Personal news from each participant (when you are done with your segment please ask the next person what has been up with them)

Rob- I got books and DVDs from the Armed Citizen Legal Defense Network.  And a new shoulder holster.  Thanks, John.

John – I finished grading all my exams, turned it my grades, and now my career as an adjunct professor has come to a close. That will give me time to actually go shooting and I won’t have to worry about missing a class when I attend the SHOT Show. Speaking of which, I got my program for it in the mail today and now just need my badge to arrive. Other than that, I’m trying to wrap business up as we are heading to St. Louis on Saturday for a whirlwind trip.

Gary – What training do you have coming up?

A couple of private classes left this year. January is getting pretty booked up.

We’re Winning!

For the first time in twenty years, a majority of Americans oppose an “assault weapon” ban. In a New York Times poll that probably rocked the editors to their Guccis, 50% of Americans are now against a ban, while 44% remain in favor of the Clintonesque elimination of the modern sporting rifle. Since 1995, the public reversed its opinion by 16 points, an incredible amount considering this divisive, highly politicized issue.

The poll numbers are backed by the increasing numbers of first time AR-15 buyers, ever-climbing NICS checks, long lines at the ranges, humming firearm factories, and the sadly reduced stocks of firearms and ammo in gun stores. This change has occurred in spite of the media’s steady anti-gun drumbeat, the constant demonization by the politicians, junk science studies, and Bloomberg’s millions.  The reversal has come with the steady leadership of the NRA, the brilliant legal maneuvering of the Second Amendment Foundation, and the steady rain of facts and analysis from John Lott. Mostly, the change came from the American people themselves, who must have looked at the realities of America’s rifle, and it’s role in defending the Constitution and the United States against all enemies, foreign and domestic.

Rob Comment- Candidate Hillary Clinton said that voters WANT more gun control.  How is it possible that many public opinion polls say one thing and Candidate Clinton says another.

Gary- She lies.. and

John – In response to this, Rep. David Cicilline of Rhode Island introduced HR 4269 yesterday. While the text isn’t available, the working title says everything –  A bill To regulate assault weapons, to ensure that the right to keep and bear arms is not unlimited, and for other purposes. It has 123 co-sponsors – all Democrats.

He’s Loosing!
In the wake of the San Bernardino massacre, Obama continues his attempts to keep guns from the hands of American citizens. As if international terrorism can be defeated by simply controlling firearms of law-abiding Americans. His administration is working on executive actions to tighten background checks, create additional classes of prohibited persons, and increase the requirements for Federal firearms licensees.

To further these goals, Obama invited our old friend Michael Bloomberg to the White House for a closed-door strategy session. “The two discussed ways to keep guns out of the hands of those who should not have access to them and what more could be done at the state and local level to help address gun violence in America,” according to the White House. Obama is obviously looking to coordinate the media mogul’s support for any sweeping executive restructuring of the firearm laws. The legality of the executive actions is questionable and would certainly be challenged in court by the Republicans and the gun- rights organizations. Despite these hurdles, Valerie Jarrett said that the executive orders would be revealed in “short order,”

We’ll be waiting, Mr Obama.

John – More importantly, the attorneys for the NRA and the Second Amendment Foundation will be waiting!

Rob- Bloomberg wanted to know where to send a check.

Sen Paul’s Bill To Gut DC Gun Laws

We’ve told you before about DC Police Chief Cathy Lanier urging her city’s citizens to fight back against terrorists — while working to eliminate the firearms that would allow the citizens to fight effectively.  Now, Senator Rand Paul is fast-tracking the “Defend Our Capital Act 2015” which would gut the city’s draconian gun-control laws.

Paul’s proposal would force DC to issue concealed carry permits to both District residents and nonresidents. It would also require the District to honor concealed carry licenses from other states and roll-back D.C. laws that currently restrict gun and ammunition ownership. The proposal can’t come at a better time, as a three-judge panel at the U.S. Court of Appeals for D.C. disqualified a federal judge in a ruling where he said the District’s highly restrictive concealed carry law is unconstitutional. DC’s ban on CCWs is back in force.

