Rob- I’ve had a busy week.  I joined Bill Frady on his Lock and Load Radio program. We talked about Self-Defense Gun Stories.  I was on Steve Pauwels’ Striker Radio to talk about gun culture. I was also on Armed American Radio with Mark Walters, and we talked about the death threats leveled against the women who advocate for self-defense.  Tom Gresham also retweeted one of my blog posts. I carried every day and got to eat breakfast with a traveling firearms instructor.  Thank you, Tracy Thronburg.  How about you, John?

 

John – Congratulations on the retweet. I hope it drove readers to your blog.  I received my media badge for the SHOT Show and Industry Day at the Range as did my wife. It is hard to believe that it starts in little more than a month. I had a nice discussion on training and carry with a client and friend who is a lesbian. Her partner is still wary of firearms and we discussed some of the things to help. Other than that, we’ve just been getting ready for Christmas like everyone else.

Amy –  Unfortunately, I have been busy these past few weeks taking care of family emergencies, which is why I have been unable to record the past few podcasts. But, I do want to thank everyone who has reached out to check in with me, and while my family still has a lot to deal with moving forward, I am back at work and making plans to get ready for SHOT show and the rest of 2018.

 

Tracy- I just got back from the MAG-120. This was my most favorite class EVER! We shot double and triple speed qualifications, long gun qualifications, shot the Florida Department of Law Enforcement qualification, got to shoot from a moving vehicle, had a night shoot, performed handgun retention and disarming maneuvers every day, had a 4-hour block of Kubaton (™) instruction on the last day of class, and had great guest instructors. I was also the class champion for the handgun sniper shoot. My STI Trojan ran great. I can’t wait until the MAG-180 in June of next year. I also got to have breakfast with one of my favorite podcasters yesterday. It’s always good to see you, Rob.

 

Belle- Shot an IDPA match in Renton. I did pretty decent. No major mistakes and no gun or ammo issues, for once, thankful for that! Going to try and get out next weekend for another IDPA match. Have to get as much competition as I can before training season starts in the spring and i’m working weekends again.

Rob- CHICAGO COMMISSIONER CALLS FOR THE UN TO HELP SOLVE CITY SHOOTINGS EPIDEMIC

 

We have all heard of the high numbers of gang and drug related shootings that take place in subsections of Chicago. Now, Chicago’s Cook County Commissioner Richard Boykin has called for the United Nations to intervene in the city.

 

Commissioner Boykin met recently with the UN’s Assistant Secretary General Oscar Fernandez-Taranco, in New York to discuss the “quiet Genocide” in Chicago’s black community.

 

Saying that “The United Nations has a track record of protecting minority populations” Commissioner Boykin said “we have to do something.. black people make up 30% of the population in Chicago, but 80% of those killed by guns.”

 

When asked if he would welcome foreign troops on the streets of Chicago, Commissioner Boylin replied “I’m talking about whoever the UN would decide to send in.. He may  have some ideas about how we get peace in these communities.”, continuing “We can’t wait for the mayor to put another 1,000 police officers on the streets..”

 

STOP PRESS UPDATE:

Commissioner Boylin confirms that the UN will “accept an invitation” from the city to visit, once a youth violence study is completed.

 

We’d like to know what we think of our cities officials calling for the UN to solve problems here in the USA that those cities’ elected officials seemingly cannot.

John – HOTELS TO BEGIN ELECTRONIC SCANNING FOR CONCEALED FIREARMS

 

Following the recent Las Vegas atrocity, where 59 concertgoers were killed by a murderer shooting from a hotel window, One hotel has decided to use  radar to scan their guests at checkin for the presence of concealed handguns and other firearms.

 

The Westgate Las Vegas Resort and Casino has deployed a weapon detection device made by the Canadian company PatriotOne Technologies. This technology scans customers without their knowledge or consent. The devices are so small that they can even be installed in hotel room doors.

 

The Chief Operating Officer at the Westgate LAs Vegas, Mr Mark Waltrip, says that the hotel will have a 100% scan rate of all guests in order to “maintain a safe environment”

Amy- NANCY PELOSI GETS THREE PINOCCHIOS FOR HER REMARKS ON THE NATIONAL RECIPROCITY BILL

 

Following the passing of HR38 through the House, Senate Minority Leader Nancy Pelosi went on record preaching doom, gloom and the end of civilization as we know it over Twitter and other social media platforms.

 

Stating that the new Bill would “invite violent criminals, convicted stalkers and domestic abusers to carry concealed weapons.” Minority Leader Pelosi ranted with demonstrably false and self-contradicting statements.

 

Now, the Washington Post has awarded her three Pinnochios for lack-of-facts. We wonder how many are in her collection.

Belle – THE FIVE YEAR ANNIVERSARY OF THE NEWTOWN ATROCITY

 

The weekend of December 15th marks the 5th anniversary of the murder of 26 pupils and teachers at the Sandyhook Elementary School, in Newtown Connecticut.

 

Everyone knows the story of what happened. Five years later, schools, parents and local authorities still disagree on how to prepare for such events. Many still use it as a source of political gain and activism.

 

Here at the Podcast we hold out our hearts to the grief of those who lost loved ones and to the bravery of the school staff who stood in defense of those children.

Rob- Oak Park, Illinois

When armed robberies become common place, you must protect yourself.  In the first 10 months of 2017, Oak Park, Illinois has had 47 reported armed robberies and 40 more unarmed robberies.

A week ago at the 7-Eleven, three people entered the store and at least one of them displayed a weapon.  They were wearing masks or bandanas and demanded cash from the clerk.  The clerk was armed legally and opened fire on the three, leaving one in critical condition laying on the store floor.

Just the previous week, the same store was robbed at gunpoint in the middle of the afternoon.  A man entered the store, showed a small handgun and ordered the cashiers to put money in a bag.  The workers removed $147 from the register, put it in a plastic bag and put the cash on the counter.  The man grabbed the bag and left the store.

In that case, no one got hurt, but that won’t always be the case.

Gary- The Oak Park police chief and mayor said it was unfortunate that the thief was shot. These government officials did not celebrate that the clerk went home alive. The victim attitude is spreading.

John – Oak Park used to ban handguns just like Chicago.

Amy- Columbia, Missouri

When Levi Strodman’s wife heard a knock at the door, she told him about it.  He grabbed his pistol and went to the door to see who was there.  Of course, we call it POGO.

When he got to the door, the peep hole was obstructed but he thought is was just one of the neighbors having some fun.  He cracked the door open, but it was not a neighbor.  It was an armed intruder.  The thug rushed the door and Strodman fought back and had stopped him when the criminal presented his firearm.

The homeowner lost his footing and fell down the stairs, but as he did, he fired two shots at the would be intruder.  The intruder valued life more than whatever the Strodman’s owned and ran from the scene.

Former prosecutor Bill Tackett commented that it was a textbook case of Missouri’s Castle Doctrine and stand your ground in action.

Under castle doctrine, a homeowner, or someone allowed to be in the home like a babysitter, has the legal right to defend themselves using deadly force when faced with a threatening trespasser. Stand your ground says people no longer have to retreat from danger before shooting in any place where they have a legal right to be.

The homeowner stated he only saw one person but a witness reported to police that they saw two people.

Police brought in a K9 unit to try to track down the suspects.  There was no indication whether the intruder was hit by either of the shots.

Rob- Can’t retreat when you’re flat on your back.

 

Gary – Glenpool, Oklahoma

A Tulsa man attempted to rob a Glenpool convenience store but the tables got turned on him.

Ezell Brown entered the store, pointed a gun at the clerk and told him that he would kill him if he didn’t give him the money.  The clerk did just that.

Gary Adams then grabbed the crook’s gun and a baseball bat and chased Brown outside where he held him until police arrived.

As the clerk kept the robber in place, Brown kept telling him that “I have a gun.”  Adams said, “If you pull a gun, I am going to shoot you with the gun that I have of yours.”

The hapless robber was booked on multiple charges including attempted robbery.

Belle- MORE ON MARIJUANA…

 

We recently reported that three states have begun to move against firearms ownership among medical marijuana holders.

 

Since then, there have been additional developments. After public outcry, Honolulu Police Department has begin to review its policy of confiscation and may have reversed it altogether.

 

However as of now, twenty-nine states and the District of Columbia have laws “broadly legalizing” marijuana use in one form or another. Legal gun owners in each of these states remain at risk of having their firearms confiscated as a consequence of their having a marijuana card from their home state, because as of now, marijuana use remains illlegal under federal aww. Ohio for example, just joined the list of States letting people know that MJ and firearms don’t mix.

John – The ATF revised the Form 4473 to make clear that marijuana usage is against Federal law.

Rob- FBI AND AFT COOPERATE ON GUN CONFISCATIONS

 

A little known aspect of the NICS process is that if a report fails to come back with a clean “Yes / No” decision within three days, then the FFL is at liberty to release the firearm(s), at their own discretion.

 

The Law that established the NICS system, specifically prohibited the background check from being used as a “system of registration of firearms, firearms owners, or firearms transactions…”

 

Now, a report in USA Today reveals that FBI and ATF are working together to confiscate 4,000 firearms from people who were sold them after the 72 hour period expired with no NICS result, but who turned out to have been a “no”.

 

This presents a huge dilemma for legal gun owners. Is it better to have 4,000 guns removed from those who would have been denied them? Or, is it worse to have the NICS system being used as the registry it was specifically precluded from being?

In what can only be considered as a huge victory for gun rights and restoration of 2nd Amendment rights for legal gun owners everywhere, the House of representatives passed the National Concealed Carry bill last Wednesday. The action now moves to the Senate.

 

The Bill was merged with the “FixNICS” bill and had an item about “bump stocks” included also. This is designed to make it easier to pass the Senate because while FixNICS is thought to be an easy pass there alone, it would be much harder to pass National Reciprocity there as an independent bill.

