Rob- I got to shoot my Mosin Nagant again.  I had to sight the rifle in after I put a taller front sight on it.  I am a three minute shooter so far. I’d like to shoot it again shooting outdoors with a larger target at a longer distance.  I also shot my friends Browning copy of a 1881 lever action in 45-70.  That 350 grain bullet makes the Mosin feel like a 22.  It is embarrassing that the Browning front sight was a tenth of an inch too short.

 

I read the news for Kenn Blanchard’s program Black Man with a Gun.  I was also on the Lock and Load Radio Show with Bill Frady.  Bill said he’ll come on our podcast.  So will Bob Mayne next month.

 

John, what have you been up to?

John – Not much to report this week. It has been mostly work since Memorial Day. I have been assembling the parts for my retro AR-15 A1. I just need the barrel to complete it. It will be a mixture of original surplus parts and some modern parts especially in the fire controls. My dad had shot Expert with the M-16 and I thought I’d like something similar to what he was issued.

 

Gary- Teaching, shot the Para again still working on FTF issues.

 

Paul – Getting ready for next weekend’s renaissance festival. meetings meetings meetings.

John-

-Judge  Frederick J. Scullin Junior said Washington, DC’s regulation of concealed carry was unconstitutional.  The judge enjoined the city from enforcing those laws.  Then judge Scullin denied DC’s request for a stay in his decision.  In layman’s terms, the judge said I mean it, and I mean it now.  The second amendment foundation has filed a motion seeking contempt charges against the city.

 

The city had a chance to appeal the judge’s original decision.  One reason the city might not have appealed is that DC did not want to lose in front of a federal appeals court, and the DC law was so egregious that the could well have lost even in front of a democrat appointed judicial panel.

 

-Oklahoma Governor Mary Fallin signed a knife preemption bill.  It passed the Oklahoma house by a vote of 81 to 4.   The governor signed a bill allowing automatic opening knives the previous week.  This means that common knives are legal across the state of Oklahoma.. and law enforcement can pursue violent criminals rather than chasing honest knife owners.

 

Licensed Open Carry Passes in Texas.

-The Texas senate and house passed separate open carry bills.  and then both chambers ignored open carry until the last days of this legislative session.  The Senate finally took up the house bill and passed licensed open carry.  It included a provision that open carry is not probable cause for arrest.  The concern was that texas police would arrest any black person carrying a gun.  That provision has been eliminated from the bill and both houses of the Texas legislature pass the bill on Friday. Gov. Greg Abbott tweeted, “Open Carry just passed in both the Texas House & Senate. Next destination: My Pen.

 

John – I know I have teased my fellow podcast Rachel Malone about how North Carolina is ahead of Texas on this. We have had unlicensed open carry since 1922. That said, I want to recognize all the hard work that she and other gun rights activists put in to make this law a reality. Congratulations to all 2A activists in TX who fought for this.

 

Campus Carry in Texas

A campus carry bill passed the Texas Senate by a 20-11 vote on Saturday. The bill will be taken up by the Texas House on Sunday afternoon. Gov. Abbott has said he will sign the bill when it arrives on his desk.

The bill as passed by the Senate would allow licensed carry holders carry in dorms, classrooms, and public buildings of public universities. A provision to add private universities was eliminated in a conference committee.

While schools will be able to designate their own “gun free zones”, it will be limited.

State Sen. Brian Birdwell, R-Granbury, said his legislation would allow for “very limited, reasonable prohibitions” on handguns in certain locations on university property.

He said his intent was that public college campuses would be as “permissive and accessible” as possible to handgun license holders and that universities would be as “specific and as minimalistic as possible” in defining restricted areas.

Concealed Carrier Has Pistol Seized and Disassembled and Placed in Trunk.
A Coral Gables, Florida policeman noticed a CCW License, freaked out, seized the pistol, disassembled it, and placed it in the trunk. And his chief see nothing wrong with it.

 

A man and his family were driving through Coral Gables when they were pulled over for exceeding the 15 MPH speed limit. The cop notice the CCW License when getting the Driver’s License. His reaction was completely without justification. He order the driver to freeze and the officer reached in and removed the pistol from the driver’s holster. The pistol was finally returned, disassembled, in the trunk. The driver is sure he was treated as a criminal. And his police chief feels the deputy did nothing wrong.

 

Marion Hammer, executive director of the Unified Sportsmen of Florida and past-president of the National Rifle Association, disagrees. “I believe this incident involves an illegal search — without provocation — of a law abiding citizen duly licensed to carry a concealed weapon,” Eric Friday, the general counsel for Florida Carry, Inc. also has issues with the constitutionality of the search. Friday was not surprised by the allegations.

 

Friday reiterated that no driver in Florida has a duty to tell police when they are armed. “Because of repeated instances such as you are describing to me, I no longer recommend that to people today,” Friday said. “I changed my position because of misconduct such as this. … I strongly believe it’s time for the legislature to create specific penalties that apply when the rights of concealed-carry licensees are abused, or this will continue unabated.”

 

It’s a sad state of affairs when the cops mistrust and fear their obvious ally.