Unfortunately, Paul needs the support of at least six Democrats to move the legislation through the Senate over the threatened filibuster. Joe Donnelly was the only Democrat to vote in favor of Paul’s amendment last week; RINO Republican Mark Kirk (IL) voted against it.

Call your Senator and urge them to support this common-sense gun law!

Governor Trying To Implement No Fly – No Buy in Connecticut

Connecticut Governor Dannel Malloy is trying to make his state the first to ban the sale of guns to people on federal government watch lists. Claiming this as a common-sense step, Malloy would implement the ban by executive order, which he says he will soon sign.

The measure, which Malloy said needs federal approval, would require state police to determine if a potential gun buyer was on the federal no-fly list or on a watchlist for people suspected of ties to terrorism. It would also revoke existing gun permits issued to people on such a list.

Although Malloy claims this is the right thing to do, State gun-rights groups were quick to criticize the move. “I think it is downright dangerous and above and beyond what is constitutionally acceptable,” said Scott Wilson, president of the Connecticut Citizens Defense League. White House spokeshole Josh Earnest welcomed Connecticut’s move but said that the Obama administration was determined to press ahead with federal action on guns. “There are necessarily some shortcoming to that approach,” Earnest told reporters at press briefing on Thursday.

Shortcomings, yes; at least two. The ban would not have stopped the terror couple’s California attack as the shooters were not on any government terrorism watch list. Loving a bad idea, Illinois and California are also proposing similar laws. Many legal scholars believe these attempts would be in direct violation of Amendments Two, Five and Fourteen of the  United States Constitution. Governor Malloy would also be in violation of Article 1, Section 8 and Article 1, Section 15 of the Connecticut Constitution. The Second Amendment Foundation, among others, is promising an immediate lawsuit. It’s time to get out the checkbook to defend your rights — again.

Comment- rob- I think the no-fly no buy proposal is a distraction.  Look at all the gun control laws that absolutely failed to stop mass murderers.  The two muslims who attacked an art show in Garland Texas,  the murderer who shot up armed forces recruitment centers in Chattanooga Tennessee, the murderer at the Oregon community college, at colorado Springs, and now the murders at the Christmas Party in San Bernardino.  Gun control failed each and every time.  The democrats need a distraction from their failure.

John – I would not be surprised to see Gov. Terry McAuliffe try the same thing in Virginia. It appears that there is a definite strategy to try and end run Congress on this by going to gun-control friendly states. Or, at least, states with Democrats in charge.

Paul – I wonder if this is a dance with Obama

Gun TV

This is going to make some anti’s heads explode: Gun TV, a channel that lets people order firearms from the comfort of their Barcaloungers, is coming to a flatscreen near you. The GTV Live Shopping Network will open for business this coming January. Viewers will be able to buy guns, ammunition, firearms accessories and related gear dressed in their fuzzy slippers. All firearms laws will be followed. Purchases will be sent to local retail stores, where customers will have to pass the federally-mandated background check before taking their firearms home. Initially, there will be six hours of GTV a week, expanding to 24/7 sometime in the first year.

Predictably, the antis immediately speed-knotted their panties. Critics (there’s always some) suggest that Gun TV could trivialize the decision to purchase a weapon, making it the equivalent of ordering a Snuggie or a Ronco Pocket Fisherman. They believe it’s not a decision you should be making at three in the morning because you are watching TV.

We could say the same thing about Snuggies.

Resisting Unjust Laws

Fifty-two years ago, Martin Luther King, Jr. wrote from his Birmingham jail cell: “One has not only a legal but a moral responsibility to obey just laws. Conversely, one has a moral responsibility to disobey unjust laws.” Today, many are heeding the spirit of Dr. King’s words and engaging in civil disobedience of what they feel are unjust, unConstitutional laws.