 

We should all watch carefully as anti-gun Senators on *both* sides of the house work hard and long to re-separate these two Bills in order to quash Reciprocity. If National Reciprocity fails in the Senate, then millions of Americans will continue to live under the oppression of their States’ anti-gun laws. Contact your Senators to let them know that you want National Reciprocity passed, even if it is merged with this FixNICS Bill.

Gary- GOOD NEWS FOR DELAWARE RESIDENTS

 

The Delaware Supreme Court recently ruled that it was legal for residents of that tiny State to carry their protective firearms in State Parks and Forests.

 

The decision lists almost 150 pages of opinion and dissent regarding the 2nd Amendment, and is interesting reading for sure. However in the end it was decided not on firearms precedent, but as a case of administrative over-reach.

 

The key sentences are: “We are asked whether unelected officials…., whose power is expressly limited, can ban…the possession of guns in state parks and forests in contravention of ….the State’s constitution. Clearly they cannot. They lack such authority because they may not pass unconstitutional laws…. As such, the regulations are unconstitutional on their face

 

This is good news for Delawarians, but it also sets an interesting precedent for those of us concerned about the “Any Federal Agency” broad ned set forth in the upcoming FixNICS legislation

Belle- POLICE CHIEF IN OHIO CALLS FOR NATIONAL CONCEALED CARRY RECIPROCITY

 

We have all been following the National CCW reciprocity legislation move through the house and to the Senate, with considerable excitement. Now, one Police Chief says – “It’s about time!”

 

Police Chief Dennis Murphy, of Gahanna, Ohio, writing his opinion for Fox News, said that gun owners are always worried that they will break a law someplace without realizing it, and the varied and ever-changing picture of state-state reciprocity makes this more likely.

 

He supports National Reciprocity as a way to end the confusion, anxiety and expense that accompanies trying to exercise one’s Constitutional right to self defense while traveling. It will also bring an end to Paul’s “disarmament dance”. This is particularly important because criminals do not pay attention to the law anyway.

 

He concludes by saying.. “I fully support the Concealed Carry Reciprocity Act and encourage all gun owners to do the same.. It’s time for Congress to protect our rights.

 

Like Chief Murphy, we here encourage all our listeners to contact their Senators and let them know you want them to vote *for* this Act.

A Sterling Heights Michigan woman took her dog for a walk outside her apartment complex in the 15 Mile – Van Dyke area on a recent Sunday evening.  As she walked she got a sinking feeling about a black van sitting running.

She noticed a man get out of the van on the other side of the street and start walking down that side of the street in the same direction she was walking.  She is a CPL holder and put her hand on her gun which was concealed under her jacket.

As she reached the end of the street, she lost sight of the man but a minute later, he was coming toward her.

He grabbed the back of her jacket and tried to grab her and pulled her towards her.

She put the gun into the suspect’s stomach and said, “I don’t want to kill you.”

The man appeared shocked and quickly retreated.

Officials were still investigating and have increased patrols of the area.

84 year old Don Lutz sleeps with a loaded pistol under his pillow.  Last Friday morning, he made use of it.

At 1:10 AM Mr Lutz woke to the sound of breaking glass.  Carrying his .380 pistol down the hallway, he was confronted by two men.  He ran into one face-to-face and the man grabbed him.

The Korean War vet who spend 16 months on the front lines, shot his attacker.  He and the second intruder then scuffled with the homeowner on the kitchen floor when the wounded intruder rolled over succumbing to his wound.  He was described as a 35 to 45 year old white male weighing close to 300 pounds.  He was unarmed and wearing rubber gloves.  He had not yet been identified.

The second criminal ran out the front door.  Mr Lutz then called the police.

The gunshot was went through the dead man and the police could not find the bullet.  They are looking for the second suspect and are guessing that he has the .380 slug in him.

Based on Pennsylvania’s Castle Doctrine and Self-defense, he will not be charged.

Carlos Molina took his family out for dinner at a local Popeye’s. At about 8:30, 19-year-old Andres Herrera walked into the restaurant with the intent of leaving with as much money as he could.

The teen thug demanded money from the 32-year-old father, to which Molina replied that he had spent all his money on dinner for the family.  He then asked the robber to let his family go.

Most of the family left but two of the children were in the restroom.  When the kids exited the restroom, Herrara pointed his gun at them. It proved to be a fatal decision.  Molina was licensed to carry and shot him several times.

San Antonio Police Captain Michael Starnes said that he will not face charges and that “he really saved the day and protected a lot of people” by his actions.

Twitter users were applauding the good guy with a gun saving lives.

When Caesar Ray’s daughter’s car alarm went off in the middle of the night while they were working on their home which had flooded.  At bout that same time, a neighbor called to inform them that she had seen a man loitering around their house.

He has law enforcement training and has worked for the Louisiana Department of Corrections.  He met Roberto Garcia in his front yard.  He handcuffed the burglar and held him at gunpoint until police arrived and broadcast the entire event on Facebook Live.

Ray could be heard telling Garcia, “You tried to break into the wrong damn house.  You stay where you are located right there.  Don’t move. Who are you here with?”

Garcia answered no questions and was hauled off to jail where he was booked on charges of auto burglary and attempted burglary of an inhabited building and held on $20,000 bond.

Ray urged other people not to do what he did unless they have law enforcement experience.  “Be vigilant. Continue to be observant, especially when you are coming home.  Before you just pull in your driveway, look around and don’t just jump out of your vehicle.”

I am tired of being treated like a second-class citizen. Anti-gun Democrat politicians claim licensed concealed carry holders are dangerous. These bigoted politicians even say recognizing concealed carry permits will give criminals guns. These politicians said licensed gun owners should be put in prison for years.

I put up a post this morning speculating about the chances that the Senate will pass national concealed carry reciprocity. Given the filibuster, it is 50-50 at best. The only hope is that some of the Red State Democrats will be pressured into supporting it if they want to be reelected. Unfortunately, I am seeing the hardening of the anti-gun position in the Democratic Party. Looking back at the 2011 vote in the House passing reciprocity, 43 Democrats voted for it. Now only 6 voted for it and 13 who had previously supported it voted against it this time. This is not good news.

 

That and more is at only guns and money dot blogspot dot com.

Rob- I want a roll-call vote. Let us find out who is actually for armed citizens.

Rob- HOUSE JUDICIARY COMMITTEE PASSES NATIONAL RECIPROCITY FOR CCW BILL, HR 38

 

After what has seemed like forever since the election of President Trump, the first Bill to promote National Reciprocity of CCW was moved to Committee debate on Wednesday November 28th. The vote was an ironic 19-11 in favor. It will be presented to the House floor for a full vote on Wednesday December 5th in the afternoon. As it currently stands, holders of a permit from “any state” will be able to carry in all states. The current Senate draft of the bill however requires that a permit from one’s home state must be held. As an added benefit, the House Bill also appears to shred magazine capacity laws.

 

Listeners to the show will remember very well the sad case of Shaneen Allen, whose experience after declaring her legal PA concealed firearm to a New Jersey Police officer was horrific; additional  cases involving members of the military and general citizens in places such as New York City are also well known. House Bill 38 is designed to prevent such miscarriages of justice.

 

The debate lasted all day. Amendments were presented to many topics – some related to the Bill and some to the usual talking points (such as “Universal” background checks). Some were minor, while some would have effectively nullified the Bill if it were to become law. Many of the amendments showed an almost complete ignorance of the processes of obtaining a CCW permit in the various States. All of the detrimental amendments were defeated, two (to allow Federal Judges to carry in any state and to allow retired and off-duty Law Enforcement officers to carry in gun-free school zones) did pass. The Bill was recorded as “reported favorably” to the House at 4.54pm

 

The House Rules Committee is expected to issue a rule to send this bill to the floor for a vote on Wednesday, Dec. 6th. The bill to be voted on combines concealed carry reciprocity with the Fix NICS Act passed out of the House Judiciary Committee in the same markup hearings.

 

Listeners are encouraged to contact their House Representatives to encourage them to vote “yes” on this key bill. We need to now look for the parallel bill in the Senate.

John – ARMED CITIZENS STOP THE BAD GUY WITH THEIR GUNS – AGAIN (is this more of a DGU story?)

 

We may not need more data to support the National Reciprocity movement, but we certainly need to get the good stories about CCW holders out to a broader audience.

 

Here is a prime example of the Good Guys doing their work correctly. At 4.30 pm on Saturday November 25th, two legally armed citizens stopped the threat presented by a murderer.

 

The attacker shot two people, killing one and paralyzing another, at which point the two good guys intervened, stopping the attacker with their defensive handguns.

 

If they had not, things could have been much worse. The local Police Chief said: “The attacker had multiple magazines on his person.  He was intent on doing harm. The employees stepped up and prevented customers, employees, and other vendors who were in the business at the time from sustaining further injuries. They did a good job.”

 

In the week when the House may well vote on the National Reciprocity legislation, it’s important to let your State and Federal representatives know that the Good Guys are out there, working for us all, every day.

Belle- MARIJUANA USERS CAN NEITHER BUY, NOR OWN, FIREARMS

 

Some of us will have been aware of a recent clarification from our friends at ATF, regarding the prohibition of medical and recreational marijuana users from owning firearms. The 4473 form has been altered to specifically highlight this drug. This is Federal Law, so it applies across the whole country, including marijuana-liberalized states such as Colorado and Washington, and traditionally gun-friendly states such as Arizona

 

Recently, three states have begun the process of collecting firearms from citizens who have medical marijuana cards. Hawaii,  Florida and Pennsylvania are all issuing notices to gun owning marijuana users that they have to “turn them in”. Of course, to do this, there must be registries of gun ownership and medical MJ use, that can be cross-referenced.

 

We wonder whether this slow creep of state-legalized marijuana use is another part of the progressive long-game to prevent the upcoming generation from being able to own, and perhaps even handle, firearms.

