firearm instructor Adam Foster added the perspective of someone who lived under a similar law in Alaska.  He said, “The world continued to turn round and round. Nothing changed, really. There were no wild, crazy gunfights in the street.”

Well, heck, we could have told them that. And we will continue to.

Six states down. Only 44 left to go.

John – if you are not a prohibited person and are 21, you can carry concealed or openly. If you are a vet, then it is 18 or older.

Princeton Turns to Firearm to Protect Students and Staff
In our last story, there’s been a sudden, unexpected rush to sanity at an unlikely place: the ivy covered walls of Princeton.

The Daily Princetonian reports that Princeton Department of Public Safety officers will have access to rifles that can be used in the event that a gunman tries to take innocent life or simply brandishes a firearm. DPS Executive Director Paul Ominsky said, “The national best practices for responding to an active shooter have evolved. It is now a law enforcement best practice to get an armed officer to the scene as quickly as possible to save lives.” He added, “Response time matters. Even a few minutes can make a difference to save a life.”

Well, heck, we could have told them that. And it wouldn’t take a half million dollar education either. See, a professional, degreed educator CAN learn. But can Harvard and Yale?

Gary –

Rob- Blue polyester uniforms don’t bring you superpowers?

Gun Quotes

We chose this week’s gun quotes in honor of the New Jersey SAFE conference and the Gun Rights Policy Conference.

This quote is from Ayn Rand.  She said, There is another kind of social pyramid. The genius who fights ‘every form of tyranny over the mind of man’ is fighting a battle for which lesser men do not have the strength, but on which their freedom, their dignity, and their integrity depend. It is the pyramid of moral endurance. Close quote.

Let me add that I am more than willing to be a step in this pyramid

Rob MorseObama’s  Executive Orders – or why we don’t trust the government with our guns

Rob- One of our listeners contacted me with a criticism.  On this podcast we speak as if our listeners knew all the previous news.  That means a new listener is missing part of the story.  Thank you, Alana, for that comment.  Here is a story that brings new listeners up to speed since the murders at Sandyhook, Connecticut two years ago.

Many gun owners are antagonistic towards the Obama Administration.  There is a reason for that hostile attitude today.  The Obama administration lied to us again and again.  At one point, Obama said he was not here to take our guns.  Later, he said we should turn them all in.  The president has also weaponized every aspect of government to suit his political ends.  From the Internal Revenue Service, to the Veterans Administration and the Environmental Protection Agency, each agency maximizes the political donations they receive and ignores the people’s business.

After the public murder at a community college in Oregon, President Obama again said he’d issue executive orders to regulate firearms.  I read his 23 point plan, and it is important to read his orders to see how they will be abused by a corrupt Chicago politician.

Gary-  This doesn’t sound too bad.  Obama said he’d require federal agencies to make relevant data available to the federal background check system.  Isn’t that a good thing to stop criminals from getting guns?

Rob- This sounds good, and it might be good under an honest president.  First, criminals don’t buy guns at gun stores, so they never bother with background checks.  All our recent murderers either passed their background checks or murdered to get their guns.

As to the national gun owner database, Unfortunately, there is insufficient fact checking before the feds put garbage into their national database.  We’ve all read about people who have a similar name or address who were denied a gun or the ability to get on an airplane.   Making bigger mistakes faster is not progress.

Suppose someone with a name similar to yours tries to buy a gun.  There is a terrible bias to use military tactics on gun owners when a phone call would do.

Here is an example.  Suppose your brother is a military veteran.  He listed your house as his address when he was deployed. Years later he lives somewhere else and is being treated by the Veterans administration   Now the cough medicine your brother took is sufficient cause for you to get a SWAT team kicking down your door to disarm you “for your own safety”.  After all, we wouldn’t want a gun owner taking dangerous drugs.. even though your brother is now thousands of miles away.

Those are not accidental faults; those are key features of the Obama plan.  The political goal of this administration is to promote their political ends, not to help those who are struggling with addiction or depression.  They want to punish gun ownership and make guns unattractive to the general public.  A federal database is only another political tool to that end.

Gary- OK, so how about this one.  Obama wants to remove legal barriers in Obama Care that may prevent states from making information available to the background check system.  Wouldn’t that help find crazy people and keep them from getting guns?

Rob- Good question, Gary.  This proposal means the private information you gave to your doctor isn’t private any longer.  How about the night you stayed awake worrying about your nephew.  That can now be seen as a disqualifying sign of mental illness.  Don’t talk about the headache your spouse had last week.  Those can be considered critical indicators that when taken together allow the government to seize your firearms.  The government now pays your doctor, so the doctor you visit actually works for them, not for you.  Find a private doctor and pay him yourself if you want advice on any mental health issues.

Gary- Obama says he wants to improve incentives for states to share information with the background check system.  What could be wrong with that?

Rob- Let me translate that bit of bureaucrat speak for you.  “Improve incentives” means withhold federal money unless the states do what the Obama’s donors want done.  In our case, states will fork over information about gun owners or the feds will cut state funding.

I’ve seen Chicago politics, and believe me that a loyal socialist bureaucrat can always find a paperwork violation.

Gary- Obama asked the Attorney General to review categories of individuals prohibited from having a gun to make sure dangerous people are not slipping through the cracks.  Don’t we want to keep guns away from danger people?

Rob- Remember, Gary, that the Obama administration called Christians, veterans, and the Tea Party the greatest threat to America.  The southern poverty law center called my wife a terrorist.

Meanwhile, Obama invited thousands of Syrian fighters and thousands of Mexican drug gangs across the US border.  We’ve already seen military veterans and social security recipients stripped of their ability to own firearms because they have their monthly checks sent to a third-party payee.  According to the Obama Administration, anyone who isn’t a dues paying card carrying SEIU member is a threat.

Gary- Obama also proposed new rules to give law enforcement the ability to run a full background check on an individual before returning a seized gun.

Rob- That sounds so harmless.. and it so so easy to abuse.  First, the government comes into possession of firearms for many reasons.  It might simply mean you had a gun in your car when you were the innocent victim in a traffic accident.  You might be a passenger in a car that was stopped, and now the government takes your firearm “for officer safety” and without probable cause.

You would think that running a background check simply means determining that a gun owner is not a criminal.  If you think that, then you date yourself to an earlier time when we had an honest government.  Today it means searching your medical records to see if anyone in your family ever asked for a sleeping pill.  You can have your firearms seized if your niece, who now stays with you, ever saw a mental-health counselor or had a restraining order when she was getting a divorce.  You can be disarmed if you had your dying parents move in with you while they were receiving pain medication.

Once the government has your guns, then they will determine when they are done with their investigation.  If that takes 15 years or 20 years, well that works for them.

Gary- Obama wants the Bureau of Alcohol, Tobacco and Firearms to issue guidelines on background checks for private sellers.  That seems OK to me.  I want everyone to have a background check.

Rob- Of course you and I want to keep guns away from violent criminals.  At the same time, we don’t want to turn honest gun buyers, gun sellers and Federal Firearms License holders into criminals through bureaucratic regulations.  There are some 23 thousand firearms laws, and government lawyers have all the time in the world to prosecute you for each regulation.  Some states already require that every firearm transfer go through a gun dealer and receive approval by the Federal Bureau of Investigation.  Failure to comply can be a felony.

Even handing your gun to your hunting partner as you cross a fence line is now illegal in some states.  Think about background checks for a minute.  If I sell a gun to someone with a concealed carry license, then I already know the person has passed a background checks.

No, this proposal is not about criminals getting guns.  I’ll say it again; criminals never use background checks.  This executive order paves the way for a national database of all firearms owners.

Gary- Obama asked for a campaign to promote safe and responsible gun ownership.

Gary, it sounds like Obama is going to promote your concealed carry class.  I guarantee he is not  going to fund the NRA to run more firearms safety campaigns.  This order allows Obama to give federal dollars to his anti-gun lobbyists.  You and I now get to fund their propaganda with taxpayer dollars.  Of course they anti-rights groups can and will endorse candidates before the election.  That is what community organizers from Chicago do with their phone and their pen.

Gary- President Obama asked the Department of Justice to report on lost and stolen guns.  That sounds safe enough.

Rob- The Department of Justice is headed by US Attorney General Loretta Lynch.  She is a noted anti-gun bigot.  An anti-gun bigot would write a report about the so called lost and stolen guns that criminals use.  She would say we need “smart guns”.  Those are guns that become inoperative if they are stolen from the rightful user, just like smart phones.  Of course, the Attorney General would exempt police, military, and the security details that protect politicians.

PAUL-  That’s because no one wants to trust their life to a gun that can be hacked by a chinese teenager.

Skip

Gary- Obama asked the Consumer Product Safety Commission to review safety standards for gun locks and gun safes.  Don’t we want top quality locks and safes?

Rob- Paul, Gary and John, when was the last time you had your gun-safe tested and re-certified by a licensed gun safe inspector?

John- There are no licensed gun safe inspectors!

Rob- Exactly.  So the Consumer Products Safety Commission can now report you as a danger to the public because you’re using an unregulated gun safe.  They will issue a report saying firearms must be locked and inaccessible.. preferable buried under several feet of reinforced concrete.  And the rest of us need our safes inspected every 90 days.. or they come take our firearms because we were negligent.  I trust this president as far as I can throw my gun safe.

skip Gary-  You have to like this one, Rob.  Obama wants to provide law enforcement, first responders, and school officials with proper training for active shooter situations.

Rob- Gary, the NRA is not going to write that report.  It’s Obama who will tell us how to react when the next murderer comes to a “gun free” school.  Unfortunately, we need a plan that goes beyond run, cower and die.

The NRA and other organizations have begged schools to plan and train for active shooters.   When such laws were proposed in congress two years ago, the bills were buried by democrat legislators!  The Obama Administration will produce a propaganda piece so that urban school boards can safely continuing their policy of “gun free school zones”.  Me, I’d prosecute every school administrators for criminal negligence after each and every violent injury in their school.

Gary-  I’ve one more question.  President Obama wants the Surgeon General to research the causes and prevention of gun violence.  That sounds good to me.

Rob- Gary, this might sound like research into public health to treat the mentally ill.  Instead, Obama wants to spin up his propaganda machine.  The anti-gun Surgeon General is named Vivek Murthy.  He will issue propaganda from the Centers for Disease Control.  He will report that all firearms in civilian hands are a risk to public health and safety.  The Surgeon General can define anyone who wants to defend themselves as mentally ill.  The Surgeon General can also fund the Schools of Public Health that anti-gun billionaire Michael Bloomberg has already set up.  Those universities will produce more government propaganda using taxpayer dollars.

Gary- You’re saying our own government will be twisted against us no matter what the letter of the law says.

Gary, that is it exactly. I judge a politician by his results, not his words. If you have not been listening to the podcast for a while, then you might have missed our recent political history.  I am critical of this president for turning government against his political enemies.. and the american people.  The Obama administration does anything it pleases.  There is no law to constrain them as long as they have 40 loyal Democrats in the Senate and cowardly Republicans leading them.  No one’s rights are secure.. particularly firearms owners.

Paul- We will be back with our stories of defensive gun use after this break.

Please try not to say “And”, “Ahh”, “So” and “Ummm”.

Concealed Carrier Stops Kidnapping Attempt
A Pennsylvania man used his concealed firearm to stop an attempted car-jacking and child kidnapping near Plymouth last Monday. A criminal first assaulted a local woman outside a gas station and tried to steal her car. Frustrated, the man ran into the road to steal another car. The car he stopped had two children secured in the back seat. The woman driver began yelling for help as she was pulled from the wheel and thrown to the ground.

It was at that point a local man drew his concealed handgun and intervened in the desperate situation. “I have a license to carry this gun, don’t move!” Rob Ragukus held the man at gunpoint until police arrived. No shots were fired.

The owner of the gas station said that Ragukus was “The best man. He saved all of us.”  The CCW holder said “I had to do what I had to do. It’s something everyone needs to do, step up and take back their town.”

Congratulations, Mr Ragukus. Well done, well done indeed.

Rape Victim Snatches Assailant’s Gun and Shoots Him in the Face
A woman found herself kidnapped and raped at gunpoint late in a Springfield, Ohio night. The rapist held her body, but could not constrain her will to live. When she saw an opportunity, she took it – and the gun – and shot her attacker in the face – twice.

It only took the jury four hours to convict the one-eyed rapist.

In the situation the woman was in, she could have been easily been further injured or killed after the rape. In that desperate situation, she acted, and used the best tool at hand to even the terrible odds. Our congratulations to the heroic, resourceful woman.

Two Thugs Try To Rob Armed Citizen Walking Down Street
Here’s a damn good example of why we need to bear arms when outside the home. A Houston area man was taking a late night stroll in his neighborhood when he was jumped by two robbers. The man used his firearm to defend his life, killing one attacker and wounding the second.

A neighbor related; “The shots sounded like they were fired by somebody who knew what they were doing; very distinct and deliberate,” said Marcel Smith, who lives feet away from the shooting, “From my balcony, I could hear the deputies and the robbery victim talking about it all.”

No arrests have been made so far. The Harris County Sheriff’s Office has not said if the shooting was justified.

Woman Who Shot at Fleeing Shoplifter is Charged
It is a terrible thing when someone uses their CCW firearm. The only thing worse would be the injury or death of an innocent. Laws require that the weapon must only be used when serious harm or death is imminent. A Detroit-area woman ignored what she was taught in her CCW course and injected herself into a shoplifting situation where no lives were at risk.

The CCW holder saw a man with a shopping cart running from Home Depot security. The man jumped into a waiting SUV with about a thousand dollars of merchandise. The woman drew her CCW and fired at the departing vehicle. The SUV made good it’s escape,  limping away with a flat tire. Two Flint men, ages 52 and 46, were later arrested for the shoplifting. Thankfully, no one was injured.

Detroit police investigated and determined that the woman was not being threatened when she fired the shots. She has now been charged with a misdemeanor count of reckless use, handling or discharge of a firearm. The woman’s lawyer said she made “a spilt-second decision to take action, trying to help.” We disagree; she should have already long known this was NOT a time to employ her gun.

A Detroit Free Press columnist wrote that the woman was only was “…only doing what she’d been told, time and again, from people like National Rifle Association chief Wayne LaPierre to presidential candidate Ben Carson.” This is, of course, is a damn lie. Shame on the columnist for writing such libel and the Detroit rag for printing the lie.  But print it they did – harming the CCW movement that we support.

The woman’s CCW class was required to teach her when a CCW firearm can be lawfully used. Since no lives were being threatened, she should have kept the gun in the holster and acted as a good witness for the police. Because of the critical nature of what we do, all CCW carriers NEED additional training, recurring training, and ongoing practice. DON’T be this woman.

Rob-

Waffle House concealed carry permit holder Shoots an armed robbery suspect
There are a lot of places we’d rather be than in a Waffle House at O’dark thirty. However, the employees and customers of one hash house are glad a Concealed Carrier was amongst them one morning. “He saved us, that’s what he did.” according to one employee.

Charleston, South Carolina police received a 5 AM report of an armed robbery and shots fired at the local Waffle House.  Police arrived to find the suspect was already on the ground with a bullet wound.  The suspect was taken to a hospital in critical condition.

An investigating officer said, “It says something about firearms, for good people with firearms being in the right hands.” The division manager for the restaurant chain, said this was the first incident he could recall since it opened a year ago. “No one was hurt, which is the best part,” he said. “No one was injured — besides the suspect.”

The suspect later died at the hospital. The Coroner’s Office later identified him as 19-year-old Joshua Jermaine Davis. Davis was thought to be living with a friend in the downtown area.

The customer had a valid CCW permit. Police said they are not pressing any charges at this time. Despite this situation’s outcome, Waffle House will maintain their No Carry policy in all of their restaurants. I guess we will be finding better places to be at 5 AM in the morning.

Listener e-mail discussion

On your last podcast you talked about point shooting and referred to training from Bob and Ben? In San Antonio?  Who are they and how can I get training from them.  I did do a quick search but came up empty.  Thank you for your time and the podcast.  Just started listening and enjoy it.

John Harris.

Hi, John.

We referred to Bob Mayne and Ben Branham.

Bob is at http://www.handgunworld.com/

Ben is at http://modernselfprotection.com/

I plan to take their classes soon also.

Gary –

Paul: Rob, do you have any new posts from your SlowFacts blog you want to mention?