New York’s draconian gun ban has been routinely ignored by the state’s residents, with compliance being estimated at less than ten percent. Connecticut’s state government passed a law demanding the registration of certain firearms, and the people of Connecticut mainly refused to comply. The city of Sunnyvale demanded that residents hand over all firearms capable of accepting magazines holding more than ten rounds — everything except revolvers and some single-shot rifles — and their citizens turned in a grand total of zero firearms. LA city’s ban on standard capacity magazines has resulted in exactly zero mags being turned into police during the grace period. Throughout the United States, citizens are refusing the mandates of their so-called leaders.

Political scientists call it “Irish Democracy” when a populace resists unpopular laws by simply refusing to comply with them. It is a low-grade form of civil disobedience, which can be quite powerful when practiced by a significant portion of the people. When the resistance is widespread, as during Prohibition years, the situation effectively becomes ungovernable.

Gun owners are by large an extremely law-abiding group. But push them too far, and they can become rather stubborn, believing in the intent of the Founding Fathers, their natural rights, cherished freedoms, and the absolute necessity of keeping and bearing arms in this very dangerous world.

John – FAA licensing of model planes.

DOJ slow in processing california carry applications

There has been another run on guns as people flocked to gun stores.  This is particularly true in California.  This makes some sense since California has had more than its share of mass public murders.  Its borders are wide open, and the bankrupt state is releasing convicted criminals from jail at an alarming rate.  Some gun stores reported doing four times their regular business.  The requests for background checks and concealed carry applications have also gone up.  Now there is a new bottleneck in Sacramento at the California Department of Justice.  They were always slow to run their background checks.  Now they say they will be even slower.  So tell me.  just how long can they wait as these honorable citizens wait to get the state’s recognition?  Will they wait weeks, months.. or years.

Even before this latest muslim attack in San Bernardino, the wait to get an interview in Placer county was 9 months.  Can you say infringed?

Comment- can you say lawsuit, as in a right delayed is a right denied.

Church carry in California

Geof Peabody lives on the western slope of the Sierra mountains in El Dorado County, California.  Peabody trains priests, ministers and church staff for free at his gun range in Placerville.  He’s trained more than 500 people, and the list is growing rapidly.  Classes filled again early this year with the murder of nine parishioners at a church in South Carolina.  Graduates from his class are qualified to apply for a concealed carry permit, and they have.  Many of them carry in church.  El Dorado County Sheriff John D’Agostini is an enthusiastic supporter of concealed carry, and of Peabody’s training for church members.  Sheriff D’Agostini was asked if he feels safer with more concealed carry holders in his county.  Agostini said  “Absolutely. These are law-abiding people. It’s the evil criminals that are the threat.”

More Video from NJ2AS

New listeners might not know about New Jersey’s attitude towards citizen self-defense.  The police delay issuing firearms purchase permits.  They refuse to issue concealed carry permits.  Judges tolerate that abuse of the right of self-defense.  Both prosecutors and judges treat honorable firearms owners as criminals.  In many cases gun owners are treated more harshly for minor violations than are violent career criminals.  This falls on deaf ears in New Jersey legislature.  The New Jersey Second Amendment Society recorded police officials giving false information to the public when citizens asked about applying for a firearms purchase permit.  Now we candid video to show police misconduct claims, and the video is being run on TV stations across the state.

Well done, New Jersey Second Amendment Society.  Can’t wait for your next video to come out.

Kentucky scans concealed carry each month

Kentucky leads the nation in background checks.. for a simple reason.  The state runs a background check on every state concealed carry holder every month.  Now given that the state would know if IT put a concealed carriers name INTO the database, the only reason to run a background check is to see if the concealed carry holder was convicted in another state.  While it does happen, this sounds like a government make-work project riding on the back of honest concealed carry holders.

John- Felony crimes are rare.  Citizens with a concealed carry license commit major crimes only 5 percent as often as the general public.  This is a waste of time, and the police are already busy.

Rob- California sheriff was denied.