 

We urge listeners to be on the look out for ballot initiatives or the like for the legalization of marijuana in your state and think carefully before voting for them, if you value your gun-rights, and those of the next generation.

 

Rob- All elections have consequences.

John – The only alternative is to remove the prohibition on marijuana from federal law. It actually may be counterproductive to resolving the opioid crisis.

Belle- it’s not a question of not recognizing it as much as it’s being embarrassed or ashamed by what is often perceived as allowing the behavior to occur. As far as “charging in” as Rachel said, this is a thing! I was that girl. I was a victim of the false confidence that made me basically say “try it buddy’ and then got hammered. As far as what Rachel said about asking-sometimes you have to GENTLY ask repeatedly, and ease them into being comfortable with opening up to you and enduring that embarrassment

 

If you want to help, you have to be willing to accept the burden of that-things you think are silly. You have to be willing to let them work through their plan the way that will allow them to follow through.

John- Jacksonville Florida

In June, Michael Turner couldn’t leave well enough alone.  He broke out the window of an apartment in Jacksonville Florida.  The apartment was that of his ex-girlfriend.

Turner had been arrested previously on a felony domestic strangulation charge in 2016.  He strangled then punched his former girlfriend until she lost consciousness.  The charges were later dropped.

Police stated that they received a call about multiple shots fired just before 6 AM.  When they arrived at the apartment, they found the abusive ex-boyfriend dead after receiving multiple gunshot wounds.

Leaders with Hubbard House, an anti-domestic abuse organization, said unfortunately, there are a lot of misconceptions about women in abusive relationships.

Hubbard House CEO Ellen Siler said.”People assume that if the woman will just leave, everything’s going to be OK, and that isn’t always the case,” “There’s ongoing stalking and ongoing threats, so if you’re going to leave, it’s important for you to have a plan to safely leave, which Hubbard House can help you with.”

As of June, this was the 12th domestic related homicide in the Jacksonville in 2017 to that point.

Tracy- Panola County Mississippi

It has been said that a protection or restraining order is only as strong as the paper that it has been printed on.  It did slow Phyllis Hamm’s estranged husband away.

Just 5 days after the order expired, James Clinton Hamm showed up at the residence they had shared outside Batesville, Mississippi and attempted to enter.  She had locked the door and tried to wedge a jack to keep the door shut.  Mr. Hamm was able to unlock the door then kicked it, which slid the jack out of the way.

As he entered the home, she fired her .22 caliber revolver and fatally injured her estranged late husband.  She had expressed her fear and had issues as part of their divorce in the past including finding a butcher knife stuck in the back porch.

Mrs. Hamm was taken into custody and put on a hold in the county jail pending a decision to indict or not by the Panola County Grand Jury, but she was later released.

Alejandria Guinn exercised her right to own a firearm and used it to defend herself.  When she was visited by her ex-boyfriend late one night, she had reason to fear for her life.

Frank Harrison has previously threatened to hurt her and when she saw him standing outside her home, armed with an AR style rifle, she had reason to fear for her life.

She scrambled to get her gun then made her way to the front door.  She opened the door and came out shooting.  She managed to end the threat permanently without getting herself shot.

While the police initially determined she had probably acted in self-defense so she wasn’t arrested or charged, they also have not found any records of past injunctions filed by Guinn against Harrison.

When Lake County Ohio Police responded to a call from a distraught woman they found more than just that woman.  They also found the woman’s ex-boyfriend on the floor with a gunshot wound to the leg and a pool of blood surrounding him.

The aggressive ex-boyfriend broke into her home and the woman responded with an equal show of force to end her perceived threat.  The man was transported to the hospital where he later succumbed to the loss of blood from his wound.

The handgun was secured at the scene and both the woman and another witness were brought in for questioning.  The unnamed woman has not been charged.

Rob- Have a gun, and preferably more than one.

Belle- Eastern Kentucky

Krystal Shepard has placed a warrant for assault against Brandon Endicott in September after he hit and kneed her causing her to receive 16 stitches and broken bones in her face.

When the man entered her home one morning shortly afterwards, Ms. Shepard defended herself.  Endicott was found deceased in a neighboring yard and a stray bullet went into a neighboring mobile home.

She had not been charged and the case was being sent to the grand jury.

Rob- there is no cover in a mobile home park.

US CITIZENS WILL BE ABLE TO BUY MILITARY SURPLUS 1911 PISTOLS

 

In what will be considered good news by many many US gun owners, one of the provisions of the 2018 National Defense Authorization Act, about to be signed into law by the President, will allow the release of thousands of surplus 1911s to the civilian market, an estimated one hundred thousand, to be more exact.

 

The guns will be fed out through the Civilian Marksmanship Program. Their website says that they have not yet decided how sales will be handled, or processed, but that they are expecting “exceedingly high demand” for these iconic handguns.

John – Just to clarify for anyone interested, you must belong to a CMP affiliated club and you must show proof of marksmanship. The latter could be your military discharge papers, a C&R FFL, your CCW, or your instructor credentials.

 

SUPREME COURT DECLINES TO HEAR MULTIPLE 2A CASES

 

The Supreme Court has given us two significant victories in past years. The “Heller” and “McDonald” cases enshrined in law the concept that every American has the right to have a firearm, to “keep” and “bear”. This has made significant impacts in States such as New Jersey, where there was no commitment to the 2nd Amendment in the State Constitution.  However, more recently, SCOTUS has declined to expand these decisions into the realm of defensive carry outside the home, or to prevent erosion of access to commonly used firearms, such as the AR-15 style rifle. This sad process was reinforced again today (Nov 27), when two cases were denied a hearing.

 

So in total, SCOTUS has recently declined to hear five important 2A cases: Peruta v California, Kolbe v Hogan, Norman v Florida, Stephens v NJ and Purpura v NJ. Why is this? Are there too few votes to be certain of victory, Justice Gorsuch notwithstanding, or are the cases being weeded out by members of the Clerking Pool, without the Justices ever getting to actually consider them?

 

With the ever-gathering clouds of anti-gun legislation appearing on State and Federal horizons, we need a supportive SCOTUS working for us. Please be vigilant, and write to your State and Federal representatives to tell them to vote against anti-2A legislation, and to support pro-2A bills.

John – I have been busy today and was unaware that Kolbe v Hogan had cert denied today. That just sucks. It leaves in place the horrendous decision by the 4th Circuit. I would love to know who voted to hear the case and who voted it down.

Rob- we are running out of test cases. There is so much settled law in each circuit that it becomes harder to bring up a challenge case.

TEXAS CHURCH ATROCITY PROMPTS REVIEW OF NICS SYSTEM

 

A failure of the military authorities to notify the civilian NICS system contributed to the mass murder of worshipers in a small Texan church by an individual whose military background should have prevented him from owning a firearm, thereby allowing the murderer to acquire multiple firearms, apparently legally. Now, Attorney General Sessions has asked for a review of the NICS system, to ensure that relevant military information is integrated correctly.

 

A bipartisan bill is proposed in the US Senate that would mandate such integration, which has been in the works since 2007

It’s a Texas week for Defensive Gun Uses.

 

You Don’t Treat my Daughter that Way

A day-long argument in Denton Texas ended with the victim’s stepfather pulling his pistol in a no shoot defensive gun usage and the aggressive male roommate in jail.

The fight started in the early morning at the apartment where the 23-year-old victim lived.  The suspect, 31-year-old Chad Knapp, had taken some of the woman’s Adderall pills.  Adderall is used to treat ADHD and narcolepsy.

He was kicking and throwing things before he left the apartment through a back window with the pills.  The victim confronted him in front of the apartment as he got into his vehicle.  She attempted to grab the pills from the car.  The suspect pushed her hard and threw her backwards into a brick wall.  The force of hitting the wall caused her to fall to the ground at which point he started to drive away.

A nearby witness attempted to stop him by jumping on the hood of the car and was thrown off, suffering a small cut on her hand.

The victim was taken to the hospital where police noticed bruising on her arms from being grabbed.  Her head also hurt and her back had abrasions from the brick wall.

She returned to her apartment at about 8 PM with her stepfather who had a license to carry a concealed weapon.  As they were trying to get the door open, the suspect approached them with a hammer.  Her stepfather then presented his pistol.

Knapp was held in Denton City Jail on charges of Assault causing bodily injury and deadly conduct.

 

Woman shoots teen intruder in head and Marine defends himself

A Houston Texas woman was home alone when she heard someone breaking into her home at 2 AM.  When she investigated the sound, one of the teenagers hiding behind her couch jumped up.  At that point, she shot the suspect in the head.

She is not facing any charges but as per usual, the case will be sent to a grand jury.

About 3 miles away on Friday night, a group of four teens tried robbing a man at gunpoint.  That man, a retired Marine, pulled his pistol from the front pouch of his hoodie and fired back and hit one of the teens.  The injured teen’s mother took him to a hospital and he was expected to survive.  The teens were caught on a neighbor’s surveillance camera before the ambush and as they ran away.

It was not known if the two incidents are related but the area has seen an escalation of roving gang activity.

Chase suspect picks wrong pickup truck

On Sunday morning, Vidor Texas Police were notified by the Louisiana State Patrol that they were chasing a black Acura at speeds over 100 miles per hour on Interstate 10.  As the Acura approached the 855B off ramp, law enforcement laid down the stop sticks which disabled the car.

Ahead in a pickup truck heading the same direction, Tony Alford spotted the smoking car coming towards them and pulled over to get out of the way.  Diego Gomez, the MS-13 gang member, driving the Acura pulled in behind them and jumped up in the bed of the truck.  Alford jumped out of the truck and held the criminal at gunpoint until law enforcement pulled up.

While Alford held his gun on Gomez, Vidor Police and Texas DPS troopers deployed tasers.  The gangbanger ripped the prongs out and attempted to fight officers.  He was cuffed during the struggle.

While they had him sitting on the ground waiting to EMS to arrive, he gained his feet and ran from the scene but was captured a second time.