Rob- I wrote a post called Please Regulate Guns Like Cars, and another one called Why we Don’t Trust Government With Our Guns.  They are at Clash Daily, at Ammoland, and at my blog.  That is at slow facts dot wordpress dot com.

Paul – I want to talk about the Please Regulate Guns Like Cars article. Rob, you have caused quite a stir with this post. I posted it on my personal Facebook page and if the results there are any indication a lot of people are talking about this.  I consider myself a gun rights absolutist. I believe that there should be no regulations on any type of weaponry at all period. I don’t think that you wrote this as a advocacy piece saying that this is what we need to do, however if somehow everything in your article were to come to be the law in all of the US, as the anti rights crowd likes to say when they propose changes in gun laws. “It’s not going to solve all of the problems but it’s a good start”

Rob-

John, tell us what’s new at your blog no lawyers only guns and money

To commemorate the state of Maine going constitutional carry, I released Every Picture Tells a Story, Part Three. With the help of Rob Vance, the blog post graphically shows the growth of shall-issue and constitutional carry since 1986. It updates a post we did in 2011. At that time, approximately 2/3rds of the US population was living in states that had either shall-issue or constitutional carry. With Maine going constitutional carry and Illinois and Wisconsin adopting shall-issue CCW, this has now grown to almost 3/4ths of the US population.

That and more is at only guns and money dot blogspot dot com.

We would like to thank Charlie Foxtrot for writing up show notes for us. Even though you don’t hear him on the air he is certainly part of what you do hear. Look at his blog at not one more gun law dot blogspot dot com

Seg 1- Personal news from each participant

Rob dry practiced with friends Thursday night.  Shot IDPA with my G19 friday night.  Picked up some new magazines for my small browning 1911-22 saturday morning.  I talked with John Edeen about his new 10mm version of the Sig 220.  Finally cleaned my Mosin Nagant.  (Sorry it took me so long, John.)

John – I doubt the Finns had much time to clean their Mosins when they were fighting the Red Army!  The one thing I did this week firearms related was email my local state representative, a Democrat, asking him to support HB 562, the Second Amendment Affirmation Act, as it would eventually do away with North Carolina’s pistol purchase permit system. Imagine my surprise when I got a call yesterday evening from him asking to discuss the bill. He said he was a gun owner, CCW holder, NRA member, and a hunter. He went to say there was a lot in the bill he could support and would with a few changes. He gave me his cell number and asked me to call or text him with my comments if the bill changes. I didn’t vote for him but I was impressed that he took the time to call me.

Seg 2- News

-The Texas legislature completed the final steps for campus carry and governor Abbott signed it into law.  The new law requires Texas public universities to allow licensed concealed carry holders into dorms, classrooms and campus buildings.  College campuses have often sprawled across town, with a department building intermixed with private businesses and public roads.  Licensed concealed carry was already allowed on campus, but you couldn’t enter the school buildings.  You can in the fall of 2016.

The law allows universities to carve out gun-free zones in locations of their choice – establishing their own rules on where handguns are carried and how they’re stored. We will see what college administrators do with that loophole.  Private universities can opt out of the carry requirement altogether.

-There were 27 shootings in Baltimore over the Memorial day weekend. 19 people were robbed in New York City’s central park. Chicago had 12 people shot to death and an additional 47 shot and wounded over the same weekend.  That is a tragedy.  Baltimore, Chicago, New York.. these deep blue cities are the very model of progressive regulation.  In response to continued violence, the Obama administration called for more anti-rights controls.

The White House press secretary said, Quote “Obviously there’s some common sense things we could do – certainly passage of some gun safety laws in Congress that could keep guns out of the hands of criminals would be one thing that we could do to try to limit the violence.” Also, the government could improve the lives of citizens living in poverty stricken areas of our inner cities.  close quote.

They called it gun safety, but it is really about people control. The White House failed to tell us that assaults with a firearm are down.  That is why I have to ask this question.  There are thousands of firearms restrictions in these cities already, and the violence marches on.  Which criminals do they think will obey these new restrictions?

Even though people can’t work and raise a family in those examples of a deep blue progressive paradise, the obama administration wants to blame firearms for violence.  This week the Department of Justice said it will institute over a dozen new regulations to make it harder for law abiding gun owners to own a firearm for self-defense.

We don’t think these anti-rights laws will help our friends trying to live in the inner city.

Rob- DC had  violent weekend too. People shot = 9. People stabbed = 7.

John – It just infuriates me that the gun prohibitionists try to call what they do gun safety.

-In chicago, publicity seeking priest Michael Pfleger said the NRA was responsible for the shootings in chicago.  Pfleger was joined by Jesse Jackson and Brady Campaign president Dan Gross as they staged a rally outside Dick’s sporting goods in Chicago.

Gary- This isn’t about firearms safety.  There were 300 shootings in Chicago last month.  None of them were by concealed carry holders or honest citizens who legally bought a gun and had a background check.  My students don’t shoot innocent people on street corners.

These spokesmen are chasing dollars in a witch hunt against guns.

Rob- Lots of our deep-blue progressive cities have seen a surge in violent crime.

John – You don’t think some of those shootings might have been gang on gang, do you?

-Those gun grabbers in Chicago are not the only people seeking public attention.   A man carried his AR into Atlanta airport.  He videoed himself doing it as he trolled for the police.  A second man wore his Star Wars stormtrooper costume, complete with blaster, outside a school in Massachusetts.  He also got some police attention.  If you absolutely positively need public attention, then please enter a beauty pageant or buy a dog.  You are undermining the right of self-defense as you shock the average citizen.  You’re really working for gun grabbers like bloomberg while you feed your ego.

BREAK

-This news should make our inner cities safer.  Last week we reported that Washington, DC’s good cause requirement to get a carry permit was enjoined by a judge.  In the last few days, I’m hearing reports that ordinary citizens finally received approval to take a class and receive a DC carry permit.  DC also said licensed carry holders could carry a spare loaded magazine.

Rob- We’ll have an interview on applying for your non-resident DC permit.

-Self-defense news may seem politically partisan.  There is a reason for that, as documented by a recent Yougov poll.  Republicans were 50% more likely than democrats to say they owned a .gun.  69 percent of Republicans say the ‘average American’ can be trusted with a firearm while only 32 percent of Democrats trust the average american.  Democrats were almost three times more likely than republicans to want stricter gun laws.

The meaning is clear to me.  We need to take more friends shooting so more democrats will stand up for the human right of self-defense.

Obama Seeks To Limit Communication About Firearms
It’s often said that those who would eliminate one fundamental Constitutional Right would have little problem eliminating others. From the NRA-ILA comes a warning of the Obama administration’s effort to restrict free speech about firearms. It reads like a tinfoil hat fever dream, but we assure you that the source is the reputable NRA-ILA. Obama is once again attacking the First and Second Amendments.

In the June 3rd issue of the Federal Register, the administration proposes “clarifying” the International Traffic in Arms (ITAR) regulations pertaining to the sharing of technical information on firearms and ammunition. Since Algore’s internet is worldwide, under the new rules any firearms data published on the web could be deemed an export of ITAR controlled information. Prior governmental permission would be needed or the poster could face 20 years in prison and a million dollars of fines. The chilling effect on free speech is obvious.

The firearm technical data would include blueprints, drawings, photographs, plans, instructions or documentation. Gunsmiths, manufacturers, reloaders, and do-it-yourselfers could all be suddenly subject to ITAR regulation. Under the proposed gag orders, your next issue of Guns and Ammo might only be a pamphlet, firearms specific websites would be blank pages. And the broad online open discussions about firearms we enjoy nowadays would only be a another fading memory of freedom.

Comment will be accepted on the proposed changes until August 3, 2015. Comments may be submitted online at regulations.gov or via e-mail at DDTCPublicComments@state.gov with the subject line, ‘‘ITAR Amendment—Revisions to Definitions; Data Transmission and Storage.” Please contact your U.S. legislators. Urge them to oppose the State Department’s attempt to censor online speech concerning the technical aspects of firearms and ammunition. You can use the NRA’s “Write Your Lawmakers” feature (link in the shownotes) or call the Congressional Switchboard at (202) 225-3121.

Please, please make your voice heard — while you still can.

Surgeon General Vivek Murthy Intends to Pursue Gun Control as a Health Issue

When Dr Vivek Murthy was being confirmed as the US Surgeon General there were a lot of questions about his sparse medical qualifications, lack of experience, untested leadership and his hardline anti-gun stance. He mollified the Senators by promising to not let his personal convictions interfere with his duties as Surgeon General.

He lied, of course.

In a recent fawning NPR interview, Murthy reiterates his statement that “guns are a health care issue.” He further states that  “Violence of all kinds is a public health issue. When you have large numbers of people dying from preventable causes, that’s a health care issue.  I want to find a way that we can reduce violence in America. … What I’m calling for is for more common sense.”

Despise Murthy’s claim of common sense, treating violence as medical issue is largely nonsensical. Common sense and statistics show that violence declines when criminals are  targeted. Regardless of facts, it is apparent that the Surgeon General will join the Obama administration’s coordinated assault on the Right To Keep and Bear Arms.

Legislation Proposes $60 Million for Anti-Gun Research
On Monday, NRA F-rated Sen. Edward Markey and our old friend Rep. Carolyn Maloney introduced legislation to authorize the Centers for Disease Control and Prevention (CDC) to give $60 million of the taxpayers’ money to anti-gun activists to conduct “research” promoting gun control. If approved, these studies would use taxpayer monies to promote a political agenda against a constitutionally-protected right.

We wish that if Bloomberg would like to fund additional questionably biased anti-gun studies, he would use some of his own billions rather than getting Maloney to use our tax dollars.

Rob- It won’t be approved in this congress.
Republican Representatives Preparing to Block DOJ Anti-gun Initiatives
Republican Representatives are attempting to use the Constitutional Power of the Purse to frustrate Obama’s Department of Justice anti-gun initiatives. They are preparing to use a funding bill to roll back some of the Department of Justice’s backdoor gun controls and to completely block the implementation of others.

Breitbart News has reported the DOJ’s plans to circumvent Congress with ‘more than a dozen’ new gun control regulations.  These include new limitations on who can buy or possess guns, new reporting requirements for gun dealers, and new controls on certain types of firearms. The controls also add a whole new category of persons who have to undergo background checks when estates hold National Firearm Act guns in trust.

House Republicans are planning to stop the backdoor gun control push via riders to current funding legislation. The GOP-attached riders mean the DOJ cannot get the money it needs unless the Obama administration backs down from certain gun regulations. It is not known if House Speaker John Boehner retains enough of a spine to effectively back these initiatives.

The SAF Files an Appeal in Their Challenge of Washington’s Initiative 594
Several weeks ago we discussed the SAF’s challenge to Washington’s Bloomberg Inspired Anti-Rights Initiative 594. The judge dismissed the lawsuit on what many legal scholars believe to be the shakiest of grounds. Now, the SAF has filed an appeal of the dismissal before the 9th Circuit Court of Appeals.
“We believe an appeal will result in the case being remanded for full hearing because there are serious issues at stake,” said SAF founder and Executive Vice President Alan Gottlieb. “Citizens should not have to actually be criminally prosecuted in order to challenge the constitutionality of a poorly-written law.”

We wish Alan Gottlieb and the SAF all the best in this important effort.

Harbor Freight Allows Open Carry In Its Stores
In a recent press release, Harbor Freight stated  “We understand that there are a wide range of views on ‘open carry’ and other policies concerning firearms. We believe these policies should be addressed by the appropriate government agencies—not by Harbor Freight Tools.” Based on that wise understanding of the situation, Harbor Freight will permit the open carrying of firearms within its stores as long as local laws are being followed.

We applaud Harbor Freight’s decision to respect the rights of all of its customers. And we must confess to a sudden urge for some more power tools…

Segment 4 DGUs

Welcome back to the defensive gun use segment

A Gun Saves a Life
In this DGU, a victim’s gun saves an innocent life. A couple walked out of a Tampa eatery and into two robbers with a gun. As the woman attempted to run, one suspect aimed his gun in her direction. The woman’s companion defended her life with his concealed carry weapon, shooting the criminal and stopping the attack.

The highwayman is in the hospital with a gunshot wound to the leg. His accomplice later turned himself into the police. The woman suffered minor injuries from falling in the parking lot. Her protector was uninjured.

Clerk Shoots at Three Armed Robbers

Three masked and armed men attempted to rob the Happy Daze Smoke Shop in Houston.  Unfortunately – for them – they did not hide their preparations any too well, and the observant clerk was ready for them. Unfortunately – for them – the clerk was armed, and he fired as the trio rushed into the store, yelling Go, Go, Go!

One of the robbers stumbled back into the parking lot, where he collapsed. His two confederates left him there to die.

It seems a clear case of self-defense, and in rights friendly Texas, the clerk is not expected to face charges.

Elderly Man Thwarts Home Invasion

A burglar entered through the window of 70 year old Ronald Dyke’s home at 2am on last Sunday. Fortunately, the Sullivan County, Tennessee homeowner was armed. Mr. Dykes said he only had seconds to react so he pulled out his gun and shot the intruder. Mr. Dykes’ home had been previously burglarized in April.

Police found the burglar at the Holston Valley Medical Center where he was seeking treatment for his gunshot wounds.

Mr. Dykes is protected from any prosecution by Tennessee’s Castle Doctrine. Sullivan County District Attorney Barry Staubus said, “It has to be a reasonable defense of your home and you have to be in imminent fear of death. If those things exist, then you have the right to defend yourself.”

Texas Woman Stops Home Invasion

A woman in Waxahachie (Wax-Ah-Hatch-EE), Texas stopped a home invasion on Tuesday afternoon. Trent Sinyard, 32, first knocked on the front door and then went to the back door where he started to kick it in. As the door broke, the homeowner shot at him through the door multiple times wounding him in the head and shoulder.

Here is where this story takes a funny turn. Relatives say Sinyard, who lived next door to the victim, was only looking for the family dog that had escaped. That must explain why sheriff’s deputies found him hiding in the attic of his mother’s home. They took Sinyard to a local hospital for treatment for his wounds and then arrested him.

A spokesman for the Sheriff’s Office had this to say about defending yourself from a home invasion. “As soon as we know something’s going on, we’re coming, but our sheriff is very adamant letting homeowners know you have a right to take care of yourself on your property.”

Woman Uses Gun to Stop Three Murderous Carjackers
A wrong turn on the mean streets of Detroit resulted in a woman desperately battling for her life. While attempting to make a U-turn, three armed thugs approached her car, jerked open the door and opened fire, putting two slugs into the door. What could have have been just another Detroit murder took a decidedly different turn when the woman emptied her CCW handgun’s 13 rounds of .357 SIG at the offenders. The hoodrats scurried away to the safety of some nearby abandoned homes.

The woman defiantly stated that; “All the residents of the city need to come together and take back this city from the thugs and the criminals that have taken over this city, and if you live in fear you’ll never bring this city back. You should be able to go anytime to get gas. This is the land of the free and the home of the brave, right? Why can’t we act like it?”

Detroit Police say she legally defended herself and, so far, it appears no one was hurt in the shooting. We sincerely applaud the woman’s moxie, but we believe she could benefit from one of Rick Ector’s Legally Armed in Detroit handgun classes to tune-up her handgun skills. Rick is training 300 Detroit area women for free.

We post each of our news and defensive gun use articles at Polite Society Podcast.com  Please take a minute and share them with a friend.

Listener e-mail discussion

From listener Bow in NY,

I was “lucky” enough to get a pistol permit in the state of ny. The county I’m in issues it as a “sportsmans carry” permit. Meaning I can carry to and from the range or approved hunting grounds. If I were to travel to a state that actually recognized ny permits would those states rules apply or would I be stuck with the moronic laws of my state. I mean I passed their background check and they allow me to buy guns, why only allow me to carry to certain areas?  Again only punishing the people that follow the law. Seems to be a lot of people being shot on a daily basis, funny they are no where near a range, don’t have a permit, and the guns were obtained illegally.

Thanks,
Bow

The next email is from Peter The subject line reads “Topic idea”

Hi Guys,

Wonder if you might think about getting someone on to talk about the process of getting a non-resident DC carry permit? I live across the river in Virginia and I do have to go into the city from time to time.

Plus, it seems like now might be a good time to inundate them with a few tens of thousands of applications.