Alabama AG whispers, and gun ban signs come down

Sometimes things work as planned.  Alabama passed a law allowing concealed carry in public buildings.  Some public officials thought they controlled us rather than the citizen controlling them.  The law is clear, and the Alabama attorney general received complaints about a number of no gun signs.  These misplace signs were at county offices, tax commissioners offices, county convention centers, historic buildings, theaters, hotels, city halls, public libraries, arts centers, and animal shelters.  The attorney general, Luther Strange, said the signs must come down or these government agencies would be charged in state court.  The signs came down.  As a reminder, the signs came down at public polling places too.

John – Our friend Liston Matthews was one who wrote in.

Carry at work in Oklahoma county

Some states have a different attitude towards government employees carrying at work.  County commissioners in Logan County Oklahoma said employees can carry when they are out of the office. That means a road crew or county inspector can carry for their own protection while they are in the field.  Fortunately, the sheriff agrees.  It isn’t clear yet if county employees can carry in the office as well.

Texas- has a gun ban problem- separate but equal.

The University of Texas has a gun ban problem.  The law requires the University to allow licensed carry on campus.  But, and it is a big but, the university can impose rules for “public safety”.  What we call public safety and what they call public safety are widely different.  Their rules allow an university employee to impose a gun free zone on their office.  The staff member then has to make themselves available to students at another location.  That means the concealed carrier has to reveal if they are carrying.

Comment-  On the other hand, a student who might not be old enough to carry yet, could also ask to meet with the employee outside the office.  I’d do that just to piss off the liberal professors.

John – Liberal professors. But we repeat ourselves.

Susan- True.  What the regulation does NOT DO, is require that the frightened staff member make themselves available to other STAFF MEMBERS outside the gun free zone.  The gun free zone means that the janitor has to go to work disarmed.  Texans, call your legislators.

Texas mass transit to call the cops on open carry

Texas law says that you can open carry on public transportation in Texas.  That doesn’t stop a public transit employee from calling the cops to file a false brandishing charge.  A memo to Dallas Area Rapid Transit employes says-

Greet the open carrier like any other passenger.

Notify Bus Dispatch/Train Control of the boarding/arrival.

Follow Bus Dispatch/Train Control instructions before DART Police arrive on scene.  Police will respond.

These rules are designed to inconvenience passengers that choose to peacefully exercise their rights to openly display a firearm in a holstered handgun.  This policy is also designed to train the public to fear open carriers.

Sounds like the open carriers need to plan trips with their own video crew until the Rapid Transit Authority remembers who they work for.

Gun Quotes

To ban guns because criminals use them is to tell the innocent and law-abiding that their rights and liberties depend not on their own conduct, but on the conduct of the guilty and the lawless, and that the law will permit them to have only such rights and liberties as the lawless will allow. … For society does not control crime, ever, by forcing the law-abiding to accommodate themselves to the expected behavior of criminals. Society controls crime by forcing the criminals to accommodate themselves to the expected behavior of the law-abiding. – Jeff Snyder

1 St Louis Homeowner Shoots a Home Invader

A quiet North St Louis county morning was shattered by gunshots as a homeowner defended his life from two home-invaders. The owner heard a loud banging on his front door and saw two men that he did not recognize, which prompted him to grab a gun. He was ready when the pair splintered the back door.

Shots were exchanged, and a 19-yr-old thug fell mortally wounded. His partner left him on the floor and ran. Several days later, St Louis police arrested another 19 yr old and charged him with armed criminal action, burglary and second-degree murder for the death of his accomplice. Turns out the man was already infamous for a videoed grab and run clothing robbery that knocked a 87-yr-old nun to the ground. Police will charge him with four counts of felony stealing for that crime. There is no word on what the nuns will do to him. The uninjured homeowner is not likely to face any charges as he was defending his life.

Rob- cell phone, panic alarm.

2 Two builders tear down a thief in Cincinnati

Two Cincinnati, Ohio building contractors were working on a remodel when one of them walked out to get more tools from their truck.  The builder was stopped by a robber with a gun.  The victim turned over his wallet when the second contractor came to the door.  The thief tried to rob that man of his wallet too, but this victim had his concealed carry permit and was armed.  The victim drew his gun.  The thief fired his gun several times before he was shot and killed by the intended victim.  The two victims were not injured.  They were held by police for a few hours and then released without charge.