Alford’s wife said that he was prepared for the worst-case scenario.  “He was that far from getting a bullet,” she said.

Gomez is facing charges of evading arrest in a motor vehicle and aggravated kidnapping.  Louisiana was seeking charges for fleeing and traffic violations.  In North Carolina, he is facing charges including assault on a peace officer.

Really enjoying your format modifications with all the new voices and personalities, nice work.

What I have for you is not some great new revelation or heady political analysis ….but  it’s better than recipes…I am kidding Susan!

I wrote this a while ago this past summer when Venezuela was front-and-center, but I never hit “Send.” I guess I thought it was rather obvious and mundane. But now with the heinous evil acts carried out in Las Vegas and Texas, there seems to be renewed calls to vacate or significantly modify the political foundational documents of America.

Considering what is happening in Venezuela, I thought this short story from our own American history might be timely. The below information is from the book “The Debate on the Constitution, Federalist and Antifederalist Speeches, Articles, and Letters During the Struggle over Ratification – Part I.” edited by Bernard Bailyn, 1993.

Shortly after adjournment of the Philadelphia Convention in September 1778, the colonial citizenry began the very public debate on the new American Constitution. In lieu of our current day social media, and with a lot more eloquence than our cryptic Tweeter quips, the citizens debated the virtues and follies of the new American Constitution in the newspapers, printed pamphlets and public letters. The press and local public speaking events were used to extol, ridicule, or just question the virtues, of the newly inked Constitution.

One such presentation was made on October 17, 1787 in the Philadelphia press by “A Citizen of America,” which was an alias (a Twitter Handle) for Noah Webster. He wrote…

“Another source of power in government is a military force. But this, to be efficient, must be superior to any force that exists among the people, or which they can command; for otherwise this force would be annihilated, on the first exercise of acts of oppression. Before a standing army can rule, the people must be disarmed; as they are in almost every kingdom in Europe. The supreme power in America cannot enforce unjust laws by the sword; because the whole body of the people are armed, and constitute a force superior to the band of regular troops that can be, on any pretense, raised in the United States. A military force, at the command of the Congress, can execute no laws, but such as the people perceive to be just and constitutional for they will possess the power, and jealousy will instantly inspire the inclination, to resist the execution of a law which appears to them unjust and oppressive (Bailyn 1993 p.155).”

Webster’s 1787 passage provides a view into how guarded the population was of tyranny. The Bill of Rights, in particular the 2nd Amendment, would not be ratified for another 13 years (December 15, 1791). So even in the absence of the ratified 2nd Amendment, Americans were staunch in their conviction to keep and bear.

I wonder if Venezuelans would think the American Declaration of Independence, the Constitution, and the Bill of Rights, quaint outdated historical documents. Or would they warn us to exercise prudence when considering changes to our longstanding government.

I enjoyed the discussion regarding churches.  As a Catholic, I‘m always interested to know what the Catholic position is.

 

The Roman Catholic Church is the largest Christian denomination in the USA, and so its actions are closely watched by many as an example of how churches should deal with the issues of criminality and violence in our society.

 

Many Catholic Bishops have declared churches in their respective dioceses to be „gun free“ zones.  Furthermore, many bishops have advocated openly  against armed self defense. Unfortunately, these teachings by the bishops in many cases, may directly contradict the formal  teachings of the Church.

 

Saint John Paul, known in life as Pope John Paul II, explained the need for, and obligation of, self defense.  In his own words, from the Papal Encyclical Evangelium Vitae (p. 55):

 

“Legitimate defence can be not only a right but a grave duty for someone responsible for another’s life, the common good of the family or of the State. “. [Quoting Catechism of Catholic Church #2265]. Unfortunately it happens that the need to render the aggressor incapable of causing harm sometimes involves taking his life. In this case, the fatal outcome is attributable to the aggressor whose action brought it about, even though he may not be morally responsible because of the lack of the use of reason.“

 

You‘ll never hear the priests or bishops cite this contradiction of their heretical teachings.

The Sheepdog’s Prayer

The Knights of Old were Men of Honor who used their Might For Right!

Today they’re known as Sheepdogs, those who carry on the fight.

I am a tired old Sheepdog, the guardian of my flock.

I keep the predators at bay and stand watch around the clock.

Please stop the Sheep from pulling my teeth. I’ll need them for the fight,

When the hungry Wolves come calling, some dark and deadly night.

I pray I’ll never need my gun, but someday if I do:

May my cause be just!

My draw be quick!

And my aim be ever true!

Heaven holds a special place for those who do the deed.

Defenders of the innocent in their hour of need.

May the Sheep someday be grateful. There’s a debt they can not pay,

To the Sheepdogs who lay it on the line, each and every day.

I’m proud to be a Sheepdog. I’ve done my very best!

I’ll stand my watch until my Maker calls me home to rest.

But when I meet St. Peter, there’s just one request I’ll make:

“Please let me spend Eternity, standing guard at Heaven’s Gate”.

This Black Friday saw the all-time one-day record for NICS checks set with over 203,000 checks. While there isn’t a one-to-one correlation with firearms purchases, it is a sign that maybe the stagnation in the firearms’ market is coming to a close. For the sake of those people working in the firearms industry at the retail, distributor, or manufacturer levels I certainly hope so.

Rob- I joined Bill Frady on his Lock and Load Radio program. I’m now a regular guest on the first hour of Tuesday evening. Ben Branam joined me for another episode of Self-Defense Gun Stories.

 

John – I’ve been transcribing my notes from MAG-20. I need to get out to the range but I’ve been slack on that lately. I’ve been working on my annual Black Friday/Cyber Monday post. Given the state of the gun market, I think there will be some real bargains out there.

 

Tracy – I gave a couple of handgun lessons last week, and yesterday I replaced the mag catches in two of my 1911s with right-sided mag catches, on the recommendation of Karl Rehn, because of my freakishly short thumbs. Stay tuned for updates on how my magazine changes are coming along. Yesterday was the first time I have ever attempted any type of gunsmithing on my firearms, and the first time I have ever used LocTite, so I am rather pleased with myself.

It must be nice to write for the mainstream media. It is so much easier to tell a good story when you don’t let the facts get in the way.  The boston globe reported that there is an epidemic of firearms violence in the US. They said there is a growing movement for mass confiscation.  The staff at the polite society podcast wants to know when we get to report without facts.

 

There is not an epidemic of violence across the US. There isn’t even an epidemic of mass murder with firearms.  Our failed socialist cities are violent. Even in those cities, violence is localized to drug turf wars. A number of law enforcement agencies report that we don’t have a firearms violence epidemic.  We don’t even have a drug epidemic. They say we have a drug prohibition epidemic.

 

Compared to other countries, the US firearms homicide rate is average. What isn’t average is localized violence. More than half of our murders occur in 2 percent of our counties. When we exclude a few socialists cities here in the US, then we’re one of the safest countries on earth.

 

When you look at mass public murder by firearm, the US rate isn’t even in the top 10 nations. The US and Austria are 11 and 12. The reason this is so significant is that these mass murder rates exclude government genocide. Government is far more lethal than an armed populous. Here in the US, we have the best of both worlds. We have a low rate of murder and mass murder, diversity of opinion, contentious political freedom, freedom from democide, and an armed populous.

 

Also, there is growing support for going armed, and declining support for an assault weapons ban. That isn’t our opinion, but the results of a pew research poll. You didn’t hear that from the Boston Globe or the New York Times.

Now if only we could clean up Chicago and Saint Louis.

Gary- Careful What You Post

Nick Davis had a successful night at the casino.  And like so many, he posted on social media about his winnings.

Cashmiere Hill saw Mr. Davis post and thought it would be a way to gain some extra cash in his own pocket.

Davis was laying down when he heard glass breaking in his kitchen.  He went to investigate and found a black male trying to get into his house.  The man yelled at him to “give me your [expletive] money,” and then fired a shot at Davis.  That shot struck him in the wrist.  Nick fired back in self-defense, he thinks 8 rounds, and struck the intruder who fell back into the stairwell.  Mr. Davis then called 911 and yelled to neighbors for help.  Hill died at the scene.

Tory Summers has told police that he called Davis to make sure he was home then drove Hill to a spot about 2 blocks from the residence.  Hill had told him that he was going to rob Davis and he wanted Summers to pick him up.  When he heard shots coming from the direction of the residence, he left.

He is charged armed robbery, armed burglary, and felony murder.

Tracy- Heros run toward trouble

5:30 AM can be a good time to go for a run in Austin Texas but the sun doesn’t begin to rise for another hour and a half in September.

A young woman was out for a run last month then she was grabbed from behind by a sexual predator and then fell to the ground with her on her back and the suspect on top of her.  He put his hand over her mouth and kept saying “shh, it’s me baby, it’s me.”  She continued to struggle and tried to use a whistle she carried.

Another jogger who leaves the house prepared heard the victim scream and ran toward her to help.  He was armed with a firearm, flashlight and cell phone.  He pointed his flashlight in the direction of the screams and saw the victim on her back and her attacker on his left side on top of her.

He aimed his gun at the predator and demanded he get off the victim.  The man stood up and was naked from the waist down.  The woman took advantage of her attacker getting up to get up as well and walk toward the jogger.  She did not realize he was armed because she was blinded by his flashlight.  As she walked across the line of fire, the attacker fled with the woman’s shoes and shorts.

She and the hero jogger were able to pick the man from a photo lineup and he has been arrested.

 

Rob- The attacker was a homeless person with a history of exposing himself. Why did the victim choose to go unarmed?

 

Rob City on Lockdown

Last week, the town of Ortonville, Michigan, north of Pontiac, was put on lockdown after Michael Quigley went on the run.

Quigley was distraught that his wife had filed for divorce and had tracked them down at her male friend’s apartment in the small town on Tuesday evening.  He forced his way in and shot both of them.  They were rushed to the hospital with gunshot wounds to the head.  The male friend’s daughter was home at the time but unhurt.