Also, when ya’ll interviewed Bob Mayne a month or two ago, you were talking about testing a gun to make sure it’s reliable before you carry. I wonder, does that still apply if it’s your first gun, or your first carry gun? It seems to me you were mostly talking about people who have a reliable carry gun they’re thinking of replacing. If you buy your first handgun, I’d think you’d want to wring it out and make sure it’s reliable, but I don’t think that should stop you from carrying it while you do.

Thanks,

Peter

John do you want to your discuss any new articles at No Lawyers – Only Guns and Money?

I did a number of posts this week regarding HB 562 which would eventually eliminate North Carolina’s pistol purchase permit system. I knew the sheriffs were against it since they’d be losing power, control, and money. I didn’t expect some Republicans to vote against it in committee. It only passed out of the Rules Committee because the chairman broke the tie in our favor. All three Republican who voted against it were both endorsed by the NRA and A-rated. So much for fair weather friends.

You can find these and other posts at onlygunsandmoney DOT blogspot DOT com. I have also started posting gun safety videos at my Everytown for Real Gun Safety site. The address there is everytownforgunsafety DOT blogspot DOT com.

Seg 1- Personal news from each participant

Paul- Back at ABN for the first time in quite a while. No longer doing the Baltimore run. Bought my wife a really cool Valentines day gift.

John – My new Kydex holster has arrived for my Ruger LC9s and it fits the pistol very well. I’ve worn it around the house and you forget that you are carrying. Other than that, no new gun news. We are still on grandbaby watch and it could be this week as the official due date is the 19th.

Gary – My Glock 30 is now my official back up gun, it fed 3 boxes of Ranger T without a jam. I’m still using my Colt 1911 because my FFL who is also a leathersmith is supposed to be making a double, double stack mag pouch for the Para, which is also feeding the Ranger T without a hitch. I had a couple of conversations with former students about disparity of force and AOJ, please take a moment and review these with your instructors. We actually have it easier to appear at house of rep committee meetings here in Illinois than in Texas. Rachel had to drive to the meeting, I filed my appearance and opinion from my home office.

Rachel- Thursday’s Senate hearing on gun bills was my big activity this week – I did a special segment with Paul on that that’s being included in Episode 310. Friday and Saturday was follow-up with my activists and some recovery downtime with a friend. And trying to catch up after several near all-nighters this past week.

Rob- Shot IDPA yesterday.  I learned a lot by slowing down a little.

I’ll miss testimony for a local gun range before the city council because of the Wednesday podcast.

(Weekend shows only) I am going to insert a live promo about upcoming training classes in Sioux Falls here.

Seg 2- News

BATFE released a proposed ruling this week that would reclassify one of the most common AR-15 5.56 rounds as “armor piercing”. Specifically, they said the exemption from the pistol armor piercing list of the SS109/M855 bullet would be rescinded. This is the bullet that is commonly found in surplus 5.56 or .223 ammo. BATFE says the steel and lead core combo makes it armor piercing. They also say this bullet has no “sporting purpose”. People have until March 16th to submit comments on this proposal.

John – Comment – I see this as a parting gift to Attorney General Eric Holder who said his one failure was the failure to pass gun control.

Rob- I remember a poster by Oleg Volk.  There is no “right size” when it comes to gun grabbers and firearms.  Guns are always too large or too small, too accurate or too inaccurate, too cheap or too expensive, too loud or too quiet.   There is no right size when it comes to firearms, and the 223 is no exception.

Where is the outrage that my police are carrying ammunition that is so lethal it will penetrate body armor?

A campus carry bill was introduced into the Nevada House by Rep. Michelle Fiore (R-Las Vegas). The bill would allow those with carry permits to legally carry in buildings on Nevada public higher education campuses, to carry in the unsecured areas of airports, and to carry in public buildings with some exceptions. Rep. Fiore calls this bill “Amanda’s Law” after Amanda Collins. With Republicans in charge of both houses of the Nevada legislature, Fiore is confident that this third attempt to pass a campus carry bill will be successful.

Comment – Rob and I saw Amanda Collins discuss her rape in the film “Safe Havens”. It was very powerful stuff.

Rob Comment- The presidents of the Florida state universities opposed concealed carry on campus in Florida.  To our Florida listeners, you trusted these university officials to educate your children.

Rachel comment- the Austin police chief doesn’t think campus carry is the best option. He prefers to offer victim counseling after rapes rahter than give victims a fighting chance.

-When Illinois passed its concealed carry law two years ago, one of the places that was made off-limits for legal carry were the Cook County forest preserves. Now two Downtstate legislators have introduced a bill to allow legal carry in forest preserves. Rep. Kyle McCarter of Lebanon said, “Allowing those who the state has trained to carry a gun will only provide safety.” The Chicago Sun-Times in an editorial takes issue with that and tries to bolster their argument with a spurious report from the Violence Policy Center that “counted” 722 deaths nationwide since 2007 by concealed carry holders.

-Sen. John Cornyn (R-TX) and Rep. Marlin Stutzman (R-IN) have introduced bills Thursday in their respective houses of Congress entitled, “The Constitutional Concealed Carry Reciprocity Act of 2015.” This bill would treat state-issued concealed-carry permits like drivers’ licenses, allowing law-abiding citizens with concealed carry privileges to concealed-carry in any other states that also permit it by law. The bill has bipartisan sponsorship and has the strong support of the NRA. Stutzman said, ““Americans enjoy a natural right to self-defense preserved by the Second Amendment. This federally guaranteed liberty should not be forfeited when state lines are crossed.”

Rob- I couldn’t find the house version of the bill yet.  See PopVox.com  https://www.popvox.com/bills/us/114/hr923

https://www.popvox.com/bills/us/114/s498

John – HR 923.

The New Hampshire State Senate voted 14-9 to approve constitutional carry of concealed firearms in the state. The bill was sponsored by Sen. Majority Leader Jeb Bradley. As Sen. Sharon Carson said, “This bill recognizes that the simple act of putting on a coat should not require a permit.” New Hampshire already recognizes unlicensed open carry. Senate Democrats argued that the bill will increase the number of deadly arguments. The bill now goes to the New Hampshire House for their approval.

Comment – I guess the New Hampshire Senate Democrats have never heard of an armed society being a polite society.

Rachel comment- So New Hampshire’s Senate thinks this is fine, but Texas’ Lt. Gov. Patrick doesn’t think it should even get a hearing. What’s wrong with this picture?

-We’ve reported on Operation Choke Point in past episodes. On Thursday, Sen. Marco Rubio (R-FL) introduced a bill that would “defund, in perpetuity, “Operation Choke Point or any other program designed to discourage the provision or continuation of credit or the processing of payments by financial institutions for dealers and manufacturers of firearms and ammunition.“ The bill is called “Firearms Manufacturers and Dealers Protection Act of 2015.  Sen. Rubio’s bill would complement legislation introduced earlier in the month by Rep. Blaine Luetkmeyer of Missouri.

-We have reported many times on how New Jersey law has ensnared innocent victims. We have interviewed both Brian Aitken and Steffon Josey-Davis on this show. The latest victim is retired school teacher Van Gilder. Mr. Gilder was arrested for the mere possession of an unloaded 300-year-old “Queen Anne” single-shot flintlock. He has been charged with a Second Degree Felony of Criminal Possession of a Handgun which can carry a 10-year sentence. Mr. Gilder has been an antiques collector for years. Under Federal law, this single-shot flintlock pistol can be bought and sold by anyone. No license is required, it can be shipped through the mails, etc. A legal defense fund has been set up for Mr. Gilder and we would encourage you to be generous.

Rob- Can he register this firearm?

Break

-In Connecticut, the 16-member Sandy Hook Advisory Commission issued its report with a number of recommendations.  Their want to prohibit the sale and possession of any firearm capable of holding 10 rounds or more.  There was no provision to grandfather in existing firearms.  They recommended that any shell casing for ammunition sold in Connecticut have a unique serial number etched on it, and that each casing should be registered and traced.  Also, all firearms would be registered and ammunition buyers would be restricted to only the caliber chambered for their licensed guns. Those who have firearms licenses, stresses the report, should at every renewal pass a test of firearms handling capacity as well as an understanding of state and local laws.

Rob- That sounds like a semi-auto ban.. and a bolt action ban, since most could accept a mag over 19 rounds.  That means they would need a department in Connecticut like their DMV where a firearms owner would be tested every year.

-In Denmark, only licensed gun owners may possess firearm or ammunition. License applicants must establish what the authorities consider a “genuine” reason to possess a firearm. Those laws didn’t prevent deadly shootings in Denmark Saturday. A man killed a victim and injured three police officers at a free speech debate in a cafe. The gunman then proceeded to the city’s main synagogue, where he killed a Jewish man and wounded two police officers. Police tracked down the gunman and shot him Sunday morning. Investigators believe the attacks may have been inspired by the Paris shootings.

Gun Quotes- I strongly believe that the Second Amendment creates an individual right to possess and use guns for purposes of both hunting and self-defense. That quote was by democrat legal scholar -Cass Sunstein.

Gary- I have a problem with this quote.

Hang on everybody, we’ll be back with our defensive gun use segment.

A Kalamazoo County, Michigan man awoke around 11pm Saturday night to loud knocking on his door. As he went to check it out, one of the two men outside broke a window on the side of his house.  The homeowner shot the man as the home invader entered the house and his accomplice took off. Police arrested the accomplice nearby and took the wounded home invader to the hospital with non-life threatening injuries.

A San Antonio, Texas homeowner was uninjured this morning after exchanging gunfire with a home invader. The home invader, however, was shot in the stomach and was taken to San Antonio Military Medical Center. The Bexar County Sheriff’s Department said the home invasion suspect will be charged with burglary when he recovers. They said they don’t expect any charges to be filed against the homeowner.

-Normally, one does not think of heavy snow as being of an assist to law enforcement. However, a combination of an armed homeowner and deep snow allowed Springfield, Massachusetts police quickly to arrest brothers Jordan and Jovan Eady. They had broken into a house and threatened “to light the house up” last Saturday night. The homeowner was armed with a legally registered firearm and he shot Jordan in the arm. The Eady brothers were captured by Springfield Police after they ran from the home. The reason they were running and not driving is that their 2014 Chrysler 200 had gotten stuck in a snowbank. Police investigators said the homeowner had acted in self-defense of himself and his family and no charges would be brought against him. A followup story said both the brothers Eady were charged with burglary and malicious damage and released on bail. Their attorney said it was all a mistake and they had been drinking.

We talk a lot about gun rights and politics on this show. Rarely do we address the history of older firearms. Some of these guns are absolute works of art. The late gun writer and firearms innovator Elmer Keith had an incredible collection of firearms. I did a story on Wednesday about the auction of his collection. Elmer passed away in 2003 and his family is now auctioning the collection. The post has many pictures of these guns.

Seg 1- Personal news from each participant

Paul- The truck died.. again! This time it is the AC unit. Dry fire practice. I have a sidewinder pro holster on the way.

Rob-  I’ve been busy. Business cards, ammo, dry practice, steel shoot. Wrote an article.  John, one of our listeners sent me a link to open source software that records the shot pattern from your SIRT pistol.  http://phrack.github.io/ShootOFF/  Listener John in Texas, please take note.  Oh, I edited Wednesday’s show on my day off.

John – Not much in the way of gun stuff to report since Wednesday. I did order a Kydex holster to go with the SIRT pistol. It’s hard to practice your draw without a holster unless, of course, you want to end up like Plaxico Burris.

Rob- you don’t have an M&P?

Rachel- I taught my brother how to take apart, clean, and reassemble my AR and XD. That’s the beauty of homeschooling. 🙂 It gave me some great ideas for a tips and tricks segment on children and firearms…stay tuned for that in the near future. I’ve also been making plans for a Battle Road defensive handgun class with some friends of mine. You know you have great friends when that’s their idea of hanging out and celebrating everyone being in town together.

John-Joseph Palumbo, co-owner of the Albion Gun Shop, released information today that New York State Police officers from the Narcotics Enforcement Unit demanded the shop’s release of all customers who purchased New York SAFE Act compliant rifles under threat of a warrantless SWAT Team Raid. Since the passing of the New York Secure Ammunition and Firearms Enforcement (S.A.F.E.) Act, the New York State Troopers Narcotics Enforcement Unit has been delegated to enforce the S.A.F.E. Act and to handle all matters pertaining to the S.A.F.E. Act. This unit visited Mr. Palumbo on several occasions, disrupting his business, to see that Mr. Palumbo is compliant with the S.A.F.E. act provisions for licensed gun shops owners. “The New York State Police told me that my guns were NY S.A.F.E. compliant. The chief of the Medina police told me my rifles were NY S.A.F.E. compliant and in fact purchased one of the guns from my shop.” James D. Tresmond, attorney for the Albion Gun Shop, raised the possibility of entrapment. “My client disclosed to me that he would not have sold these rifles to the general public had they not been approved by the New York Division of State Police”

Rachel Comment- That makes sense that Governor Cuomo got the drug cops to enforce the gun laws.  The drug cops are usually the most corrupt unit on the police force.

Rob- Could dirty cops tie up an honest store in court and drive them out of business.

Paul -We brought you a number of pro-self-defense news articles we found in the mainstream press.  Perhaps this next news item explains why the press has changed their attitude.  In San Francisco, a TV reporter was robbed at gunpoint while he was sitting inside his Television Station news van.  The thieves took his wallet, computers and television equipment.  All this happened in “gun free” San Francisco.

Rob Comment-  Go ahead, mister news announcer.  Tell me the police will protect me.  I dare you.

Rachel- A firearms manufacturer in Oregon was suddenly blocked from processing credit card transactions.  The company that Calico Light Weapons Systems used to process the transactions said the company was involved in illegal activities.  The manufacturer denied this, and the bank would not specify what activities were illegal.  The manufacturer believes it is the latest victim of the Obama administration’s “Operation Choke Point.”  Operation Choke Point lets the Departments of Justice and Treasury block banks from servicing selected businesses.  Calico Systems recovered by partnering with McMillan Merchant Solutions.  McMillan is based in Arizona and was started by members of a firearm manufacturing company.  McMillan simply decided that it won’t be cowed by the government’s strong-arm tactics.

Paul Comment-  This sounds like more lies, denials and delays from the obama administration.

John Comment-  And the Obama administration didn’t run guns to Mexico either.. just ask the mainstream media.

Rob- comments- Calico sells springs, screws and small gun parts.  They were accused of selling firearms over the internet.

Rob- The Point Marion Police Department in Fayette County closed its doors after settling lawsuits against two police officers.  The city manager of this Pennsylvania town said “We had to lay off all the officers due to the fact that we do not have police liability insurance.”  The insurance carrier dropped the department after paying two settlements against the department’s only two police officers.  One of the officers was fired from two other nearby Police Departments.  This time the officer was sued was by the ACLU for arresting a citizen who was recording the officer on his cell phone.  The ACLU won.  Insurance premiums went up ten fold.  The city can’t afford the insurance and closed their police department.  The city is now patrolled by state police.

John- The Second Amendment Foundation and the NRA’s Civil Rights Legal Defense Fund are teaming up to sue the Commonwealth of Northern Marianas Islands in US District Court over their ban on the possession and use of handguns. The Commonwealth of Northern Marianas Islands is a US territory. As SAF head Alan Gottlieb notes, ““The Second Amendment does not just apply to the continental United States and Hawaii. It also applies to territories under U.S. jurisdiction. The issue is a fundamental civil right, not only to possess a handgun, but also to use firearms for self-defense purposes, which is currently banned in the Northern Marianas.” The Northern Marianas are located north and east of the Philippines in the Pacific Ocean and includes the island of Saipan.

Rachel Comment – It is good to see the NRA and SAF working together on this issue.
Rob- comment- Guam issues concealed carry permits.

BREAK

Paul- Speaking of the Second Amendment Foundation..  The organization Jews for the Preservation of Firearms Ownership will officially become part of SAF.  JPFO operations will move from Wisconsin to Washington.  The new board of directors at JPFO has not been made public.

Rachel-  School started, and some things changed this fall in Idaho.  That is because Idaho became the seventh state to allow concealed carry on campus.  Oregon, Utah, Colorado, Kansas, Mississippi and Wisconsin also allow students to conceal weapons on campus.  Campus carry in Idaho requires an enhanced permit, and some 3000 permits have already been issued.  Some of the permits were issued to Idaho college students.

Rob- Comment- I’m know these laws drive some of the college administrators crazy.

John- Comment- The college administrators are crazy to oppose campus carry.  I’ve had soldiers and veterans as students in college courses.  We’d be crazy to disarm them.  These experienced adults have seen more stress and demonstrated more self-control than ANY university administrator.