Rob- have a plan.  Know when you’ll put it into action.  Wouldn’t it have been better of both contractors were armed?

3 Craigslist Purchase Goes Bad

A good Craigslist deal for high-end stereo equipment turned into a bad ambush. The Tennessee-area deal turned sour when one of the three buyers pulled a gun and demanded the equipment. One victim told police that if he didn’t act first, he would have been shot. He fired all nine rounds from his weapon and hit the armed suspect at least twice. The two confederates beat feet, leaving their wounded buddy in the dust. The two victims also left and called police from a safer place. Police found the convicted felon still bleeding in the street. They later arrested the other two and will charge all three thieves with aggravated robbery. The unharmed victim is unlikely to face charges as it is believed he acted in self-defense.

Police warn about the dangers involved in these types of transactions, especially around the holiday season. They remind people to only meet in public places.

4 Don’t Bring a Toy to a Gunfight
All in all, criminals are not generally known for their intelligence. One Houston area theif just might have earned his place among the dumbest.  He attempted to rob four people – two of which were military security veterans – using a toy gun – in Texas. And yes, he was well-ventilated for those lapses in judgement.

At closing time, two men and two women were leaving the Houston club where they worked. A car pulled up with three men and at least two drawn guns. While the thieves were busy robbing a woman of her purse, one victim reached into his own car and pulled a gun. Pistolman 17-year-old Dante Grant was shot several times and then kicked in the face. One other suspect may have been hit, but he managed to get away in the car. None of the victims were injured. Grant was taken to a local hospital where he remains in critical condition. Police are still searching for his accomplices. The pistol was recovered and found to be only a pellet gun. Unfortunately, the other thieves got a real handgun from the purse of one of the women.

Off body carry fails again……

Paul – Susan

5 Then Again – Some Criminals Do Learn
Three robbers faced a sudden reversal in fortune when a CCW carrying customer acted to defend his life and the life of a cashier. They reversed their path and ran from the scene. There was no word if they were actually turning their lives around at that moment.

The masked trio tried to rob the Newport News, Virginia Family Dollar late one night. One robber had a gun – but, fortunately, so did a customer. When the customer pulled his gun in self-defense, the three pirouetted and beat a very hasty retreat. Not before one was shouldered into a door jamb by his buddy. There were no shots fired.

Area police are looking for the three, who are suspected in a string of similar robberies.  One guy should be really easy to identify, from the bruise that face-full of door must have left.

6 Criminal Pushes His Luck, Follows His Victim Into Home, Gets Shot

From the Only in Nowlans Files: An auto burglary suspect was challenged by the car’s owner. Apparently a little cranky from having his work interrupted, the criminal used a large stick to beat the 62 yr-old owner. When the victim stumbled back into his house, the suspect followed. There, the injured man was able to retrieve a gun and put two into the brazen thief. Jordan Lowe is in stable condition and recovering in a local hospital. He’ll be charged upon release.

Here’s hoping the victim learned his lesson about carrying his weapon on his body. That might just have saved him a beating.

Paul: Rob, do you have any new posts from your SlowFacts blog you want to mention?

Rob- I have four new posts out this week.  Our listeners might like to read one called “We Stopped Mass Murder”.  Many of our defensive gun use stories fit that category.  These posts are up at Clash Daily, at  Ammoland and at my blog slow facts dot wordpress dot com.

John, tell us what’s new at your blog no lawyers only guns and money

I came across an editorial in the Roanoke Rapids Daily Herald that shocked me. It was an unsigned editorial representing the views of the paper’s editorial board. The shocking thing is that it was, wait for it, pro-gun. It was entitled “Guns not to blame for shootings”. It said that banning guns would stop as many shootings as prohibition stopped drinking. They closed the editorial by saying that “The arms we bear are in fact our most important militia weapons.  The difference between these journalists and the New York Times editors is that they live in the community they serve, go to church with their readers, and shop at Walmart with them. Journalism has a future and it isn’t at the big city dailies.