Wednesday morning the local schools were closed or were on lockdown.  The manhunt was on.

Late Wednesday evening he was found hiding in a van in a Brandon Township driveway.  The homeowner opened the back door of the vehicle and found the wanted man hiding under a blanket.  The homeowner had his 9MM pointed at Quigley and the man did everything that he was told to do.  He ordered him down to the ground then called 911 and within two minutes, the SWAT team came out of the woods from every direction.

Quigley’s estranged wife and her friend were in intensive care but in stable condition and were able to talk to police.  Quigley was being held on $8 million bond and was facing numerous charges including attempted murder.

We are god’s hands, so it is up to us to stop violence when it comes to church. We are already doing so, and have been for years. You probably won’t notice it, but the change is very real and already underway.

I have been looking at the murders in Rancho Tehama Reserve, California and in Sutherland Springs, Texas. Both sets of murders were done by people who were prohibited persons and both might have been prevented if government had done its job correctly. In the California case, the police had reports from neighbors of the guy shooting in his yard even though he had an order prohibiting him from possessing a firearm. They did nothing about it. In the Sutherland Springs case, we know the Air Force failed to submit the killer’s name to the FBI for inclusion in the NICS database. However, it is actually worse than that. The court martial only gave the guy one year imprisonment and not the eight allowed under the UCMJ. In a NC court, he would have been looking at over 10 years. Either way the killer would still be behind bars. Frankly, I think the USAF just want to get rid of the guy and thus foisted him upon the civilian population. As Dave Hardy titled his new book, “I’m from the government and I’m here to kill you.”

I heard from Jeff and Robyn Street. They live in Naples Florida and went through the eye of hurricane Irma. They prepared well and did well. They have water and power, so they have air conditioning, but they don’t have phone or internet yet.

 

John- As regular listeners to the show know, my wife and I love to visit thrift stores and church bazaars. This weekend I picked up a tennis racquet carry bag with a shoulder strap which I intend to convert to a covert bag for either a folded stock rifle or my AR15 pistol. So for $1 plus some cheap foam I will have a carry bag that lets me go about my business without frightening the hoplophobes,

2- News 1

Due Process Failure

When the Police State is running things you must be careful.  We are not talking about being questioned at a train station in East Germany during the Cold War.  We are talking about the treatment of American citizens by federal authorities.  The case of Gerardo Serrano is a textbook example.

Mr. Serrano lives on a farm in Kentucky.  He unsuccessfully ran for the US House in 2014 as a pro-Second Amendment candidate.  He is licensed to carry and typically conceals his Sig Sauer .380 caliber pistol.

Mr. Serrano decided to drive to Mexico for a visit with his cousin in September 2015.  Along the way, he took pictures with his phone to document his journey.  Everything was going swimmingly until he reached the border crossing in Eagle Pass, Texas.  He held his phone out the window and captured an image of the Customs Agents in the vicinity.  The photo depicts the two agents holding their hands up in an apparent attempt to prevent him from taking their picture.  The agents then directed Mr. Serrano to the side of the road and asked him to surrender his phone.  He refused to comply.

 

The agents then opened the door to the new Ford F-250, unbuckled his seat belt and removed him from the truck.  His phone was seized and the agents demanded his phone’s passcode.  Again, Serrano refused to comply.  His truck was searched and a loaded six round .380 magazine was found in the center console.  He was detained for three hours and was told he was free to go.  However, his truck was not free to go.  Serrano then rented a car and drove back to his Kentucky home.

 

The authorities seized Mr. Serrano’s truck under federal asset forfeiture.  The truck was considered a “conveyance of illegal exportation.”  Of course, these types of findings are normally made once someone crosses into Mexico.  It seems that the border agents don’t like to have their picture taken.

Mr. Serrano requested a trial to resolve this matter on September 7.  His other options were to pay a ransom to the agency in the amount of $4,000 (10% of the value) or just let them have it.  It will be interesting to see how this works out for Mr. Serrano.

 

John – As bad as this is, Mr Serrano just lost a truck. The SAF has filed an amicus brief in a case out of Florida where the District Ct said you can have either your 2nd rights or your 4th amendment rights but not both. A man answered the door at 1:30am with a handgun in his hand. He was shot and killed by the cops who knocked and then shot when he answered the door. They were seeking info on a motorcycle parked near his house.

 

Rob- John, I disagree, but I hope he hasn’t lost a truck, but I agree this is abusive prosecution, and the so called civil rights activists are silent..because the victim was a gun owner.  Why is the Trump administration continuing the prosecution of this legal case?

 

Cleanup in Aisle 14

The Utah Supreme Court sided with a group of Wal-Mart workers who were fired for defending themselves when they were assaulted by an armed shoplifter.  Six workers were fired after they fought with a shoplifter who pulled a gun on them inside the Layton Wal-Mart.  The company had claimed the employees violated Wal-Mart’s policy of disengaging, withdrawing and alerting authorities. During a hearing, Utah Supreme Court Justice Christine Durham bluntly asked if an employer should be able to fire somebody “for refusing to take a bullet for the company?”

 

The court said, “Utah law reflects a policy favoring the right of self-defense.  That public policy is an exception to the at-will employment, but only under the narrow circumstances where an employee cannot withdraw.”

 

In practical terms, this means the employees can sue Walmart for unfair termination.

A Marysville Washington homeowner credits his training for a no shots fired DGU.

Sunday night just after midnight, Joe Hemrich was awake and sitting in his living room when he heard a noise outside.  He turned on his surveillance cameras but did not see anything.  Not knowing what it was, he went to investigate.  He found a man in his driveway under his carport.  The area appeared to be ransacked and the man looked to be holding a baton or a stick.

Four feet away from the man was his child’s bedroom.  Up until recently, the 70 degree temps meant that the bedroom windows were open at night.

Hemrich drew his weapon and ordered the man back.  The man dropped this baton and backed up and even got down on the ground when ordered to do so.

The father of three held his stance in the doorway, holding the pistol he has owned and trained with for 12 years on the criminal with four warrants out for his arrest and happened to be on the lam.

“This is the first time in my life it has ever come out of the holster when I wasn’t at a range,” he said.  “I train so I know exactly where it is, exactly how to pull it out, whether my finger is going on the trigger.”

He stated that the extensive training allowed him to focus on the subject in front of him and not on his gun.

“I carry a firearm to protect myself, my family, my community with the intentions of never having to use it,” he said.

The surveillance video was still rolling when it captured Hemrich walk the suspect at gunpoint to the front yard, ordering him to the ground and holding him until police arrived about five minutes after the altercation began.

Marysville police said he did everything right and most importantly, he complied with the officer’s commands when they arrived on the scene.

Leave your Ex alone

Nothing good happens after midnight.  And nothing good happens when you go to your ex-girlfriend’s home after midnight.

Christopher Carter showed up at his ex-girlfriend’s new boyfriend’s home just before 4 AM this last weekend.  An argument erupted and shots were fired.  Police said that Carter shot both his ex-girlfriend and her boyfriend.  She was shot in the leg and he was shot in the arm.

The boyfriend went in the house, grabbed a pistol and shot Carter.  Carter was pronounced dead at the scene.

The couple were treated and released at the local hospital.

The Athens Alabama police chief stated that they had reviewed the evidence and statements were taken.  The investigation will continue for several weeks but they believe they have a case of self-defense.  The case will be handed to the County district attorney and will probably go to grand jury.

John –

They always say he shouldn’t have been shot

In Laplace Louisiana last week Kalvin Ferrygood tried to break into a home.  When the homeowner heard two voices in the back of his house, he went to the door to see what was happening.  That was when Ferrygood forced his way into the home.  The homeowner defended himself and opened fire.

Saint James Parrish Sheriff’s deputies found a gun in the backyard which they believe belonged to one of the two intruders.  They also stated there is video evidence of what happened.

Ferrygood had just been released from jail four months ago after being arrested for shooting five people on Christmas Eve 2008 at a night club in the Parish.

Ferrygood’s family was defending him.  They stated that the mojo had him running and that he wouldn’t break in or hurt anyone.  As stated, the video shows differently.  Mojo is a synthetic marijuana which has been known to cause erratic behavior and even cause death.

According to the Parish Sheriff’s office, the homeowner acted in self-defense and he was not arrested.  They are working to identify the second subject.

Don’t Judge a Book by Its Cover

79 year-old James Noah and 77 year-old Barbara Melton were inside their apartment on a Saturday afternoon when there was a knock on the door.  Melton answered the knock and two men shoved her aside and forced their way inside.

The two men started assaulting Noah with a blunt object.  But, Noah was practicing POGO and was able to draw his handgun from his waistband and fired one shot.  He hit his 26 year-old assailant in the head.

The second would-be robber fled the scene after his partner was shot.  The first robber was alive with life-threatening injuries.

According to a neighbor, Noah was a vet and had training which kicked in during the encounter.  Noah was recovering but had some bruising on his face.  No criminal charges will be sought against him.

Hello gang!

 First off thank you for the wonderfully informative podcast! since I started listening roughly a year ago I have yet to miss an episode.

 I just listened to your segment with Paul Martin on being prepared. As Paul spoke about having friends in the Salt Lake Valley who are prepared but do not consider themselves “preppers” it dawned on me that We who live in Utah are just that. I did not realize that it has become a way of life here. Now I, not being of the Mormon faith, but lived here almost all of my 40 years,pick up on these ideals because it is a way of life here. But the Idea of food storage here is not just for doom and gloom. As the Mormon church teaches, it is to be self sufficient, in case of loss of job, accident, etc. that may keep you from having funds to feed the family.

 

Our food storage consists of canned at home, re-fried beans, whole beans, rice, powdered milk, and wheat. very little is store bought “canned” items. We also have bottled (a lost art in some areas of the nation) mirepoix (onions, celery, carrots in chicken stock) for soups and the like, for each member of our family we have no less than a weeks worth of food on hand.