Rachel- Comment- Soldiers and veterans absolutely have the right to carry on campus…along with the rest of us.

Rob- Most of us are familiar with the gun safety education for elementary school children called the Eddie Eagle program.  It is once again part of the curriculum in some Jacksonville, Florida schools.  The school allows parents to opt out of the gun safety program.  The only reason this made the news is that a parent complained.  He said he would have opted his child out of the program if he’d known it was developed by the NRA.  The program encourages children to stop when they see a gun, not to touch it, to leave the area and tell an adult right away.  School officials said the district hopes utilizing the program will help prevent tragedies that start by children playing with guns.

Paul Comment- All publicity is good publicity.. as long as they spell the name right.

Rachel Comment- again, the beauty of homeschooling: you can throw in gun safety or even shooting classes without going through any government red tape or dealing with school regulations..

John- Billionaire Mayor Michael Bloomberg knows how to pick his allies.  We criticize the mayor for his organization Mayors Against Illegal Guns.  That is because so many of his mayors have been arrested for corruption.  Once you’ll take money from Michael Bloomberg, you’ll take money from anybody.  Now we see a similar thing happen to the Bloomberg group, Moms Demand Action for Gun Sense in America.  Erika Quinn, the Oklahoma leader of Demanding Moms,  has a restraining order against her.  The restraining order bars Ms Quinn from being within 300 yards of her children and prohibits her from having firearms.  That is why it is hard for Erika Quinn to explain a picture of her holding a shotgun on her twitter page.

Rachel- comment- Gun control means training regularly.  Gun sense means taking a real class in armed self-defense.  THAT is how real moms keep their children safe.
Rob- comment  Does Twitter have throw-back thursday?

Paul- Does it feel like there are one set for rules for government officials and another set of rules for ordinary citizens?  A judge from the Fourth District Court of Appeals said that judges in the district may enter courthouses armed and may carry concealed.  The rest of us have to be fingerprinted.  The rest of us have to undergo a background check.  The rest of us have to demonstrate training and proficiency.  The rest of us are disarmed in most government buildings.

Rachel Comment- Not if you’re a judge.
Rob Comment- I read where two Califonia judges were disciplined for having sex in their chambers.
John Comment- I wonder if the judge can enter a post office while armed?

Rachel- Shaneen Allen was arrested for bringing a gun into New Jersey.  Also in New Jersey, Bonnie Oliver Allamong was prosecuted for bringing her firearm to her sisters house to protect her sister from domestic abuse.  Both are victims of New Jersey prosecutors.  Now lawyers have asked to look at the prosecution record to see if there is a consistent pattern of abusive prosecution.  Atlantic County prosecutor Jim McClain did not hand over the documents as requested by defense attorneys.

John Comment- That says something when attorneys question the impartiality of the prosecution.
Paul Comment- We have a legal system, not a justice system.

Rob- Many gun owners across the country are subject to background checks as they buy firearms and get licenses to carry concealed.  The background check is the holy grail of gun-safety for gun prohibitionists.  Recent news revealed that a terrorists fighting for ISIS passed a background check and worked as a baggage handler at the Minneapolis-St. Paul International Airport.  The MInneapolis Metropolitan Airports Commission handles security clearances and background checks for the airport.  The terrorist was recently killed while fighting in Syria.

Rachel Comment- well that makes me feel safer.
John Comment- at least he passed his background check.

John – Gun Quotes
I do not carry a pistol so I can impose my will on someone else. I carry a pistol so someone else cannot impose their will on me! – Lynn Givens of Rangemaster.

Michael Cargill 6:30 CDT owns Central Texas Gun Works, host of the Come And Talk It radio show, is also running for Austin City Council

Traffic management motivated me to run for Austin City Council.

How do you feel you’ve already impacted the Austin gun culture?  How could you continue to do so as Austin City Council member?  We live in Austin, and we have to both vote and talk to our elected representatives.  Your vote makes a difference.  Go to city council meetings and go to the state capital.  I have to have input from the citizens of Austin so I can advance their interests.  There are a lot of us who do our own research.  I can cover their back and they need to cover mine.

John- The Ottumwa [IA] Police Department was dispatched to a Burglary in Progress at approximately 3:21 p.m., Tuesday. The home’s owner called police after he found a man in his basement.  The homeowner went downstairs looking for his cat.  He found a partially disrobed intruder instead.  The homeowner called police and grabbed his handgun.  42 year old Billy Ray Snow was arrested at the scene and charged with trespassing.

Rob Comment- and intoxication, I’ll bet.

Paul- A mob of teens in Milwaukee tried to rob a group of tavern employees as they were walking to their cars after closing time Monday night. Fortunately, one of the employees was legally carrying concealed and fought back. One of the attackers, a 15 y.o. with gang ties and a long criminal history including armed robbery, was killed. Police took the rest of the teen attackers into custody. Milwaukee Police Lt. Mark Stanmeyer said the group was believed to have been responsible for dozens of robberies over the last three days. No charges have been brought against the man who defended the group though he was originally taken into police custody.

Rob- that must be why Chicago politicians want to disarm everyone who goes into a bar.

Rachel- Barbara Haley called 911 after 24-year-old Jody Kudlacz (CUD lez)  allegedly broke into her Omaha, Nebraska home around 3 a.m. She was awakened by noises and found the door to her attached garage open. She grabbed her handgun, a .45 Sig Sauer P220, and followed her pitbull to her home office where they found Kudlacz hiding in a closet. He tried to get out of the situation by saying Mrs. Haley knew him. She responded, “ I said I don’t know you, shut up and quit talking to me.” She noted to the media that she wanted to control the situation. Kudlacz had been in the process of stacking stolen clothes, gift cards, and jewelry before he was found. He was charged with burglary.

Paul Comment – Interestingly, the location is just 4 blocks from the University of Nebraska – Omaha campus. And yet authorities want to keep students and staff at risk in a gun-free zone.

Rob- Joseph Cihak (See hack) awoke at 4:30am on Wednesday morning to use the bathroom when he heard noises in his Westwood Terrace North home in St. Petersburg. Police said Cihak, who armed himself, walked into his living room to find Bryan Remley, 25, going through Cihak’s belongings. Cihak said he was armed because his home had been broken into a week earlier.  The intruder started running towards the homeowner who fired two shots but missed. The homeowner ran to get a backup gun and came back to find Remley in the kitchen unable to get out. He held him there until police responded to the 911 call placed by Mrs. Cihak. While waiting, Remley told the homeowner he’d come back and mow his yard if he’d just let him go. Remley was charged with armed residential burglary and a probation violation. Mr & Mrs Cihak said they have a plan to be armed whenever they get up in the middle of the night.

Commentary : It’s a story about theft of registered firearms in New South Wales Australia. It seems that criminals are still finding a way to become armed. Color me shocked.

Paul- Chris emailed in this link to a story and says that this is why he carries a gun.

http://madworldnews.com/white-missouri-couple-black-teens/

A white Missouri couple was brutally attacked outside of a Springfield nightclub by a mob of young black men, and now police are asking for the public’s help in identifying the attackers.

According to OzarksFirst, the incident happened on Aug. 22 outside of the Outland Ballroom. The victims sustained serious injuries after being assaulted by multiple black males.

Meredith Cole said she was outside of the club where her boyfriend Alex is a DJ, when she was approached by the group, who attempted to sexually assault her. Cole said she went back inside to tell her boyfriend what happened, and when they went back out to identify her assailants they were viciously attacked by the group.

KY3 reports that both of the victims had to seek treatment at the hospital for their injuries, which included a fractured ankle for Cole.

The story includes a video of the attack. You can see the video through the link in the show notes.

Seg 1- Personal news from each participant
Rob- Dry practice with my SIRT pistol and handgun on Independence day.

John – We had family in town from Missouri yesterday and we all enjoyed the various displays of fireworks. They also brought me a T-Shirt from the MO Univ of Sci & Tech where my nephew is think of attending. The shirt said, “My mascot carries a gun” on the front and “Does Yours?” on the back. The school’s mascot is an old miner with a six-gun on his hip. I love it!

Paul – We have brought up our dog Dakota several times on the show. This week she left us. On the day she left us Dakota was 14 ½ years old exactly. Is seems to me that one of the cruel tricks that is played on us by God, or Mother nature, or whomever you believe in is that while humans have a lifespan that lasts 75 years or so our companions have life spans that are about ⅕ of that. I got home this morning and we got a call from the Veterinarian’s office saying that her ashes were back, and we brought her home.

Those that have had a 4 legged family member know the pain that Susan and I are going through. Dakota came to be a part of our family when she was 6 month’s old. She had been abused by her prior owner, and it took a lot of work for her to trust men, but after several months and a ton of love she finally trusted me and eventually she became comfortable around all adult males.
Like any canine family member Dakota took it on herself to be the family’s guardian, confidant, and occasionally troublemaker. She gave so much and all she ever wanted or expected in return was our love and attention. Those 2 things we poured on her. She was always our “Puppy” and “our baby girl” If you ever want to know what unconditional love is just get a pet like our little puppy. It didn’t matter what kind of day you were having, or if something wasn’t going right, or if she wasn’t feeling the best, we were the very focus of her entire existence always.

I posted that we lost Dakota on facebook Tuesday stating something to the effect that if I earned a spot in heaven and our Dakota was not there I would move along and find her because if she wasn’t good enough for heaven than I definitely had no place there. Thank you to everyone who replied offering kind words. There are 2 that I would like to bring up specifically. First Ben Cook said “If my animal friends are not in heaven, I’ll be sure to leave a trail to where I find them so that you can find us all there

Second there were several references to a poem called the rainbow bridge. If you all would indulge me I would like to read this short poem

Just this side of heaven is a place called Rainbow Bridge.

When an animal dies that has been especially close to someone here, that pet goes to Rainbow Bridge.
There are meadows and hills for all of our special friends so they can run and play together.
There is plenty of food, water and sunshine, and our friends are warm and comfortable.

All the animals who had been ill and old are restored to health and vigor; those who were hurt or maimed are made whole and strong again, just as we remember them in our dreams of days and times gone by.
The animals are happy and content, except for one small thing; they each miss someone very special to them, who had to be left behind.

They all run and play together, but the day comes when one suddenly stops and looks into the distance. Her bright eyes are intent; Her eager body quivers. Suddenly she begins to run from the group, flying over the green grass, her legs carrying her faster and faster.

You have been spotted, and when you and your special friend finally meet, you cling together in joyous reunion, never to be parted again. The happy kisses rain upon your face; your hands again caress the beloved head, and you look once more into the trusting eyes of your pet, so long gone from your life but never absent from your heart.

Then you cross the Rainbow Bridge together….

John 1- Gun-rights advocates won another victory in Chicago.  A judge approved almost a million dollars in legal fees that the city must pay to attorneys who challenged Chicago’s gun store ban.  The original lawsuit was filed in 2010 by an Illinois offshoot of the National Shooting Sports Foundation.  That battle isn’t over.  Richard Pearson, executive director of the Illinois State Rifle Association, anticipates a legal challenge to the city’s new rules regulating gun stores out of 99.5 percent of the city.  He said, “The ordinance is prohibitive.  If you look at the hidden costs of opening a gun store, I don’t know how a person could make a living selling firearms in the city of Chicago.”

Rob 2- There was another victory for the right to choose armed self-defense.  A Florida appellate court ruled that college and university campuses must allow students to store firearms in their cars on campus.  This allows adult students to attend school and remain armed when they work those late night jobs.  Contrary to the public claims of school administrators, negligent discharges remain extremely rare.  This is another small step toward self-protection in Florida.

John 3- A Kansas open carry bill went into effect on Tuesday.  It is now legal to openly carry a gun in a holster, in your hand, or carry a rifle on a sling.  Captain Rance Quinn of the Kansas City Police Department said they will still respond to calls of man with a gun, but the department will change how they handle the encounter.  Quote “…How are you doing today. I see that you are exercising your right to bear firearms. Is there anything I can do for you today?”

Rob Comment- Why yes, officer.  May I buy you a cup of coffee while we talk about your department sponsoring more firearms training for the general public?

Rob 4- The attention seeking anti-gun Virginia State Delegate, Joe Morrissey, once carried an AK-47 onto the Virginia statehouse floor.  Now he faces criminal charges for having sex with the 17-year-old receptionist in his office.  A special grand jury charged the Virginia politician with supervisory indecent liberties with a minor, electronic solicitation of a minor, possession of child pornography, distribution of child pornography and contributing to the delinquency of a minor.

Comment- He was only following Bill Clinton’s example.

John – This is the same Joe Morrissey who as the State’s Atty for Richmond was disbarred for among other things, fist fights in the courtroom. Why is that anti-gun activists are so violent?

John 5- Here is a good example from law enforcement, and from a small police department at that.  Police Chief Michael Combs found out there were no firearms safety courses offered in the county, so  Chief Combs decided to offer his own course.  The department will host a classroom and firing range sessions at the Goodwill Fire Company on July 19th.  Pennsylvania is a shall-issue state and there are no training requirement for ownership or a carry license.  I think the Chief’s decision makes citizens safer!

Rob Comment- Thank you, Chief Combs.

Rob 6- Some gun-grabbing activist groups tell you that real women want to be helpless.  Not me.  I’ll remind you that the number of women who own guns has been rising rapidly.  The percentage of women who own a gun nearly doubled from 2005 to 2011.  Those guns are not gathering dust.  A growing number of women are at the range and taking classes.  Women are on the cutting edge of self-defense.  I offer as example of the students I see and the students of our frequent guest Kathy Jackson.

Rob- There is a list of women’s gun groups on my blog site Everytown for Gun Safety.wordpress.com

John 7- We’re not sure if it was on purpose or an accident.  On the first of July, a poorly written law in Mississippi exempted disabled military veterans from paying some hunting and registration fees.  Unfortunately, the law it required veteran submit to a disability review by the Veterans Administration.  Many veterans will decline that opportunity, thank you.  The bill also required non-veterans to submit to a mental health exam at the will of the Mississippi state police.  It isn’t clear how the bill will be implemented by law enforcement.  Gun owners need a strong state organization that takes a critical look at legislation.  This legislation may have taken Mississippi back to “may issue” status.

Paul 8- This probably wasn’t the answer they were looking for.  The MSNBC network conducted a poll asking, “Do you think people should be allowed to carry guns in public?” 84 thousand people answered.  88% chose “Yes! The Second Amendment guarantees the right to carry in pubic.  Another 4% chose “Only for self-defense.” and 8 percent said carrying a gun is too dangerous.

John Comment- I didn’t know MSNBC had 84 thousand viewers.

John 9- Because of changes in the Georgia gun laws, churches in Georgia now have an opt-in or opt-out policy towards concealed carry while at church.  An Episcopal bishop in Georgia said he will forbid concealed carry in church.  Other congregations have accepted concealed carry. Pastor Tom Rush said, “Quite frankly, we may have some people in our church that are uncomfortable with the idea… You know, I grew up in a day when we left the sanctuary doors open so people could come in at any time and pray. Unfortunately, we don’t live in those days anymore.”

This is part of a larger social trend of our culture splitting into isolated tribes.  Honest gun owners have had to choose which stores to enter based on the store’s no-guns policy.  Now that decision includes churches as well.

Rob- This issue isn’t confined to Georgia.  I live in California.  Last year a nearby church took an anti-self-defense petition to a city council.  The church’s public statements sounded inclusive, but their claims were wildly inaccurate.  I asked to speak with the church committee but they ignored me and never returned my calls.

Rob 10- In California, Assembly bill 1014 remains in committee.  The bill creates a new law aimed directly at California gun owners.  The bill requires police to proactively confiscate firearms and hold them for one year with no due process based solely on an accusation made by an immediate family member, a law enforcement officer or any health professional.

The person filing the complaint only has to believe quote “the gun owner poses a significant risk of personal injury to himself, herself, or another by having under his or her custody and control, owning, purchasing, possessing, or receiving a firearm.”  close quote.  One anti-gun doctor could declare all California gun owners mentally unfit.

John Comment- so will every vindictive divorce lawyer.

Rob Comment- We commented last week on California’s failing grades for mental health treatment.  They aren’t doing any better this week.

Questions for Kathy

Thanks for coming on Kathy, It’s been a while since we were able to have you on for a long form interview and I am so happy that we found a hole in your schedule so that you could join us tonight! I would like to discuss a few of the more recent blog posts. The first one that I would really like to cover is one you titled “Strength and Weakness” where you talk about a the recent Miss USA pageant winner and her take on self defense, in reference to a Larry Correa post. Could you talk a little bit about that?