 

 Due to the fact that we live in Southern Utah, which is high desert, we get a variance of weather. In the summer temps reach 110+ and in the winter can reach freezing during the night. we generally have on hand 2 gallons of water per individual per day for just as many weeks as food. Sounds like overkill to some but to us it is might be enough.This is just if we decide to barricade and ride out the problem. If we must bug out we have backpacks for each individual containing enough food water and first aid for three days. we also carry a field medical bag with surgical kit. To top it off, each family member has a primary and secondary firearm system with ammo to spare. As far as training is concerned, local meetings happen quite regularly for first aid, canning and bottling and general food storage.

 

   In just our neighborhood alone there are a plethora of different skill sets among the neighbors and we all know each other well. With local parties and gatherings that are usually put on by the Mormon Church you get to know the people around you very well creating almost a band of families you can trust. As I write this we do sound a tad crazy but better to have it and not need, it than need it and not have it.

 

Rob- What a wonderful neighborhood.

Amy – Not crazy, very prepared! For example, when a natural disaster happens, grocery stores are emptied, and supplies are hard to find.

John – I worry about my daughters and their families. We preach that they need to have extra food. I may finally be getting through to one of my sil who is diabetic.

 

Paul: Rob, do you have any new posts from your SlowFacts blog you want to mention?

 

Rob- We recently found out that the election last november in New Hampshire was probably a fraud.  New Hampshire has same day registration, and more than five thousand voters entered New Hampshire to cast their vote on election day, and then never became state residents.  New Hampshire voted for Hillary by a margin of only 2700 votes.  They elected a democrat senator with a margin of 1100 votes.  Yep, that is the definition of fraud.  Dr John Lott proposed a solution.

 

We already have a national instant background check system in place.  Scores of judges already ruled that this particular background check does not infringe on any of our constitutional rights.  This is the background check system we use when an honest citizen buys a firearm.

 

The background check wasn’t an infringement when I had to use it..or so I was told.  Democrats also told us that the instant background check system is necessary to keep felons and illegals from buying guns, and to keep honest gun owners from buying more than one gun a month.  We can use these background check systems today to keep illegals from voting and to keep US citizens from voting more than once.

Earlier this week, the Wisconsin Senate Judiciary and Public Safety Committee approved a bill that would bring constitutional carry to the Badger State. Given that they didn’t get any form of concealed carry until 2011, this is amazing. The chairman of the committee predicts it will pass both houses of the legislature. It is unclear whether Gov. Scott Walker will sign the bill as he has indicated he is happy with the current system. If you live in Wisconsin, you might want to give your governor a call on this. Now if the North Carolina Senate would get their act together on constitutional carry….

Tracy- I just got back from a Ladyseed class this past weekend down by San Antonio, at Tim Crosnoe’s home range. Tim was one of our instructors.  A big word of thanks to Tim and Kristin Crosnoe for putting me up for three nights. I very much enjoyed their company and hospitality. It was a great class. Dr. John Edeen was there and helped out. I’ll tell you, the class is A LOT harder than I expected. In all of the years that I’ve been shooting, never have I fallen asleep on the range, much less during live fire. I’m pleased to report that I finished the class on a high note, with all of my 400-yard shots and the 250-yard head shot on the Redcoat target. While I didn’t make Rifleman this time, I’m looking forward to my next Appleseed class. I can’t let Rachel beat me at anything, and I’ve got my work cut out for me to get to her level of rifle shooting.

Aldermen want a ban on weapons at Chicago rallies after Charlottesville violence

Last week, a Chicago Alderman introduced an ordinance in response to the violence in Charlottesville, Va.

The ordinance says that because right-wing “paramilitary militias” carried guns and other weapons at the “Unite the Right” rally that devolved into violence, Chicago police should have explicit power to outlaw weapons at Chicago events.

 

Given that Chicago police can ban loudspeakers and other disruptions, Alderman Edward Burke said in a news release “it seems only fitting that Chicago should also be able to restrict the carrying of weapons during public demonstrations in order to curtail the possibility of violence.”

 

Chicago police already have broad powers about what may or may not be brought to marches and other public gatherings in the city. But the new proposal specifically bans “firearms, knives, weapons, sharp objects, shields, fireworks, chains, bats, clubs, sticks, batons and any other rod-like instrument.”

 

It also allows the Police Department “to determine other items that may not be allowed at an assembly.”

Violators would face fines of $500 to $1,000, and up to 10 days behind bars. The proposal will head to a joint Finance and Public Safety Committee hearing.

 

Rob- This sounds like legislating “pre-crime” to me.  So far we’ve seen communist mayors disarm peaceful protesters while they stood back and let left wing goons beat people up.

 

Any rationalization will do to make chicago citizens vulnerable.  How about we arrest chicago drug gangs and put them in prison.

 

Tracy – Let’s just go ahead and ban car keys while we’re at it (because car keys can be sharp objects) and have everyone take public transportation to the rallies. This is just sad.

 

ELMHURST POLICE: THERE WILL BE NO GUNS AT CONCEALED CARRY CLASS
Safety concerns raised over a planned firearms class qualifying people to carry concealed weapons in Illinois are baseless, according to Elmhurst police chief Michael Ruth. “It’s strictly a classroom environment. There’s no weapons, there’s no firearms, there’s no ammunition. There’s none of those things.”

Social media activity had raised the specter of armed students coming to the classes being offered in the Knights of Columbus Hall.

Brad Carey, who manages hall rentals, was as emphatic as Ruth about the rental by Illinois Concealed Carry, LLC, the organization putting on the classes. “In the contract I had them sign, there’s no ammunition allowed in the hall, there’s no shooting going on.” Carey said. Carey also stated that during the rental the Knights bar will be closed and locked up.

The issue was brought to the attention of the Elmhurst City Council meeting Tuesday when a  resident told council members about their concerns. The resident cited what they claimed were written statements by previous class attendees that they were “required to bring a firearm” and were “required to shoot on the last day of class.”

Ruth and Carey said after a full class day on Saturday, the Sunday classroom work would end at 1 p.m. Participants are expected then to leave Elmhurst for hands-on gun work at an approved firing range outside the city.

Those intending to fire weapons outside Elmhurst after the class must possess a valid Illinois Firearms Owners Identification card issued by the Illinois State Police. Weapons to be transported must be broken down and not easily accessible from within the vehicle.

Paul- Gary, isn’t there a firing portion to the qualification to get an Illinois CCW?

 

Rob- You can smell the stupid from here.  This is really poor journalism.  Someone said shooting is required, so I don’t want a class in my neighborhood.  It just SOUNDS dangerous.

 

In fact, the only point of the mandated training is to dissuade licensed gun owners.

 

Virgin Islands prepares to grab guns ahead of hurricane Irma

On September 4th ahead of the landfall of Hurricane Irma Kenneth Mapp, the Governor of the US Virgin Islands issued a directive that raised quite a few eyebrows. Quoting directly from the 2rd paragraph of the directive.

 

“The Adjutant General is authorized and directed to seize arms, ammunition, explosives, incendiary material and any other property that may be required by the military forces for the performance of this emergency mission”

 

Immediately after some in the media informed the Governor that the Virgin Islands were a territory of the US and were subject to the constitution, including the 2nd amendment, the Gov tried to backpedal and say that he was only authorizing release of weapons from an armory.

3- Interview 2

We’ve heard the claim that “Democrats want your guns”.  I’ve heard it from  republican candidates when they are running for office.  I wanted to know if that was true.

 

That isn’t too hard to do.  We know how many people have concealed carry permits in each state.  We know what the permits costs and if the state doesn’t give permits to ordinary citizens.  We also know the party affiliations of state governments.  All we have to do is put it all together.

 

We see some consistent trends.  Fewer of us get permits when the cost go up.  The more training the state mandates the fewer of us get our permits.  Some states make you take out a newspaper advertisement or call your employer before you can get a permit.  Only judges and politicians get permits in “may issue” states.

 

You’re about three times more likely to get your permit if you live in a republican dominated state than in a democrat dominated state.  If you really want to see political bias then look at the permitting schemes.  The constitutional carry states are republican or neutral.  The may issue states are all democrat controlled.

 

There is one exception. Vermont became democrat controlled and they never have had any gun licensing laws.  They still don’t.

 

I wish it wasn’t so, but I’ve seen it with my own eyes.  Judging by their actions, the democrats want us disarmed.  I wish both political parties defended our rights.

Tracy – Many medical practices are now owned by major healthcare corporations, such as Healthcare Corporation of America. HCA has a policy prohibiting firearms at their facilities. How can we circumvent this? I work for a group of specialty physicians, some of whom are gun owners, but their practice is owned by a large corporation. Are those patients just out of luck?

PA Home Invasion

Servando Santos was warned.  After assaulting an elderly lady in Dauphin County PA, he forced his way into a nearby home.  The homeowner confronted Santos and warned him that he was armed.  Santos continued into the home.  The homeowner then fired several shots, one of which hit Santos in the abdomen. He then continued further into the home and struggled with other people before being subdued shortly before police arrived.

Santos continued struggling with officers and was taken into custody.  He was given medical attention at the scene and transported to a local hospital where he died from this wound.

The female from the first residence was in the hospital in critical condition

Taco Bell Shooting

Two armed robbers walked into Taco Bell in Cleveland.  It was the middle of the afternoon and they were wearing masks on their faces as if they were acting in an old western.  Instead of a Taco Supreme, they ordered the employees behind the counter to  lie down on the ground.  The robbers were both armed.  Six employees were in the store that evening.

The robbers walked up to the cash registers and three other employees then fired several shots at the two masked men.  They shot one of the robbers 6 times.  The other robber immediately ran from the restaurant.

Police found the first robber laying face up on the floor unconscious with a faint pulse with the loaded gun still in his hand.  He died after being taken to a local hospital.

The second robber had not been apprehended.

Tracy – I’m glad to see an employer who lets their employees be armed at work.

Indianapolis Carjacking Prevented

Law student Kari Bird was getting out of her car.  She was parked outside her home.  It was almost midnight and a group of 3 or 4 young males approached her.  She didn’t think much about it until one of the robbers presented his firearm and demanded her keys.

Just after handing over her keys, she remembered that all of her very expensive law books were still in her car.  She reacted quickly and drew her own gun from the center console.

The robber said ‘Oh, [expletive]’ , and then ran.

 

Tracy- do we know what state this was in?

Spokane Neighbors Stop Burglars

Recently in a close knit Spokane neighborhood a couple was watching TV and noticed by the reflection in the TV that a couple of people were walking up to the house next door.  They didn’t recognize either person and knew that the woman who lived there was not home.

They knew they were going to have problems contacting the neighbor since she had gone to an area of notoriously poor cell service.

Raymond Dupris watched the couple from his window as they walked past the house then came around back through an alley.  The female burglar was pacing around and the next thing Dupris sees is a backpack fly over the fence and the male suspect jumps the fence.  When he broke in the door, Dupris told his wife to call the neighbor from the other side of their home.

The neighbor came over with his gun and Dupris’ wife called Spokane police.

When the burglar tried to exit the home through the bathroom window, the neighbor aimed his gun at him.  He then tried to flee through the front door but was cornered by Dupris and the neighbor.

“He just stopped in his tracks and got down on the ground.  I held him down on the ground and got on him with my knee on the back of his neck and the other neighbor had the gun on him, and we were just waiting for the cops,” Dupris said.

Spokane police arrived quickly and arrested the 21 year-old man.  He make an appearance in court for a residential burglary charge and a $500 bond was set.

 

Tracy – My doors are locked for YOUR protection! I’m also NEVER going to look for trouble. Call 911. This is why we have property insurance.

Rob- I want them to listen to this podcast so they have a plan.  That means they know what to do, and what to not do.

Pistol Packing Mama chases off home invader

Brett Santo walked into Sarah Long’s home in Elyria OH and approached her 15 year-old daughter.  When Long’s 17 year-old saw Santo, she screamed which launched her mother into action.

She grabbed a pistol by her bed and charged Santo but dropped her gun while still in her home.  She and the 17 year old chased Santo out of the house and down the sidewalk until they lost sight of him.

Officers were dispatched to the area on a report of burglary suspect fleeing the area and Long provided a description.

Police found him on a short distance away and during the ride to the station admitted to burglarizing the home.

This was not the first time Long chased Santo from her home.  He entered her home but left when confronted.  This time when he approached her daughter, the mama bear made an appearance.  Her boyfriend had just left the house and had told her to keep the pistol handy.

 

Rob- To give moma bear a bit of credit, maybe she chased her daughter, not the thief.

Hal thinks Paul’s choice in guns is… Less than ideal

 

I had just about forgiven Paul for his glock-fan-boy shame since he smarted up and started carrying a S&W Shield and then we came to episode # 412 and the question of BBQ guns. Paul made the statement regarding 1911’s… “I am not a 1911 fan” (gasp!!!) “I do not like them” (heresy!!!) “I think they are very old technology” (that should be stated as ‘have stood the test of time!’) and then, shame of shame “incredibly outdated”… OMG!!! I almost drove right off the dang road! I must admit, he did save a very small bit of face when he described how much he liked the Cabot 1911 with the meteorite grip, I could hear the lust in his voice! That made his previous comments almost bearable! I had to put the torches and the tar and feathers back into the closet that I hide them in and will once again try to find a way to forgive Paul for his blatant sacrilege of not liking a near perfect form of sidearm that some of us learned to shoot at the age of 7… some 53 years ago… as taught by our Marine father.

 

In response to the obvious question… yes, I have shot the glock, many times, and find it to be the Yugo of firearms, cheap, somewhat efficient, ultimately serviceable and totally undesirable, for me, on par with a hi-point… this is my opinion, no better than Paul’s, and we all know what they say about opinions!

now, if one of you would be so kind as to tell me what font we are supposed to use when utilizing sarcasm, those portions of my commentary in which I am utilizing sarcasm would be much more easily discernible…

Do you want to attract more women and minorities to your club?  Do you want more young people at your events and fundraising activities?  Here is your opportunity to back up your words with actions.  Since concealed means concealed, new gun owners don’t know what they are missing.

 

Put on a concealed carry fashion show that looks like the members you want rather than the members you have.  You can do more than tell new gun owners that they are a welcome part of Armed America; You can show them.  Show them that concealed carry holders “look just like them.”

 

Amanda wrote this book with us in mind.  This is a nuts-and-bolts kind of instruction manual.  She identifies the people, positions, tasks and decisions you need to make your event a success.  Events like this have been done before.  We all can learn from their experience, the good and the bad.

 

I want you to do it.  A fashion show does more than demonstrate methods of concealed carry for men and women.  It can recruit new members into your club, and it can be entertainment for existing members.  The show can be a fundraising event for your organization.  You can showcase local vendors and promote their products.  A fashion show does that,  and something equally important.

 

A concealed carry fashion show communicates what responsible gun owners in your community look like.  You get to make that statement rather than accept how gun owners are portrayed in the media.

 

Do it.

Rob- I read the Wren decision out of the DC appeals court. I recorded David Cole for Self-Defense Gun Stories. I carried every day. We dodged a hurricane, so it is still a little wet to go to the range. I did some dry practice indoors.

 

John- My week has had dual highlights. First, I had dinner – in person, mind you – with Paul on Wednesday as he was driving through with a load. Then, my granddaughter Olivia spent the weekend with us which is always a treat. I also attended the Greensboro, NC gun show with my son-in-law and his dad. My biggest take-away is that AR prices are way down – Ruger AR-556s for as low as $449 – and that the new short barreled firearms from Mossberg and Remington are big hits.

 

Tracy- I went to Camp Gladiator five days this week. I gave a retired husband and wife a lesson on Thursday night, where they quickly learned that good gear choices can make or break a private lesson, and I worked as the chief range safety officer at Shady Oaks Gun Range today in Cedar Park. I’m still on the lookout for a reliable source for gas for my Denali.

So Let It Be Written So Let It Be Done.

In July 2010, R. Joseph Franzese submitted an application for a business license. He proposed opening a gun shop called Second Amendment Arms (SAA). Franzese bought the property advertised as commercial property, but the city now claims it was not zoned as commercial. He contends the city will block a gun shop, no matter where it’s located. The Second Amendment Foundation became Franzese’s ally and backed a case challenging a ban of firearms sales within city limits. A federal court judge in Illinois denied a City of Chicago motion for summary judgment and refused to dismiss the case. Robert M. Dow, Jr., U.S. District Court Judge set Sept. 28 as the next date to discuss damages for the plaintiff in Second Amendment Arms v. City of Chicago.

Alan Gottlieb, SAF founder and Executive Vice President, said “The City of Chicago under Rahm Emanuel is trying to be too clever by half. We would have thought by now that they would have ceased this pattern of spending tens of thousands of taxpayer dollars on stubborn litigation, but the city seems determined to be dragged kicking and screaming into compliance with the Second Amendment. Since losing its gun ban fight in the Supreme Court’s 2010 McDonald ruling. Chicago has been digging its heels in deeper and deeper, throwing every kind of legal roadblock it could in an effort to delay what seems inevitable. The city has got to follow the law and the constitution, and as long as they keep fighting, we’ll keep suing. That’s what winning firearms freedom one lawsuit at a time is all about.”

 

John – What Chicago is engaging in is a form of “red-lining”. The use of zoning to keep out legal business. It was originally used to keep African Americans out of certain neighborhoods because mortgage companies wouldn’t lend to them.

 

Rob- I agree, John.  This is a civil rights violation and it has been going on for a very long time. Why is the city’s bigotry allowed to stand?  The city demands live fire before it will grant a permit.  A judge should demand that the city open police ranges to civilian use until a private company stands up.

So, you think you have Constitutional Carry?

If you are not familiar with the work of John Lott, you are missing out on some valuable information.  His Crime Prevention Research Center published an article addressing limitations on Constitutional Carry in March of 2016. https://crimeresearch.org/2016/03/the-very-real-limits-on-constitutional-carry/

 

The focus of the article is the federal Gun Free School Zones Act.  This legislation was originally introduced by Senator Joe Biden and signed into law by President George H. W. Bush in 1990.  In 1995 this law was struck down by the U.S. Supreme Court.  This was a landmark decision.  It was the first time in over 50 years that the Supreme Court placed limits on Congress’ ability to legislate under the Commerce Clause.  In 1996, Congress massaged the language and reenacted this unconstitutional statute.

 

This statute criminalizes the possession of a firearm within 1,000 feet of the boundary of a school.  There are exceptions to this rule.  Unloaded firearms that are in locked containers in a vehicle are exempted.  Private property within 1,000 feet of the school boundary but not part of school grounds is also an exception.  Additionally, persons licensed to carry may be exempt.  However, you must have a license issued by the state in which the school district resides.

 

If you live in a Constitutional Carry state and you do not possess a state-issued license, you have a problem.  You are committing a crime if you find yourself carrying a firearm within 1,000 feet of a school boundary.  Dr. Lott’s article points out the difficulty of even driving across a typical city without violating this law.  Even if you are unaware of the school tucked back in the woods two streets to the east of you, you are eligible for a five-year, all expenses paid prison term and a $5,000 fine.  Even gun-friendly states have anti-gun politicians and prosecutors in their larger cities.

 

Congressman Ron Paul introduced legislation to repeal the GFSZA on three separate occasions.  His bills never made it out of committee.  Can you say national reciprocity?  The more things change, the more things stay the same.  Gun control is about control, not guns.

 

Rob- I used to open carry in California.  You had to know where every school was located.

Belle- How is this enforced?