Another post that I really liked was one of your shorter posts from late May entitled “He Didn’t Deserve That” One unfortunate side effect of our society is that everyone seems to be suing for everything. I thought that this post was quite illuminating in that it seems to have spread to some sectors of public opinion. Could you talk a little bit about that post?

Rob- Kathy, in one of your posts you said You’re never disarmed. “Your ultimate resource for self-defense are the things you carry inside yourself.” Would you tell our listeners more about that?

Guns and alcohol?

Rob 1- Two young men walked into Marlene’s jewelry store in Fresno, California.  The two men looked at the display cases and slowly moved towards the cash register in the back of the store.  That is where one of the thieves pulled out a gun and pointed it at one of the store employees while demanding cash and jewelry.  Seconds later, the store owner pointed his shotgun around the corner from the back room of the store.  The unarmed thief yelled “shoot them” as he dropped and ran towards the door, but the armed thief turned and followed his cowardly compatriot.  Both young thieves were caught on video and are very lucky to be alive.

Paul 2- Thieves tried to steal a vehicle parked in front of a home in Wasilla, Alaska.  When that failed, they tried to force their way inside the home through the kitchen door.  The 65-year-old homeowner called 911 and then fired a single shot.  She missed, but the criminals turned and ran.  They were long gone by the time state troopers arrived.

Citizens are the first responders, either as witnesses or as victims.

John – comment – if the homeowner was a few years older, I might have guessed it was my first cousin Ginny who lives in Wasilla!

John 3- This man is my hero.  A Centralia, Washington man and his girlfriend were sitting in their living room when a homeless 43-year-old stranger entered their home armed with a knife.  The homeowner grabbed his shotgun and ordered the intruder out of the house. They both walked outside, but instead of leaving, the intruder pushed the homeowner down a flight of stairs on the back porch. The intruder then grabbed a machete sitting on the porch and approached the homeowner.  Rather than shooting his attacker, the homeowner hit him with the butt of his shotgun, putting him on the ground and holding him there until the police arrived.  The homeowner preserved the life of a drug addled man.  Sheriff Steve Mansfield said. “This is another example of why citizens need to take all possible precautions and be prepared if something like this occurs.”

Do you have that much restraint after getting pushed down the stairs?

Rob 4- Well your hero has some competition.   My hero is Orlandous Brown who suffers from cerebral palsy and needs a wheelchair.  Orlandous came home Thursday morning in the company of his friend Latisha Vernon and Latisha’s 17-year-old daughter.  That is when he discovered that someone was already inside his Easly, South Carolina home and was robbing the place.  The thief was armed, but so was Orlandous.  Latisha and her daughter fled the home and called 911.  Deputies moved the women a safe distance away, and entered the home a few minutes later.  They found 33 year old Orlandous wounded from a single round and they also found the intruder, 26-year-old Darin Lowe, dead from multiple gunshot wounds.

Orlandous was transported by ambulance to the local hospital where he underwent surgery and is expected to make a full recovery. Police believe Orlandous may have been targeted because he is disabled and the dead intruder thought he was an easy target.

Comment- The thief thought wrong.

Paul 5- There is no way and no reason to pretty this up.  Gun control kills.  Two armed teenagers shot a couple as they walked on the sidewalk of Newark, New Jersey.  The murderers told the couple to kneel.  They shot 17-year-old Cheyanne Bond in the head execution style.  Her boyfriend survived.  The money Bond’s family had set aside for the teenager’s tuition at nursing school will go toward her funeral.  The crime rate in New Jersey has exploded since gun-prohibition was enacted in the late 1960s.  Now, long time politician and anti-gun Newark Mayor Ras Baraka has the murder rate he worked for.

Rob- Dry practice and wondering about new training techniques.

John- Still waiting for a SIRT pistol coming out in M&P since I’m not a Glock fanboi.

Rachel- Gave a presentation along with a local CATI leader for TAG (Texans for Accountable Government). We talked about gun legislation in Texas – why it failed, good outcomes from that, and what we need from activists to get stuff done next spring in the legislative session. I like the way TAG functions – they encourage their members to take charge in their area of interest and provide support by facilitating communication to other activists who can help out.

Seg 2- News

News_Partner_whiteRob- To open the news we have a rant from Rachel Malone. This one is about the heart of leadership, so let us know what is on your mind, Miss Malone.
Rachel-

I was asked the other day, “How many people do you have who would blindly follow you?”

My response: “Nobody, I hope.”

I don’t want people to follow me. Now, that might sound strange. I AM the leader of a gun rights organization, am I not? Aren’t I supposed to be leading the way? Why on earth would I NOT want people to follow me?!

I’ve got three reasons.

#1 – I’m not going to do your work for you.

The responsibility of running this country and holding elected officials accountable belongs to We the People. Last time I checked, I wasn’t a plural entity. I’m one person, and I’m responsible for myself. You’re another person, and you’re responsible for yourself. Get out there and do what you’re supposed to do.

Even though I am the director of a gun rights organization here in Texas – I want all you Texans out there to know, I’m not going to lobby for you. I’m going to lobby for myself. I’ll teach you how to lobby, I’ll teach you how to be involved, but I won’t do your work for you. Get out there and do the job yourselves!

Even if I wanted to be nice and do your work for you….

#2 – I’m not always right.

As hard as I work to research thoroughly and get my facts straight and present 100% correct information, I’m still very human. I’m going to mess up sometimes. It’s happened before, and it will certainly happen again. I’ll be responsible for my own mistakes, but please don’t try to make me responsible for yours.

Also, I may simply hold to a slightly different position than you on some things. So, perhaps our beliefs line up perfectly in most things but diverge in 10%. You’d be wrong to just blindly follow because you’d be violating your conscience in that 10%.

Even if I were always right and you knew you would always agree with me…

#3 – I want you to think for yourself.

If you end up following me, that’s great, but it has to be because you took time to consider the issue, look at the facts, and come to your own strong conviction that just happened to match up with mine.

A large part of what I’ve done with Texas Firearms Freedom is to take the time to do extensive research on an issue or on a piece of legislation, and then give people pertinent information on that bill. I DO give them my own conclusions and suggested action items as a convenience for them, but I always try to avoid pressuring people to just fall in line and do what I say.

My hope is that I can persuade people with logical arguments and facts, so that they take up my position with strong conviction. I don’t want passive agreement. I would rather have people believe what they believe with strong conviction whether they agree or disagree with me.

A person will fight for a belief with the same strength he believes it. So if you reach your conclusion by examining the facts and thinking for yourself, I think you’ll fight for it more strongly. You’ll have more reason to do so and more conviction that you’re right. You’ll be fighting for what YOU believe in. And THAT is what I want.

CONCLUSION:
I don’t want to have people blindly follow me. I want people to think for themselves and reach their own conclusions and chart their own courses to complete their own missions. I want to help them understand the process of effecting change so they can achieve their goals. Sure, I’ll tell them what I think and try to be persuasive, but at the end of the day, I don’t want them to agree with me just because I said something and they follow me. If they agree, I want it to be because they believe strongly the same things that I do, and they have reached those conclusions themselves.

Beware of anyone who asks you to blindly follow. Be very wary of any organization that sends you an action item without any explanation. Be extremely cautious and ready to cut ties with anyone who tries to get you to quit thinking and just do what they want you to do. That’s not their place. It makes your job a little bit easier right now, but it’s a cop out. Quit copping out. Do your own thinking.

I should also note that I consciously operate in the same way. You can’t buy my vote or agreement just because you’re my friend or you voted with me or helped me with some project. I won’t decide to agree with you as a favor to you, or because I “owe you one.” I’m not just going to follow you blindly no matter who you are and how much I like you as a person (and, I’m not going to refuse to work with you no matter how much I dislike you). No, you have to earn my vote or agreement. You have to persuade me. You have to show me that you’re right and convince me of the reasons. Do that, and you earn my support.

And I hope, for at least some of you, I will help you to think through issues and convince you of my position and earn your support. But please – make me EARN it. Don’t ever blindly follow me.

-Comments? Thoughts?

Rob- Rachel, that is why we give our listener news and DGU, so they can make up their own mind.

John- Hear-hear

1- John – Let’s start off with good news. Thanks to your efforts, Gov. Chris Christie (R-NJ) has listened to us. He vetoed the bill, A2006/S993, which would have banned possession of magazines with greater than 10 round capacity. Christie said in his veto message that the bill was one of those “cheaply recycled answers that never really address the root causes” of violence”.  He goes on to say, “These advocates argue that forcing an unstable, untreated, and likely clinically ill shooter to pause to reload during a rampage will humanely spare lives. This is the very embodiment of reform in name only. “ ANJRPC Executive Director Scott Bach said, “The Governor clearly recognizes the difference between legislation that punishes violent criminals vs. legislation that targets the rights of law-abiding citizens.”

Rob 2 -It wasn’t a quiet weekend in the windy city or the big apple.  21 people were shot in New York city and 42 people shot in Chicago over the weekend.  Both cities are the epitome of gun control and big government.  Both your big gulp and your magazine capacity are regulated and registered, but the violent crimes just keep on coming.  Strange, but the city government hasn’t learned that over-regulating the honest people hasn’t controlled the behavior of criminals at all.

Rachel- Maybe their gun free zone sign is broken, and no one told them?
John- I don’t think they want to learn.
Rachel- I don’t think they care. Regulation is the goal, not the means.
Rob- I think you’re right.

Rachel- Here is more news from Chicago.  Richard Hernandez was supposed to stop gang violence as a paid “interrupter” in the anti-gang CeaseFire program.  Now Chicago cops have another name for Hernandez. They call him a rapist.  Hernandez faces 36 counts of sexual assault and kidnapping of a teenage girl while he worked for the anti-violence program.  Hernandez is one of  nine employees of the CeaseFire who faced serious criminal charges in recent years.  Their convictions included illegal weapons possession and drug charges.

John 4- Outside the corrupt city of Chicago, Illinois now has over 60 thousand licensed concealed carry holders since the state started accepting application in January.  Firearms sales often slump during the summer as people get busy, but sales of handguns and the request for training and licensing courses have continued to grow.

break

Rob- 5 As part of the American Civil Liberties Union’s recent report on police militarization, the Massachusetts chapter of the organization sent open records requests to SWAT teams across that state. They received a very interesting answer.  Small police department pool their resources and share a SWAT team.  The teams are operated by law enforcement councils, or LECs. These LECs are funded by several police agencies in a given geographic area and overseen by an executive board, which is usually made up of police chiefs from member police departments.  The LECs also facilitate technology and information sharing and oversee other specialized units, such as crime scene investigators and computer crime specialists.

This is the interesting part, the SWAT teams said they do not have to respond to freedom of information requests because they are not a state agency.  On the one hand, they claim that corporate status exempts them from open-records laws. On the other, they still claim the privilege of using deadly force on behalf of the state, and their evidence is admissable as a law enforcement officer.  I think someone has something to hide and needed better legal advice.

6 John – The California Legislature has now passed AB 1964 and sent it to Gov. Jerry Brown. The bill would eliminate the single-shot exemption to the Cal Handgun Roster. Only handguns originally made as single shots would be exempted. A firearm that was converted would have to be on the roster or it would be outlawed for sale. The Firearms Policy Coalition has an page up urging Gov. Brown to veto the bill. Links are in the show notes. They are also asking people to make their voice heard on SB 53 which would ban online sales of ammo in California (among other things). A link for that is up as well.

Rachel 7- Will the last manufacturer to leave the blue states please turn out the lights.  PTR left Connecticut and gave a commemorative rifle to the Governor of its new home in South Carolina.  Remington moved some of its production lines from New York to Alabama.  Sturm Ruger & Co Inc is building a 220,000-square-foot building in North Carolina. Colt which is also headquartered in Connecticut, moved its shop to Texas at the end of 2013.  Beretta abandoned Maryland and moved to Tennessee shortly after Maryland lawmakers banned assault weapons’ sales.  The reasons are simple.  These companies moved because of laws, costs and people.  They found more of what they wanted in other states.

John – comment – I hope to visit the PTR factory in a couple of weeks when we vacation at Myrtle Beach. Maybe I’ll come back with an interview.

Rob- They don’t build airplanes in California any more, and they don’t build cars in detroit any longer.

John 8- If you felt a bump in the night, it was a wave of freedom felt on July 1 as several states recognized more rights of self defense.  In Georgia, the guns everywhere bill went into effect with 12 new pro-defense provisions in state law.  Even purple Virginia had seven new pro hunting provisions take effect.  Mississippi had three bills become law that limit local pre-emption, exempts disabled veterans from paying hunting license fees, and created a tax holiday for hunting and fishing equipment.  A Tennessee bill will allow a gun owner to carry his firearm in his car without a permit while a second Tennessee bill makes it illegal to harass hunters and fishermen with drones.  Blue state Maryland allowed Sunday hunting, expanded hunting season, and instituted special classes to teach hunters to cull the overpopulation of deer in some Maryland counties.

Rob 9-Ahh, smell the freedom.. except in Los Angeles, California.  There the stupid is still strong.  The LA City Council proposed a 10 round magazine capacity ban.  That would make possessing large-capacity magazines a misdemeanor.  It would eliminate any grandfather exemption and demand standard capacity magazines be surrendered in 60 days.  There are of course exceptions for law enforcement and museum collections.  None of these new laws would have stopped the latest killer in Santa Barbara.

John Comment-  Somehow the criminals will ignore our 23 thousand gun laws, but obey this one.

Rob Comment- The stupid is everywhere in LA.

Rachel 10- Last episode we reported on the Federal district judge who denied the appeal of Colorado sheriffs to rescind the new Colorado gun restrictions.

Rob- Comment- Is this the same judge who took data from before the background check law went into effect to show that people didn’t use background checks?

Rachel – Yep, that is the judge.  Well the sheriffs have decided to appeal her ruling.

Weld County Sheriff John Cooke said,  “These laws are unconstitutional and unenforceable due to the way they are written.”

Rob- John and I met Sheriff Cooke.  I remember him.

Break

11 John- The Bloomberg funded group “Moms demand action” was asked to leave a Target department store in San Antonio, Texas.  The group demand that Target refuse service to licensed concealed carry holders.  The daughter of one of the protesters was murdered in a gun free zone.. so they want to turn all Target stores into gun-free zones.

Rob- What?  I can imagine this in Dallas, but Austin.

12 John – Unfortunately, Target has now issued a “Starbucks” type of statement regarding the carry of firearms in their stores. They say, “But starting today we will also respectfully request that guests not bring firearms to Target – even in communities where it is permitted by law.” I take this to mean that while they won’t post their stores, they want their stores to be unofficially gun-free zones. While Everyday Moms for Illegal Mayors is claiming victory, a spokewoman for Target clarified that “It is not a ban,” she said. “There is no prohibition.” Nonetheless, it is a PR win for the anti’s.

Rachel- There is stupid even in Texas, but not much.

Rob 13- Really, Rachel, then explain this.  Dallas County has an agreement with a private gun range to accept the firearms taken from people charged with domestic abuse or the subject of a protective order.  Jan Langbein, CEO of Genesis Women’s Shelter said, “Imagine how much better victims would sleep at night knowing all the guns had been removed.”  I say, “Imagine how helpless the victims will feel if their abuser drops a dime on them and has the victim disarmed by the cops.”

John- My lawyer can beat up your lawyer.

Rob- Exactly.

Rachel- Comment- Are you guys picking on Texas?

Rob- I know restraining orders are fairly common in divorce cases, but I’ve never found an example of someone charged for making false claims of domestic abuse.  The liars are simply never prosecuted.

Rachel 14-  There  is no workable definition of an assault rifle, yet many anti-gun politicians use exactly that pejorative term Assault Rifle to ban modern sporting rifles.  Well Ares Defense has come up with an AR-15 configuration that going to frustrate the gun grabbers.  It doesn’t have a flash suppressor or bayonet lug.  It has a conventional stock, yet it uses stock AR uppers.  It operates like an AR.  Eats ammo like an AR, and it shoots like an AR, but it looks just like any other semi-automatic hunting rifle.

Comment- A few pounds of freedom coming to an over-regulated gun-banning jurisdiction near you.