 

Truckin’ through Wisconsin

Truck driver Guy Smith of Wisconsin pulled into a weigh station Kenosha County in June of 2016.  He then found himself charged with carrying a concealed weapon after his revolver was seen in the cab of his truck.  Of course, they confiscated his property.  Mr. Smith does not possess a concealed weapons permit.  

 

Smith’s defense attorney, John Monroe, prepared two theories to defend his client against these allegations.  The first defense is as simple as it gets.  In 2011 Wisconsin passed a law making it legal to have loaded handguns in vehicles.  A revolver is a handgun, isn’t it?

 

To paraphrase, Monroe said the charge never should have been filed because the the law allows handguns in cars to be unencased and loaded.  This seems pretty clear, doesn’t it?  But the prosecutor intended to take this case to trial.  The prosecutor actually stated that the law could not mean what it said because it would invalidate concealed carry law.  The judge in the case corrected him by stating that it would “in cars.”  Again, this seems like common sense stuff.  That is true unless you are a prosecutor with an axe to grind against citizens arming themselves.

 

The second defense theory Monroe devised centered around Castle Doctrine.  Wisconsin, and most other states, allow the use of firearms in their home, business or vehicle.  As Mr. Smith’s truck provides transportation, a livelihood and lodging all three elements of a castle exist.  

 

When prosecutor Thomas Binger learned of the defense Monroe planned to present at trial, he asked for a postponement.  Presumably this was to give the State more time to prepare.

 

On August 28, just before the date of trial, the State dismissed all charges against Mr. Smith.  Monroe pointedly stated they were not informed of this dismissal until the defense had been prepared and they traveled to Kenosha.  As Dean Weingarten of Gun Watch stated, this sounds like a case of punishment by process.  Was there ever an intention of going to trial with this?  Or, was Mr. Smith just being railroaded by a powerful government?

 

After the dismissal, Mr. Smith said, “I’m just a trucker trying to stay alive.  I want my gun back and I don’t want a record, and I’m not paying a fine.  I didn’t do anything wrong.”  Well done, Mr. Smith.  Perhaps we need a remake of Mr. Smith Goes to Washington?

John – Guy Smith still has his legal bills. The prosecutor was trying to drag it out to force Mr. Smith to plead to a lesser charge because of the uncertainty involved.

Hurricane Harvey Mischief

As we have seen this week, while thousands were fleeing Hurricane Harvey, the low lifes came out to “play”.  About an hour after the storm made landfall, police in Corpus Christi responded to a call and found a man with a gunshot wound in the head.

It appeared that the man tried to break into the home and the armed homeowner defended himself.  The man was coherent and was transported to the local hospital.

In a second incident near Houston a few hours later, a home invader was shot and killed by the homeowner.  Both incidents were still under investigation.

Rob-  Low light.  You need a flashlight and a cell phone.

Gary-

Belle- low light practice is more important than people give it credit for. How often is it dark? About half the time? Why wouldn’t you practice that skill?

Belle Night sight can be a distraction too. Low light shooting is likely to be close, because of the diminished ability to see anyway. Practice your point shooting or as Marty teaches, your Default Stance and you’ll develop the necessary skill.

 

Evil Roy shares a story

Fans of SASS or Cowboy Action Shooting know Gene Pearcey by his SASS moniker of Evil Roy.  He recently posted this story.

Here’s a self-defense story from a friend. It demonstrates the value of awareness, presence of mind, and making other members of you family familiar and proficient with available firearms. Being a cool head doesn’t hurt either.

My friend stops at convenience store on the way back from the lake. His shorts are wet so he takes his small pistol out of his pocket and puts it the door pocket. He tells his wife the 1911 is in the center console and goes inside. A small car pulls up alongside and a guy gets out. The wind blows his shirt up exposing a weapon. The wife is not sure if it is a knife or gun but she is alerted. My friend comes back to the Suburban and opens the rear doors and reaches for the cooler. He turns around to see the guy standing very close looking very tense, wild eyed and agitated. Bad things are about to happen. Suddenly he gets very still and very slowly lowers his hands to his side and makes some idiot remark about looking for gas. My friend looks over his shoulder and sees his wife aiming a very shiny 1911 through the truck at the guys head with the safety off from the passenger’s seat. Guy very slowly mutters some nonsense and leaves. The wife did not say a word through the entire encounter. Lots to learn from this incident.

Rob- Teamwork is insanely effective.

Belle- Great example of why it’s important to be aware of pre-attack indicators.

 

Wrong ATM

Sierra McFatridge was outside getting her dog when she heard the crack of gunfire and saw a robber falling right in front of her.   She said, “I didn’t know where the shot came from and then he was right there in front of me.”

A 51 year-old man had just visited the local ATM, withdrawn cash and was walking home when the robber hit him in the head.  The robber had a rock.  His intended victim had a gun.

The thug got away but a neighbor saw a woman in the get-away car and gave the license plate number to police.

Police said the victim was transported to the hospital with non-life threatening injuries.  Once again the case was still under investigation.

Rob- The victim was walking with his son.

Gary- Grandma was robbed.

 

Man hold suspect at gunpoint until police arrive

In South Carolina, a deputy was serving a warrant for car theft when Christopher Cravets spotted the officer and ran from the scene.  He was wanted on an armed robbery charge. The deputy called for backup and multiple agencies responded.  The manhunt was on.

Charles Belcher had gone to visit his girlfriend in the area and she informed him of the ongoing manhunt.  He retrieved his gun from his truck and went back inside.

He then went outside to check the property.  He spotted Cravets hiding in the back of an Explorer in a carport on the property.  He ordered the man out of the SUV and to lay face down on the ground.  He then held him at gunpoint until the police arrived.

“The only thing I was worried about is if he had a gun and if he was going to try to shoot me,” Belcher added.

Ok folks I have tried to stay out of the 1911 “discussion” but….allow me to go back a few episodes.  You had a guest who was trying to decide between a Springfield EMP and the range officer.  I own both and would suggest either or both for anyone.  The EMP is nice for CCW when you have light clothes or need deeper concealment.  The range officer is great to have a full size 1911 on your hip.  Buy both and you can choose each day.  They feel the same in your hand and function exactly the same.  The only difference is the recoil.

 

ok Paul I have to agree with you on wanting a 64 1/2 Mustang (I would love one too) but anytime we compare cars and guns we run into problems.  So if we are going to compare a 64 1/2 mustang and a new car the difference we see is a huge increase in government regulation and safety features as well as digitalization.  So I’m afraid you would have to compare the 1911 to a “smart gun” in that comparison.  I don’t think any of us want a smart gun!!  

I’ll agree with Belle “1911 finest handgun known to man”, but I also like to take my wife’s XD mod2 out for some target shooting too.  She carries hers all the time and loves it.

All in all, carry what you practice with, practice and get training often and above all else POGO!!

Hey crew,

It has been 7 years since I have had interaction with the DOT but today was my lucky day. The Officer approached from the passenger side and asked if we could pull off into the truck stop parking lot a few blocks up. For Paul’s benefit we do 99%of our Excavation work in Barron county WI so we don’t see scales ever. Before he left I informed the officer of my Glock 22 as I openly carry. When we got to the parking lot and he started the inspection he and I had a wonderful chat about firearms as he cited me for a non approved air line splice and let the few other things go with a warning provided they are fixed within 15 days. Be polite with officers and do what they say always but especially when armed. This gentleman was polite as we chatted about guns walking around the truck and trailer looking at the needed repairs. Enjoy your night!

Jake writes in about safeties on firearms

 

I understand where he is coming from, but I have to disagree with Paul on manual safeties on concealed carry firearms.  I have carried for years with a fullsize with no manual safety and a subcompact with manual safety (depending on the season, what I’m wearing, and the required level of concealment).  If you ever observe me when shooting, you will notice on every gun, even those without when I draw or otherwise prepare to fire, my thumb swipes downwards on the left side of my gun as if disengaging a safety, and ends in a proper shooting grip.  On guns without safeties, it doesn’t cost me anything in terms of time or mental effort, and of course it’s necessary on guns without safeties.

 

I’m beginning to change my mind on the usefulness of safeties and DA/SA guns purely for additional safety when reholstering.  Reholstering is the most dangerous gun handling task we commonly do, and a stray string from a sweatshirt, piece of brass, rock, fold of a t-shirt, or any number of other things could get stuck inside the holster or trigger guard on holstering and cause an accidental discharge.  With a hamer-down DA/SA gun, you can keep your thumb on the rear of the hammer so you feel it begin to move if the trigger is pressed by anything, and with a gun with a safety, you can physically stop the trigger from moving.  If I want to carry with the safety off, I can toggle the safety on, holster, then withdraw just far enough to disengage the safety before reholstering.  Lately, though, I just keep the safety on – I instinctively disengage it on drawing anyway.

Just wanted to thank Tim Crosnoe for his elaboration of natural point of aim as it is sometimes talked about in pistol shooting.  I had begun to wonder how NPOA could be used in pistol shooting as the shoulders are mostly muscular joints.  This seemed contradictory to the NPOA we learn at Appleseed which takes the muscles out and relies on the sling and bones to get an NPOA.  It’s nice to know that I’m not the only one thinking about NPOA as it is different in pistol shooting vs rifle shooting.  Thanks to Tim

Rob- I completed my series called “Government Fees Discourage Concealed Carry.”  In shall issue states, our concealed carry laws and fees disarmed 8 million of us.  I also asked if “Gun Laws are Really Common Sense..or More of the Same Stupid Stuff?” Do these regulations disarm criminals or disarm honest gun owners?  Do they do more harm than good?

For those who like a little bit of history with their firearms, I did a post on a lesser known trench gun, the Remington 10, used by the American army in World War One. Only about 3,500 of these bottom ejecting pump shotguns were made. They also came with a 17” bayonet. Moving from the old to the new, Century Arms released a product safety warning regarding their Canik line of 9mm pistols. Owners are warned that repeated dropping of the pistol could damage internal parts. Century will release a severe duty upgrade by Sept 8th.