John15-More cops are doing it right.  The Paragould, Arkansas Police Department trained citizens  to carry concealed.  The one-day class covered the laws surrounding handguns and how to properly handle, fire and care for them. Students then went to the range with instructors for a live-fire practice session.  One instructor said the class is important because it also teaches students how to avoid becoming a victim. “Not just teaching them the specifics about carry and conceal, where you can carry, where you can’t carry, but give them information that they can use in their daily lives.  Be aware of your surroundings and reduce the chances, of having to use that concealed handgun to defend themselves or a loved one.”  Classes are available each month until October.  This is the department’s nineteenth year teaching the class.

Rob, I read about some other departments doing this.  Good for them.

John – Kathi Jackson will join us on Saturday night.

Rachel-Coming right up, we have an interview with Molly Pitcher of CATI-Austin regarding an upcoming special event, as well as an interview with Jim Irvine of Buckeye Firearms, so stay tuned.

The Gunpowder and Lace Walk sponsored by CATI Austin will be held Saturday, July 12, 10:30 AM at the Capitol Visitors Parking Garage (12th st. and San Jacinto). Participants will meet on the corner for a safety briefing and then walk down Congress Ave. to 6th Street. Ladies, bring your black powder pistols and/or long guns. Chamber checks will be conducted as always to ensure safety (no round in the chamber for long guns). Long guns should be carried on a sling in a way that keeps the muzzle in a safe direction at all times.  More Info.  Facebook event page.  CATI TX page

Rachel 1- It is good to have friends with guns in Pennsylvania.  Christopher Vazques and an associate robbed a 60 year old man in front of the victim’s house, taking his valuables and keys.  The victim recognized them and called police.  Because his keys were taken, the victim stayed outside to protect his car.  The thieves came back to take the car and they began beating the victim when he said he’d reported the earlier crime to police.  Moments later a neighbor yelled for the two men to stop beating the victim.  The neighbor fired one shot, striking Vazquez in the chest.  The criminal died at the hospital.  The shooter was taken into custody and released without charges.

Rob- Police were called to the Step-N-Style in Dayton Ohio before noon.  Two armed and masked men entered the store and demanded cash.  The store had been robbed before, only this time the store owner was armed.  He shot one of the armed robbers, and his accomplice fled.  Police later identified the dead criminal as 16 year old Isiah Haggins, Jr.

He lived with his grandmother, and the family was surprized by his armed criminal behavior.

Very few criminals start with armed robbery.  The start with stealing property, then burglary, then, finally muggings and armed robbery.  Maybe this young man was different, but for most criminals committing armed robbery, it isn’t their first crime.

John – The manager of La Bodega Mexican restaurant was happy that an off-duty Midland (Texas) Police detective was eating in his restaurant this past Friday night. That is because Nyocomus Garnett, 35, entered the restaurant through its backdoor intent on committing armed robbery. After Garnett fired several shots in the kitchen, he exited into the restaurant where he was met by the off-duty detective who told him to drop his handgun. Garnett refused and then tried to shoot the detective. That is when the detective shot and killed Garnett. No patrons or restaurant staff were injured in the robbery attempt. Police say that Garnett had an “extensive history” with Midland law enforcement.

Rachel- From listener Chris Gillespie
I was a local store purchasing a monthly gun magazine. I reached the check out counter and the clerk asked if I concealed carry. I was thrown off guard by this question. I said “lets hope we never have to find out if I do.” How would you guys have answered that question?
Comments- Rachel? John? Rob?

Rob: The Polite Society download app is out on Amazon for Android and the I-phone app is in I-tunes and it is called Podcast Box.  They are located by our old name, Politics and guns.  Hot links are in our show notes.

John: Also please check out Kathy Jackson’s Cornered Cat training classes. Her next class that still has seats available is the weekend of July 12th and 13th in Walla Walla Washington. Go to Cornered Cat dot com for more classes and details.

Rachel John, do you have any new posts from your Blog, No Lawyers, only guns and money you want to mention?

John: I do. I did a post Monday about the story we discussed a bit earlier. It was about the Target store in San Antonio that ushered the gun control protesters off their property. The organizer made a comment that stuck me with me. She said they were “armed with children and clipboards.” The UN and all responsible and moral people have condemned the use of children as soldiers. While qualitatively different than the warlords in the Congo and elsewhere, it is still using innocent children as tools and props in a war against gun rights.

Rob- Well said, John Richardson.

Rachel: Also please check out the shooters club by Bob Mayne and Ben Branam.  For $75.00 a year, $6.25 a month, you get 24/7 access to some fantastic training and audio podcasts that you can’t get anywhere else.

John: That wraps up another episode of the Polite Society Podcast. Until the weekend show…
Rob: stay safe,
Rachel: be aware,
John: and we’ll see you down the road.

Paul: Episode 247 of the Polite Society Podcast starts right now.
Show intro music.

Seg 1- Personal news from each participant

John – In keeping with Tom Gresham’s “No Shrug” Policy, I responded to a local hospital’s Facebook post sending people to the Brady Campaign’s Asking Saves Kids website. I noted that the Eddie Eagle program was proven to work and had many endorsements while the Brady Campaign was really about gun control and trying to stigmatize firearms. Later that day they had removed their original post.

Rob- I  had a couple dry practice sessions with my SIRT pistol. It is good for practicing follow-on shots.

Rachel- Wilderness Fun Day with friends learning about wilderness survival – knot tying, fire building, sheltering, and a great line-up of scenarios requiring medical help in backwoods settings. Despite all the skills training segments and emphasis on medical training, I learned most about leadership this time around – some important do’s and don’t’s.

Paul-  Nothing gun related, did add a new show sponsor and screwed up the editing of the last show.

Rob- 1- Welcome back Anthony Colandro.  Anthony is a Master firearms trainer.  He’s on many NRA committees. He is a podcaster and is also the owner and operator of Gun for Hire at the Woodland Park Range in Woodland Park New Jersey.  Welcome to the Polite Society Podcast.  Anthony, tell us what is happening in New Jersey gun law?

Please call New Jersey Governor Chris Christie and ask him to oppose the magazine capacity bill.  We need calls from every state, not only New Jersey.  Governor Christie has until July 7th to sign or reject the bill that cuts capacity from 15 rounds to 10 rounds.  Call 609-292-6000 and politely ask Governor Christie to reject the bill.

Rob- when I called they did not ask where I was from.  I assumed they saw that I was from out of state.

Anthony, where will our listeners learn more about you? GunforHire.com

Paul 2- It was not a quiet week in the gun control paradise of Chicago where the gangs own the streets.  The gangs usually shoot each other, and they have no trouble shooting innocents as well.  19 people were shot this weekend, and 5 were killed.  The victims were walking on the street or working in neighborhood stores.  886 people were shot in Chicago so far this year.

We have a link showing the shootings for the last 30 days.chicago wounded June

Rob Comment- It is a little hard to show a graph on a podcast.  Here, I’ll hold it up higher.

Paul Comment- yeah, that helps.

john 3- Anti gun billionaire Michael Bloomberg spreads his love around.  Bloomberg invested a quarter million dollars to help the struggling campaign of incumbent Mississippi Senator Thad Cochran.  The unremarkable Senator Cochran won his primary race, so how do you think Thad Cochran will now vote on gun issues?  Mississippi gun owners had 250 thousand reasons to vote for Chris McDaniel, and the missed.

Rob Comment- No money for RINOs.

Paul Comment- No money for anti-rights RINOs or Asses.

Rachel Comment- The revenge of the low information voter.

Rob Comment- Thank you to your listeners who choose to stay informed on self-defense.

Rachel 4- A Joplin, Missouri, church decided the best way to get more people in the pews was to raffle off two Black Rain AR-15 rifles.  The first raffle was held at Ignite Church on Father’s Day to entice more young men to attend services.  The pastor says more raffles could follow.

Quote- “If we get people in the door, we get to preach the gospel. If we can get more people to follow Jesus, I’ll give away 1,000 guns. I don’t care.”

John Comment- well praise the lord and pass the 223.

Rob 5- Vermont Governor Peter Shumlin signed a bill into law that allows law enforcement to seize and store guns from someone subject to a restraining order.   Despite how good it sounds, I expect this tactic to be the latest escalation in disputed divorces.  Note that restraining orders often do not require evidence or a hearing.  Unfortunately domestic violence makes good press.. until we read about a victim being disarmed and beaten.

Paul 6- Everything the government does is political.  David James is suing the US Army Corps of Engineers because they will not give him permission to camp while armed at Georgia’s McKaskey Creek campground.  The Corps won’t even give mister James the reason why.  That left him with no choice but to file the lawsuit.  James is a former police officer and military veteran who has a Georgia Weapons Carry Licnese.  The Corps allows hunting on their property, and courts have ruled that a campground is considered a temporary domicile and due such protections under firearms laws.

Break-

John 6B- This is a surprising article.  It says that strengthening gun control won’t stop the next mass shooter, but changing the treatment for the mentally ill for treatment just might.  The article asks us to look at the last mass murderer in Santa Barbara.  California’s gun control laws received an “A-” grade from both The Brady Campaign to Prevent Gun Violence and the Law Center to Prevent Gun Violence.  The gun control organization got their wishes answered and we had mass murder in California anyway.  The murderer obeyed every California Firearms law.

Comment- Right up until the moment he didn’t.

You’re right.  In contrast, the nonprofit Treatment Advocacy Center looked at both the quality of involuntary mental health treatment and the availability of court orders to force treatment.  California received a failing grade of an “F”

That is from an article on CNN.

Rachel Comment- Let me check the weather report.  There might be snow in hell right now.

Rachel 7- Michigan Governor Rick Snyder signed bills into law that protect the identity of lawful gun owners by keeping state firearms records confidential.  The bills passed with support from both political parties.  Firearms records are now immune from Freedom of Information Act requests, though the records remain available to law enforcement during an investigation.

Rob 8- San Diego County, California is may Issue for concealed carry, so law enforcement grants the right of armed self-defense at their discretion.  San Diego Sheriff Bill Gore said law enforcement will protect you.  That is hard to believe given the thousands of crime victims in the county each month.

In the last few weeks-

-It was afternoon when a woman was helping her elderly mother into her car.  A man in a white SUV drove up next to her and asked for directions.  The stranger then got out of the SUV, pointed a handgun at her, and demanded the woman’s purse.  He then shot her in the back as she ran away.

Comment- That is one

-A San Diego woman was asleep in her Pacific Beach home at 2AM.   She woke to find a stranger touching her.  She screamed and the stranger fled.

Comment- That is two

-A gun-wielding robber approached two women as they were getting into their car in La Jolla.  The robber showed a pistol and ordered the two women into their car.  He then forced them to their local ATM and made them withdraw money.  He then had them return him to where they were originally kidnapped.  There the robber fled on foot.

Comment- That is three

-San Diego Police arrested a man suspected of a triple murder.  Back on Christmas Eve, the victims were shot as they sat in their cars at the Mission Valley Mall.  Police spokesmen said they would release details next week.

Comment- That is four

-A robber rode his motorcycle up to the Oceanside, California branch of Union Bank.  He parked the bike on the sidewalk, walked inside, and then robbed a teller at gunpoint.  Then he drove away on his motorcycle.  Oceanside is in north San Diego County.

There are four to five thousand examples in San Diego each month were the police could not protect the victims.  That is understandable.  The average police response time is 5 minutes but sometimes that stretches out to several hours.  Citizens are on their own in the mean time.

Sheriff Bill Gore says he can’t issue San Diego citizens a license to carry a weapon, though many other California Sheriffs do exactly that.  That sounds unfair to me, and a 3 judge panel of the Ninth Circuit Court of Appeals agreed.

The Court called Sheriff Gore’s policy unconstitutional!  Now the full court will decide.  Until then, the citizens of San Diego will continue to be helpless victims.  150 disarmed people a day are victims of violent crime in San Diego County.  (Link) This will continue until Sheriff Gore acknowledges their right of self-defense.Early May

Paul- Gun Quotes of the week- “With guns in the hands of many citizens, we will have tragedies.  With guns only in the hands of the government, we will have genocide.”  Multiple sources

Hang on everybody, we’ll be right back after this advertisement from Concealment Solutions.

Seg 3 Interview with John Pierce

I first read about John Pierce at Opencarry.org.  Later John and I met face to face.  Now John is a lawyer with his own practice in Virginia.  Welcome to the polite society podcast, John Pierce.

Councillor, we’ve seen citizens robbed as they left a convenience store where the convenience store had a no guns allowed sign up on their door.  We’ve also seen gun owners robbed as they left a shooting range that doesn’t allow concealed carry.  These stores identified their customers as being disarmed and as prime targets.  They can be robbed for their money, their wallet, or their weapons.  What principles of law apply to these stores and the risk they create for anyone who enters?

A man was shot outside a Jackson, Miss., convenience store where the proprietor had posted a “no firearms allowed” sign.

http://www.bizpacreview.com/2014/01/14/business-with-gun-free-zone-signs-may-be-tagged-with-legal-liability-94257

Two people shot outside gun shop.

http://www.philly.com/philly/news/Cops-Gunman-shoots-clerk-steals-6-firearms-in-Northeast-gun-shop-robbery.html

To the criminals, the human predators, waiting outside, these gun-free zone signs say the victims have been disarmed and are easy pickings.

John, where can our listeners read about you?  http://monachuslex.com/

Segment 4 DGUs

John A- This DGU is from Memphis, Tennessee.  Drunk Tony Hardin was fighting with his girlfriend and her adult son.  According to the victims, Hardin chased them with a hammer and a wrench and threatened to kill them.  That was when the son shot Hardin and the victims made their escape.  The son was taken into custody, but released.  Hardin was taken to the hospital and charged with aggravated assault.

Rachel 1- Anti-gun groups say this never happens, but it sure happened here.  A gunman burst into a 15 year highschool reunion in East Peoria, Illinois.  The gunman then shot his ex-wife and her new boyfriend.  The assailant was then shot by an off duty FBI agent who happened to be in the same restaurant and witnessed the assault. Unfortunately, all three died.  Thanks to the FBI agent, for making sure no one else was injured.

A gun free zone since it served liquor in Illinois?  According to Illinois legislators, we’d be safer if everyone was disarmed except the criminal.

Paul 2- Two teens were on a car robbing spree when a man heard them break into his car early Tuesday morning.  The car owner stepped outside, and that is when the car thief, Jarvis Brooks, age 18, shot at the car owner.  The owner fired back.  Brooks and his accomplice, Jashayla Finney, 17, fled in another stolen car.  Brooks was picked up at the hospital where he was being treated for a gunshot wound.  Finney was picked up for questioning by police a short time later.  Since they are minors, the police can not say much about the two robbers. but both of their portrait pictures were available for the newspaper article, so perhaps this was not the first time they have come to the attention of the local police.  Both face charges.

Rob 3- Wendell Vanbuskirk of Indianapolis, Indiana got drunk and was fighting with his fiancee at a family cookout for Fathers Day. He agreed to leave the party.   He returned with a baseball bat after midnight and started beating his fiancee’s mother.  His future father in law saw the attack, drew his gun, and shot Vanbuskirk.  Vanbuskirk died.  No arrests have been made and the investigation is ongoing. Police do not suspect the father-in law of any crime because he was acting in defense of his wife and himself.

John 4- It is good to have friends with guns.  A 27 year old convenience store clerk was robbed in Milwaukee, Wisconsin on Wednesday night.  During the robbery, the thieves shot the clerk.  A second employee at the convenience store shot back and wounded one of the robbers.  We don’t know how bad the situation would have become if the second store clerk was not armed.  We do know the shooting stopped when the criminal was wounded.  The wounded robber, age 25, and his 20 year old accomplice are in police custody.

rachel 5- A convenience store clerk in Rutland Vermont has been fired.  58 year old Don Pitaniello was closing up Mac’s Convenience Store Monday night when a man wearing a hoodie and a bandana over his face entered the store and threatened him with a roughly 5-inch blade.

Quote, “I looked up when I heard the doorbell chimes and saw the hoodie, the bandana, and a bag in his hand.  He (the robber) walked up to the counter, laid the knife on it and said ‘Empty the register.’”

The store clerk has carried a handgun all his life and had his .380 in his grasp and behind his back before the intruder made it to the counter.  The robber waved his knife in Pitaniello’s face, and the store clerk responded by pointed his handgun at the robber. Thats when the robber fled.

The store had been robbed at least eight times, and this attempted robbery is the the second time in a week that an assailant armed with a knife has demanded money from convenience store clerks in the Rutland.

The clerk, Don Pitaniello said, “I can always find a new job.”

Rob6- Some people can’t find another job.. not when they own the business.  Kent Wright and his wife live in Red Lake Falls, Minnesota.  They were sleeping the the basement of their convenience store early Father’s day when they heard a noise upstairs.  Kent went upstairs when 16 the year old intruder hit him in the head with a flashlight.  Kent recovered, and rather than shoot the youngster with the pistol he carried, the threw the youngster to the ground and jumped on him.  Quote, “I got on top of him and said don’t you move and I said a few other choice words I shouldn’t repeat.”

Thank you for your restraint, Mister Wright.  You, sir, saved a young man’s life.  The 16 year old male was charged with  1st degree burglary.

Comment- I’m surprised he wasn’t charged with assault, too.

Paul 7-  Speaking of choice words, this reads like a bad detective novel.  A traveling contractor in Jackson, Mississippi was staying the night in a Motel 6.  While crossing the motel parking lot, a stranger asked him for a cigarette.  He said he didn’t have any.  That is when the stranger drew a gun and said, “I bet you don’t have one of these, either.”  The robber lost the bet and the intended victim shot him.  The robber ran, but was soon picked up by police.  The charge against the robber have been filed with the Hinds County Jury.

John8- Two intruders broke through a front door and demanded money from the occupants of this Valdosta, Georgia home.  One of the robbers was armed with a rifle, and the other was armed with a handgun.  Two of the occupants of the home, a mother and son, were both shot as they attempted to flee.  Another occupant, an older man, was in the back of the house, and he grabbed his own handgun when when he heard the noise.  He shot both intruders several times.  The intruders ran but were soon picked up by police.

The robbers claimed they were victims of a separate shooting, but were identified by the homeowners.  That is why YOU want to be the first one to call police.

Seg 2- News

Rachel- comments on the Texas elections
Turnout for primary elections is typically low. The same goes for run-off elections. How about a primary run-off? Around 5% of Texas’ registered voters made it out for several statewide races and another handful of local races. The gun groups’ top pick for Lt. Governor (the president of the Senate) didn’t make it to this run-off, and most gun rights people were disappointed with the two choices we were given. We ended up kicking out the current guy, Dewhurst. We’ll see how the new one does. We did have an unfortunate loss in a house race: TJ Fabby, whom I’ve dubbed the Constitutional Carry Candidate, lost his election in the primary run-off yesterday. Now we’re going to have to work harder than ever for strong gun legislation next session.

We did have some wins, though! This primary season, we’ve thrown out several incumbents and will be replacing them with more liberty-minded reps. That should help.

Rob: Here is my rant on the Santa Barbara murders.

This is an un-teachable moment.  A young man stabbed three people on Friday.  He hit several people with his car and shot three people next to the University of California Santa Barbara campus.  This should teach us what makes us safe and what doesn’t.  This event should teach us.  The sad news is we don’t want to learn.

In his published statements, a pampered murdering son blames everyone for his failures. everyone except himself.  He drives an expensive car and lives a luxurious life he didn’t earn.  He writes about hating his parents and wanting to stab his step mother and half brother.  The murder’s father said he hates guns and wants better mental health treatment.. for his son who has been in therapy since he was eight years old.  A father of one of the victims blames the NRA and politicians who allowed guns into the world.. while his son was killed in a gun-free zone.

Do you notice a pattern here?  The father blames mental illness.  The victims father blames guns and the NRA.  The son blamed others for his problems.  Unfortunately, we are also part of that same pattern.  We refuse to learn from past mistakes and we blame others instead of providing real solutions.  Let’s stop placing blame.

Instead, let me describe the next public murder for you.

  • The murderer has a narcissistic personality and demands attention.  He wants his name in the news and will kill to get it there.
  • The attack is launched against people in a gun free zone because narcissists don’t like competition.
  • The murderer has mental health issues and is probably be on psychotropic drugs prescribed by a doctor.
  • The murderer is enthralled by violent video games and spends a lot of his time playing them.
  • There are warning signs, and they are ignored.

Making predictions about the media’s reaction to the next public murder is too easy.  Liberal media will blame the NRA and lax gun laws even though the murders took place in gun-control paradise.

This crime took place in an anti-gun state, in an anti-gun county, in an anti-gun school zone.  This crime should have been impossible if gun control actually worked.  Evidence screams that gun control doesn’t work, but we won’t learn from our mistakes.  Instead, liberal politicians will double down on gun-control and claim it is for the children.  The media will support them.

Here comes the new tragedy, same as the old tragedy.. until we learn.  <Rant off>

Rachel-  Documents indicate he planning the murders over the last 5 months.

Gary: Joe the plumber comment – will comment on this.

John – From Tam at View from the Porch is probably the best comment on how the media reacts: “So there’s a “mass* shooting” that would have been a page three wet firecracker in Compton, but do it to some cracker kids from the ‘burbs serving their four years at the Special Snowflake Warehouse & Indoc Center and the nation just loses its collective $#!+.

Apparently busting caps in three people’s asses isa lot bigger deal if you do it out the window of an ’08 Bimmer instead of a ’94 Caprice.”

Rachel- By Saturday morning the Moms Demand more money group on Facebook had many posts  blaming the NRA.  They are blaming the NRA for the murders committed by a confirmed anti-gun hollywood sociopath.  Any excuse will do.

Comments.  Rob: They blame the biggest firearms safety organization in the country.  Now that is stupid.

John- The 22 year old murderer purchased his firearms legally in California and passed three background checks as an adult.   He was not a prohibited person even though he received numerous requests by his family for police to visit the student and perform a wellness check.  This after he had been in therapy since he was 8 years old and was now seeing multiple therapists.  One of the therapists works for the Los Angeles County Department of Family and Child Services. California law applies, so I hope the therapists are very well insured.

Gary- This murder is similar to others.  The murderers at the elementary school at Sandy Hook, Connecticut, at the movie theater in Aurora, Colorado, at the Washington Navy Yard, and at Fort Hood were equally crazy.. and all of them passed background checks because they were not prohibited persons.  We simply have no way to anticipate violence.

Rachel- That doesn’t stop the politicians.  Democrat Senator Richard Blumenthal from Connecticut and Representative Peter King from Long Island, New York called for stricter firearms legislation after the California murders.   Quote, “Obviously, not every kind of gun violence is going to be prevented by laws out of Washington, but at least we can make a start.”

Really, Senator?  Really, Congressman?  After passing some 23 thousand laws restricting firearms, I kind of hoped you’d be done by now and we could finally see the beneficial results you promised from gun control.  As far as I and the researchers can tell, the beneficial effects of gun control are always one more law away.. and always will be.  They didn’t slow this murderer down, and the next law won’t either.

Break –

Gary- Background checks don’t stop murderers and they don’t bother criminals.  Thieves targeted Florida gun owners in their search to illegally acquire guns.  Four cars were broken into during broad daylight in a high traffic parking area for a central Florida gun show.  Thieves made off with guns, ammo, cameras, and other items while causing thousands of dollars in damage to the vehicles.  I guess the thieves aren’t going the legal route and submitted to those background checks the anti-gunners are so proud of.

Comment- Rob, that doesn’t stop the anti-gunners from claiming gun registration and background checks are wonderful.

John- The media loves a good massacre, and loves to ignore one.  In Chicago late last month, 39 people were shot in one weekend.  That is predominantly black-on-black crime and ignored by our national media.  Instead the media focuses on the sizzle of a sociopathic pampered playboy driving a BMW in California.

Rachel- Here is more news from Chicago.  Mayor Rahm Emanuel is proposing a far-reaching ordinance that would keep gun stores out of 99.5 percent of Chicago.  It also requires stores to videotape every sale.  They also would have to get the police to approve a security plan before they could open their doors.  What stupid federal judge allowed Chicago politicians to make those rules?

Gary: do we have his name.

Rob- There may be a limit to the stupidity of New Jersey politicians, but not much.  It appears the magazine capacity bill that limited magazine capacity to 10 rounds now exempts tube fed 22 rifles.  I don’t know how they made that change after the bill went through committee, but breaking the law would never bother a Jersey politician.

John- This news is right out of the Acorn Scandal.  Anti-gun lawmakers in Rhode Island wrote a 10 percent sales tax on guns and ammunition.  That is an additional ten percent on top of the existing federal, state and local taxes.  These tax proceeds are supposed to go to law enforcement, except law enforcement is allowed to give the money to non-profit anti-gun groups.  These are the same anti-gun groups who donate to anti-gun politicians.

The anti-gun politicians just wrote themselves a campaign donation with taxpayers money.  Rahm Emanuel and the Chicago machine would be proud.. or envious.

Comment- If you wanted to promote gun safety you’d give the money to the NRA.

Rachel- There is some good news down south.  Louisiana governor Bobby Jindal signed two firearms bills into law.  The first allows concealed carry holders to enter a restaurant where liquor is sold, though they can not drink alcohol.  The law also allows current and retired law enforcement officers, judges and district attorneys to carry concealed in bars.  There are laws for them and separate laws for us.

The second law expands the castle doctrine.  Louisiana already protected the homeowner from being sued if they killed a criminal breaking into their home or car.  The new law prevents suit if the criminal is only injured.

Rob- Here is a bit of good sense from Georgia.  Appling, Georgia to be exact.  Citizens interested in learning how to safely carry, handle and shoot their handguns were invited to the Columbia County Sheriff’s Office Citizen’s Firearms Academy. The free class was held on Saturday at the sheriff’s Training Center.

The class informed citizens about firearms laws in Georgia, and developed marksmanship and safety skills. Georgia has new open carry laws and there was a live-fire portion of the class as well.  Georgia listeners can follow the link in our show notes to look into the next class.

John- Texas is far from perfect.  Amelia Pickens called police about a car she suspected had hit her daughter’s car.  Arlington police officer Phil Hill arrived and two of the car’s occupants were ultimately arrested, one for an outstanding warrant and one for possession of a controlled substance.

When Amelia handed over her license and proof of insurance, she explained she had a CHL as required by Texas law.  That was when Officer Hill seized her purse and confiscated her firearm.

Pickens said, “I’m disabled. My husband goes out of town quite frequently. I have to be able to defend myself.  There should have been no reason why at all that he took my gun. I didn’t do anything bad with my gun.  I didn’t brandish it. I didn’t even say I had a gun.  The only time my gun was mentioned was when the officer asked me for my drivers license and insurance. I have to show my CHL at that particular point.”

It sounds like Arlington Police need a law suit, a monetary judgement, and some serious retraining.

Gun Quote of the day
Rob- Criminals obey gun laws like politicians follow their oaths of office.. source unknown.
Hang on everybody, we’ll be right back after this advertisement from Concealment Solutions.

Segment 4 DGUs

Rob- A 22 year old man in Orosi, California heard someone trying to enter his home at 5:30 in the morning.  His parents are farmworkers and had already left for the day, while he supervised his three younger siblings.  The 22 year old grabbed the family gun and traded shots when the thieves broke through the door.  He was shot multiple times, but Police found two suspects outside the home also suffering from gunshot wounds.  One died, and the other underwent surgery.

The young man who defended his family is expected to fully recover.  Police say there are still suspects at large and are seeking the driver of a gray Astro Van and they have the license number.

Comment- Rachel- As I tell my students, crime doesn’t make an appointment.  Carry or hope you guess right.

Rachel- Retired Police Officer Derek Bishop sat in a Mercedes in East New York at about 3:15 Tuesday morning.  Bishop works security at a nearby recycling plant when Manuel Ocampo and his 18-year-old cousin approached the car, pointed a gun at Officer Bishop.  The thieves demanded his money and keys.  Bishop gave the pair some money, but they demanded more.  The cousin, Rashawn Thompson, moved to the passenger side door and Manuel Ocampo stayed on the driver’s side.  That is when Officer Bishop got out of the car, drew his weapon and opened fire, hitting Ocampo in the chest and head.  He died at the hospital.

“It’s not a good feeling to shoot anybody,” Bishop said Tuesday afternoon, tears streaming down his face. “It was just something that happened. I didn’t want to die. I wanted to be able to see my kids and my wife.”

Comment-  Rob, I have sympathy for the officer, but I also have sympathy for the rest of the legally disarmed civilians in NYC who deserve the right of self- defense so they too can go home and see their loved ones.

John -Two robbers entered the Wholesale Mattress Warehouse in Charlotte, North Carolina on Sunday afternoon.  The thief put a gun in the store owners face and demanded his cellphone and cash.  He threatened to kill him if he did not comply.  The store owner reached into the till and pulled out a gun of his own.  He shot one of the robbers and the robber fired back but didn’t hit the store owner.  The injured suspect was transported to Carolinas Medical Center with a bullet wound in his stomach.  The shooter is cooperating with investigators, police said.

Comment- Rob- Action beats reaction, but only if you practice.

Rob- This is a good week for defensive gun use with no shots fired.  For starters, 22 year old Jessica McDonald works at Discount Textbooks in Fort Dodge, Iowa. She had just opened the store at 9 in the morning when a man came in, put a bandana over his face and demanded money.  Jessica showed him the still empty till.  The robber came around behind the counter and repeated his demands.  That is when Jessica grabbed the gun kept behind the counter and pointed it at the thief.  She told him to leave the store as she backed away with the gun pointed at the man.

She said “I feel comfortable now using it, but I always said I never thought I would.  It was shocking to me when I started here that there is a gun and I always thought it was over the top and we didn’t need it, but I’m very glad that we have it.“

Store Manager Paul Tigges said the firearm was put there for employees’ safety.

The thief fled and the police do not have suspects in custody.

Comment- This is why you should carry.

Rachel- Two men repeatedly called a young woman in Salt Lake City, Utah.  After she stopped answering the phone, the two men, armed with guns, kicked in the door to her home.  The girl’s father grabbed his handgun and confronted the intruders who were young men he recognized.  The intruders fled.

The two men were quickly arrested on suspicion of aggravated burglary and aggravated assault. They were booked into the Salt Lake County Jail.

Comment- These young men are lucky to be alive.

Episode 238 – Memorial Day and Frank Fiamingo

Seg 1
Personal news from each participant
Paul- Memorial day
Paul- mag 40 and the bucket list

John- I’m wearing my CalGuns Tee in honor of their latest lawsuit against Kamala Harris. I’d like to also like to remember those who have died in the service of our country. Without their sacrifice – and that of their families – we wouldn’t be the nation that we are.

Rachel- Last weekend, I visited the Silencer Shop here in Austin along with a friend who was picking up a suppressor he’s been waiting for five or six months. This week, a friend suggested I take a stress-relieving trip to the range (brilliant) – but the best I’ve been able to do is to wear my T-shirt that says “Bullets Make Me Happy” and dream about shooting cool guns.

Rob- I’m now an NRA pistol instructor. That was a long 2 day course, but it definitely changed my attitude. I took the course so I would be consistent and teach my friends. I changed my mind because I don’t want to be an average instructor even if I only teach a few friends. That means that I have to go back and unpack the class notes I just crammed. I have my reading set out for me for the next few weeks as I study and re-study the material. Second, we learn to teach by teaching. That means I have to work with and watch better instructors if I’m going to do justice to my students. I have to apprentice myself.

In the class I met a guy who makes custom holsters, so I have three new kydex holsters and mag pouches on order for my 22 handguns.

Today I visited a brand new firearms store with a laser training simulator in my town.

John, I still haven’t gotten to shoot the Mosin Nagant with Mojo sights. Did you see the pictures of the sights?Mojo sight rear

Rob- Have you guys seen the new episode of Colion Noir’s interview show called Noir on NRA Freestyle TV?  It stars Colion and Amy Robbins.  Episode two is out.  I’ll watch a few more episodes.

Comments- Why is this program about pop-culture and firearms important?

Paul- A murderer near the University of California at Santa Barbara killed for 10 minutes in streets filled with university students walking, biking and skateboarding in the beach community.  The murderer acted in a way that was similar to the threats he posted on a  YouTube video posted that same night. Seven people were killed in all, including the shooter.

During the statement by the murderer’s family’s attorney, it was revealed that the family is staunchly anti-gun and support gun control laws. Quote “This country, this world, needs to address mental illness and the ramifications from not recognizing these illnesses.”

Comment- Where have we seen this before?  Arapahoe High School, Colorado

Comment- Crazy people, particularly rich crazy people who want sex and resent their social awkwardness do a lot of damage when no one can stop them.

Comment- gun free zone in a “won’t issue” California county.

John- We told you about the Hinsdale Illinois eagle scout who was suspended for a day after he wore a shirt with an outline of a gun that advertised his shooting team.  Highschool senior Chris Borg spoke at the school board meeting.  Both the school board and the school administration were evasive enough to make my stomach turn.  The school said they would remove the suspension from Borg’s record.

Comment- Why is it important to publicly ridicule anti-gun bureaucrats?

Rachel- Remington Arms is moving another two of its firearms models from its Ilion, New York facility to its new plant in Huntsville, Alabama.  This includes its line of Bushmaster rifles and its 1911 handguns.  Federal legislators like New York Senator Charles Schumer and New York Governor Cuomo endorsed gun control, and then claimed it wouldn’t cost jobs.  It looks like the New York politicians were wrong again.. not that they care.  Ilion New York is closer to the Canadian border than it is to New York City.. and probably didn’t vote for them anyway.

Comment- Why does this matter to New York gun owners and New York voters?  Why does it matter to the rest of us outside NY?

Rob- My sheriff Bill Gore, the Sheriff of San Diego County, now says he wants the California Attorney General Kamala Harris to appeal the Peruta court decision.  Kamala Harris also said she did not want to be part of the Peruta case.. until the gun grabbers lost the case.  Originally Gore said he wanted to hand out carry licenses, but the law prevented it.  Then he said he would obey any decision handed down by the courts. Now he says he wants someone else to appeal the case.  Sheriff Gore’s changing his story doesn’t surprise me at bit.  The only amendment Gore supports is the fifth.

Comment- What is the political cost if an incumbent Sheriff lies to his constituents?

John- This is what happens when corrupt anti-gun politicians can “interpret” the law in Colorado.  Sara Warren has her carry license.  She was in a traffic accident and the police collected her firearm from the EMTs.  Now, Sara can’t get her gun back because the Fort Collins city attorney won’t give it to her.  First the city attorney said they needed a background check, so Sara gave them all the information they needed.  Then the city attorney said they needed an FFL, so Sara brought along a police officer she knew who was an FFL and who would transfer her firearm back to her.  The anti-gun city attorney threatened to prosecute any officer who transferred the firearm to Sara Warren.

The police are allowed to temporarily hold a firearm for 72 hours without a transfer.  They should have returned her firearm at that time.  The Fort Collins city attorney only agreed to return her firearm when the press started pestering him.

Comment- Who is politically responsible for these decisions?  (The mayor or city council appointed Steve Roy as City Attorney.
Why is this important to Colorado gun owners?
Why is this important to all Colorado citizens?
Should Sara have reported the firearm stolen since it was taken by extra-legal means?

Rob- How many of you have heard about Doctor John Lott?  He wrote the books on guns and crime.  Books like “more guns less crime” and “The Bias Against Guns.”  Dr Lott digs out the anti-gun lies and destroys them root and branch.  I’ve read three of his books and shaken his hand at the GRPC conferences.  Dr. Lott started a research institute about guns and crime, and he wants to fund the institute with crowdsourcing.  Bloomberg dropped a few million dollars on a university so the purchased professors would spew out the anti-gun research papers that Mayor Mike wants.  Until we find the billionaires for liberty, you and I have to fund Doctor Lott.  I said we.  I did.  Now you do it too.  His effort is called the Crime Prevention Research Center on Indigogo.  Here is the Facebook page.

Comments- Why is accurate research important to the right of self-defense?

John- Just because the Brady Campaign has been made largely irrelevant by Michael Bloomberg’s money and Everytown Moms for Illegal Guns doesn’t mean that they still can’t cause trouble. On Monday, they filed suit in conjunction with their NJ chapter to force the Acting Attorney General of New Jersey to file the required “personalized handgun” report. If the AG attests that a “smart gun” has been either offered for retail sale or that a manufacturer has delivered a production model of one to a FFL, then the 3-year clock starts. After that time ONLY “personalized handguns” will be allowed to be sold in the state of New Jersey. The timing of the filing of the suit came a day after Ernst Mauch who is the head of Armatrix had an op-ed in the Washington Post about “smart guns”.  While it could just be a coincidence, that is highly unlikely.

Comment- Rob- The legal tactic is called sue and settle.  A politician finds a special interest group to sue the state, and then the state offers no defense.  The presiding judge dictates the terms of the settlement.

Comment- What problem is the smart gun supposed to solve?
Comment- Why are LEOs exempt from the smart gun law?

Rachel – The CalGuns Foundation and Cal-FFL have filed suit against CA AG Kamala Harris in Sacramento Superior Court. Harris has recently issued a new interpretation of a long standing law in California which would limit those who have a FFL and a Cal DOJ Certificate of Eligibility to one handgun per month. This impacts those who have the Curios & Relics FFLs and a DOJ certificate. Harris is saying the exemption in the law to the 1 handgun in 30 limit is only for C&R handguns and not more modern handguns. Attorney Bradley Benbrook says this blocks individuals from exercising rights granted to them by the Legislature. The case is called Doe v. Harris.

Comment- What is the problem with Attorneys General adopting their own interpretation of standing law?

Paul- Rob had a rant about smart activism versus simply grabbing public attention.  Now the chain of Chipotle restaurants has asked citizens not to carry on their property.  The Denver-based company has traditionally complied with local laws regarding open and concealed firearms.  Guys, I’d ask you to carry concealed or carry smart.

Other businesses took a different approach.  “Dunkin’ Donuts and Baskin-Robbins restaurants are owned and operated by individual franchisees who are required to follow all federal, state and local laws with regard to firearms,” said a Dunkin’ Brands spokeswoman.

Rich Jeffers, director of communications at Darden Restaurants, the parent company of Olive Garden, Red Lobster and LongHorn Steakhouse said “Our approach has always been that we abide by all local and state laws.”

McDonald’s spokeswoman Lisa McComb said: “For franchisee-owned restaurants, operational decisions regarding open carry weapon laws are made by the independent franchisee.”

Comment – Shannon Watts and her minions are trolling the Internet looking for pictures of open carry in Texas. It doesn’t matter if it hasn’t been done in a year, she’ll try to make an issue of it. She posted year-old pictures of OC at a Smashburger even though they had to stop allowing open carry last year.

Rachel- Here in Texas, several open carry groups have made a joint statement calling their members to be responsible and wise as they exercise their right to open carry firearms. I applaud them for this self-regulation. Their new policies are designed to keep their stated mission in focus, and include instructions to notify law enforcement, use slings, leave a business quietly without a problem when asked to, and, when carrying inside a business, try to keep to local small businesses that are 2A friendly. While the Huffington Post reported this as “backing down” by the open carry groups, I see it as moving forward. Regulating themselves responsibly is a wise, strategic move as they present a positive image of gun ownership and bearing of arms to the American public.

John- The Pit Authentic Barbecue restaurant in Durham, North Carolina was the site of an armed robbery last Sunday night. Three masked men with pistols entered the back door, assaulted a couple of employees, and got away. NC Gun Blog points out, “The robbers had all the power. No one could resist them. Why? Because the owner of The Pit Authentic Barbecue has banned guns in his restaurant.”

Blogger Sean Sorrentino also states, “I am very glad that no one was seriously injured. But everyone involved needs to face one very important fact. They were not murdered only because the robbers did not decide to kill them.” It appears that the restaurant owner was making an intentional political statement with his gun-free zone. Last year, his restaurant hosted part of  Gabby Gifford’s anti-gun tour. Looks like the robbers made a statement of their own.

Jack in the Box fast food restaurants issued a similar no-guns policy for company owned stores, and three of their stores were robbed.

Comment- Are gun-free stores safe for anyone?

Stores have to properly post their no-guns policy in accordance with state regulations or the signs don’t have the force of law.

Rob-This is the season of primary elections.  That means we’re sure to be disappointed, but it also means we have to take joy in other’s successes.  In West Virginia, a 17 year old high school student ran against a sitting state delegate.  Sara Blair is graduating from high school later this month and will be in the general election in the fall after her electoral win.  Sara describe herself as a fiscal conservative who is pro gun rights, anti abortion and pro business. She is expected to win the election in the fall.

Comment- Why is it important to have young pro-gun politicians in office?

Paul-Voting along party lines, the Democrat controlled New Jersey legislature sent Governor Chris Christie a bill limiting firearms magazine capacity to 10 rounds or less.  There is neither a grandfather clause in the bill, nor is there a provision for reimbursements so citizens can make their firearms comply with New Jersey law.  The law isn’t clear if the magazine capacity is only determined by the standard ammunition used in the firearms, since 22 shorts can be loaded into a tubular magazine as well as 22 long rifle cartridges.  Of course, the restrictions to not apply to law enforcement officers.  Please write Governor Christie and ask him to veto the bill.

Comment- This is cultural cleansing of firearm owners from New Jersey.  The Democrats want firearm owners to leave the state.

Rob- Gun Quotes
“When the law disallows both the means and moral authority to defend one’s self and property, crime and violence fill the void between common sense and the hoped for utopia.”  – JD Filkins

Paul- Hang on everybody, we’ll be right back after this advertisement Concealment Solutions and the interview with Frank Fiamingo of NJ2AS.

Segment 4 DGUs

Rachel- Don’t mess with Texas, and certainly don’t mess with 17 year old Samantha Mayhue’s who lives in Cypress, Texas near Houston.  There have been half a dozen car break ins this year on this otherwise quiet street.  That explains why there are dual electronic locks on the front door at Samantha’s home.  She still thinks someone would have to be crazy to try and break into her house where a Texas flag flies on the driveway.  She heard someone try her front door before the alarm sounded.  Samantha went straight for her father’s Glock and called the police.

“Everyone knows we have guns in here.  Daddy taught me right. I wasn’t afraid to do what I needed to do.  I was going to pull the trigger and aim for the chest and keep pulling it until the 17 rounds out of my dad’s Glock 19 was gone,” Mayhue said.  Luckily, the alarm scared the would-be intruder away.  Samantha Mayhue wants to be a tactical firearms instructor in a few years.

Comment- Does disarming a young lady make her safer or put her at risk from others?

John- Muncie [IN] police say a convicted bandit got more than he bargained for when he tried to hold up a south side liquor store late Friday. Authorities said Anthony J. Williams, 47, was shot in the pelvic region as he struggled with a female clerk over possession of a handgun. Williams entered the liquor store about 11:15 p.m., pretended to have a weapon and demanded cash from the female clerk. The clerk believed Williams was trying to grab a handgun that was behind the store’s counter. A struggle then ensued between the clerk and Williams, ending when the gun discharged, seriously wounding the would-be bandit, police said. Williams was transported to IU Health Ball Memorial Hospital. Police at first thought his wound was potentially life-threatening, but later reports that his condition is believed to have stabilized..

Comment- Rachel, this sounds like having a gun under the counter is as ill advised as purse carry.  Why not carry on body?

Rachel- Back in Houston Texas- A man was walking through an apartment complex late Wednesday night when he was approached by a man who demanded he surrender his wallet and cell phone.  The victim felt threatened enough to draw his concealed handgun and open fire on the suspect.  The suspect was hit twice, but still managed to run to a waiting getaway car. He was picked up by police at a nearby hospital.  The suspect was in surgery early Thursday morning.  Police don’t expect to file charges filed against the robbery victim.

Comment- Robberies, like other accidents, happen where we are, and we are often near home.

John- A Granville County, North Carolina homeowner is safe and unharmed after burglars tried to break into his home Tuesday morning. The same cannot be said for one of the burglars. 20 year old Rodney Hanks Junior broke into a home Tuesday morning with a gun and a knife.  The homeowner shot him.  His fellow burglars were seen leaving the scene and are still on the loose.

Sheriff Brendell Wilkins said they are not releasing the name of the homeowner for his safety. He went on to add regarding the homeowner, ““They were breaking into his house; you’ve got the right to defend yourself. The suspect had a gun and a knife.” That is a sheriff who gets it.

Paul- Don’t bring a crowbar to a gunfight.. at least in Fort Wayne, Indiana.  Nathan Simmerson and four other masked men broke into a home Tuesday night.  Simmerson went upstairs.. where he met the armed home owner.  Simmerson, armed with a crowbar, fled and locked himself in a bathroom.  One of the downstairs victims yelled for the homeowner to come down with his assault rifle.. and the four downstairs robbers fled.  Simmerson tried to run but was tackled by the residents and held for police.  Simmerson says he doesn’t know the names of his accomplices.  I noticed that the papers already had his picture on file.

Gary- Don’t bring a baseball bat to a gunfight either.  A Toledo, Ohio woman and her boyfriend were attacked by a man wielding a bat Monday afternoon.  The boyfriend was struck on his arm with the bat.  The woman has her concealed carry permit and drew her pistol from her purse as the attacker moved toward her.  She fired twice and the attacker ran.  The attacker drove to the University of Toledo Medical Center in a private vehicle seeking treatment for gunshot wounds to his legs.

Comment- How quickly could you react to an attack?

Paul- More from Struthers, Ohio this last Wednesday.  Two teens entered a Sami Quickstop convenience store just after midnight in this Youngstown suburb.  One of the teens raised a rifle and pointed it at the store clerk.  The criminal fired and missed.  The 20 year old store clerk with a CCW drew his own handgun, shot and hit the 17 year old gunman Ja’Braelyn Bunn.  Both teens ran from the store.  The teen gunman is in the hospital while his accomplice is in juvenile detention.  Both face charges for armed robbery.

Comments- What would you do if you were in the store?

John- We have more, and it’s not from Houston, Detroit or Ohio.  I hope you’ve heard about the 300 young Christian girls taken as slave by the Islamist group Boko Haram in Nigeria.  Note that civilian ownership of firearms is forbidden in Nigeria.  Thank god some villages break the law.  Several villages armed themselves and counter attacked against Boko Haram.  They claim to have seized 90 motorcycles, several heavy trucks, and to have killed approximately 250 of the terrorists.  One villager was quoted as saying that they would kill the terrorists themselves since the army wasn’t doing its job.  Note that defenders typically have a three-to-one advantage over attackers.

Comment- Is this any different than the problem faced by citizens of New York or Chicago of a few years ago?

Gary- 24 year old Victor Navarro walked into the HealthMart Pharmacy in Hialeah, Florida, a suburb of Miami, just after noon.  The 24 year old demanded Xanax and was turned away by the pharmacist.  Victor Navarro came back to the pharmacy and pulled up his shirt showing a handgun, and again demanded drugs.  This time the pharmacy manager, 70 year old Angel Navarro Betancourt, no relation to the victim, shot and killed Victor Navaro.  The young man was said to have a severe drug addiction.. and the gun in his waistband was a BB gun.

Comment- Threatening people will get you killed.

Paul- Here is our listener e-mail segment.  This one is from listener Rob

-Hi guys,
I hope I can help end the spitting match over Facebook likes with the Polite Society. I’m a big fan of both polite society & slam fire radio podcasts. As a U.S. citizen I’m partial to my American podcasts. Buuuuuuuut, my wife of 10 years is a Canadian citizen. I obviously like Canadians too.  I listen to both Trevor’s podcasts for the content, hosts and because I enjoy the accent. You know what I’m talking aboat, eh?

So let’s get down to reality and accuracy with the Facebook likes. I really enjoy Paul, Rob & Rachel but Slam Fire Radio is ahead by a long shot.
The math is very simple. Polite Society has more Facebook likes but when you factor in 236 vs 57 episodes and a population approximately 300 million vs 30 million. Slam Fire is kicking some serious Facebook ass.
I’m just say’n

Ps. One good thing about Canadian gun laws is, it makes my New York State gun laws look pretty awesome.

Rachel-Here is another e-mail from listener Rick.

-Hey, guys
When Paul returns you will have to give him time to recover from Mag40.  He will be mentally drained, physically exhausted and amazed at all the new like-minded friends he made.
Oh, and he’ll be saying “I digress” a lot.
Still listening.

Rob- I have an article on Clash Daily and Ammoland.  It is called Criminals Commit Suicide by Citizen and it came from the news stories we read on this podcast.

Rachel- John, do you want to mention anything off of your blog you would like to talk about?

John- One hiker is dead and one in critical condition after being robbed and shot while hiking in Tehama County, California. Neither were armed. The robber asked for their property and then killed Pat Gregory, 69, of West Tisbury, MA. His 76 year old companion was left for dead on the trail and is in the hospital. People ask why you should carry while out hiking and communing with nature. This is why you carry!

Comment-  What is the moral of this story?  You can’t guarantee your safety by complying with criminals.