 

Anti-Gun Professor Dismisses California Gun Violence Restraining Orders
We’ve met anti-gun UCLA Law professor Adam Winkler before: the blog Not One More Gun Law fisked his inane HuffPo article Ferguson: With So Many Guns in America, Police Are Trained to Live in Fear. He pushes the standard snake-oil of universal background checks and scary gun bans. So it was a little surprising when he dismissed the new California Gun Violence Restraining Orders as ineffective.

 

Last year, California instituted Gun Violence Restraining Orders allowing associates and law enforcement to immediately strip a citizen’s 2nd Amendment rights with nothing more than an allegation. Patterned after the much-abused Domestic Violence Restraining Orders, the GVROs are a clear threat to California citizen’s embattled rights. A bill to punish false allegations was soundly defeated in the legislature.

The National Journal found that GVROs would not have stopped recent mass shootings. In their report, Winkler is quoted, “The truth is that it is very rare to know in advance when someone is going to be dangerous with a firearm. This is not going to make a huge dent in our gun violence statistics.”  Seems like even this stopped clock is right for once.

 

Loretta Lynch’s DOJ Will Move Forward With a Dozen Anti-Gun Regulations

The Obama administration’s Department of Justice will move forward with a dozen new anti-gun regulations The Hill reported. These proposed rules are to be enacted in the waning years of Obama’s term.

According to The Hill, the new regulations range from restrictions on high-powered pistols to gun storage requirements. There will be a renewed effort to keep guns out of the hands of people who are mentally unstable or have been convicted of domestic abuse. There are rising concerns that the administration will try to disqualifying as many people as possible from gun ownership; people who may have had a problem at some time in their past, regardless of their current behaviour.

 

John Lott reports the media’s coming support of these efforts has been telegraphed by Columbia University’s weekend workshop for journalists. Fifteen of the panel’s seventeen “experts” were allegedly gun control advocates. Apparently, journalism that presents both sides of the story is long gone. Gun Safety is likely to be the media theme, a more palatable, disingenuous description of anti-gun efforts. The workshop promised a range of biased anti-rights talking points, ignoring much of the benefits and realities of an armed populace.

It’s been said many times before, but the remaining months of Obama’s reign are likely to be the most dangerous ever to the Constitution as a whole and the Right To Keep and Bear Arms specifically.

 

House Bill To Require Gun Owners To Carry Liability Insurance
One of Bloomberg’s Useful Idiots: NY Rep Carolyn Maloney has introduced a bill to require the nation’s gun owners to carry liability insurance. The Firearm Risk Protection Act, would require gun buyers to have liability insurance before being allowed to purchase a firearm, fining any owner $10,000 if found not to have it. Service members and law enforcement officers would be exempt from the requirement.
It should be obvious that requiring a citizen to purchase a service from a private entity before exercising a Protected Right strains the limits of the Constitution and common sense. Poor inner city residents most in need would be economically prevented from exercising their right to self-defense. This is far from Maloney’s first anti-gun initiative. Just last week we discussed her proposed bill requiring each gun purchase to be reported to the Attorney General.  Maloney and her puppet-master Bloomberg are clearly no friends of the Constitution.

 

John – I hate to add this but Maloney is a North Carolina native who went to New York City seeking fame, fortune, and gun control.

 

The New Nationwide Crime Wave: The Ferguson Effect

It’s been a rough ten months since the justifiable shooting of Michael Brown in Ferguson, Missouri. And It looks like it’s going to get worse. In a Wall Street Journal commentary, the impacts of the growing anti-police sentiments of the black activists, media and Progressive politician’s are examined. Called the Ferguson Effect, it documents the restrictions on the police and the resulting dramatic increase in crime.

 

As we in the gun-rights community well know, politicians typically respond to notorious crimes and events by punishing the law-abiding. The Ferguson Effect is much of the same. After a string of highly publicized black deaths by police, usually when the suspect has resisted arrest, there has been a slew of anti-police efforts. Police have been facing new rules, regulations and policies, DOJ consent decrees, community organizers and politicized civilian review boards, all under the highly biased microscope of the media.

 

The assault on policing has resulted in a destruction of police morale. The officers realize that any interaction with a suspect, no matter how warranted, may end up destroying their lives and family. Proactive policing, typified by the very effect “Broken Window” policies, is gone, and crime has jumped. Rates of murder, assaults, and burglaries, have increased dramatically, in some neighborhoods as much as 500%. The decades long decrease in crime appears to be ending.

Unfortunately, the immediate victims of the rising urban violence are the poor of the  inner city. Their ability to live safely and climb out of that morass will be threatened by the empowered criminals. But have no fear, the violence will not stay in the ghetto: everyone must be vigilant. Further compounding their errors, politicians will take advantage of the increasing crime rates to push for the usual ineffective gun restrictions.

 

Read the attached article in the show notes, it is well worth your time. And prepare and be aware. It’s an increasingly dangerous world out there.

Woman Injured Defending Her Home

A 51-year-old woman was shot defending the occupants of her home from three armed and masked attackers. The three attackers burst through the Townsend, Delaware home and demanded money. One of the occupants was roughed up by an invader. The woman shot at an armed intruder and suffered a shot to the leg in the exchange of gunfire. The invaders fled, it is not known if any was injured. She and the roughed-up young man are in the hospital with non-life threatening injuries.

 

Sometimes the cost of self-defense can be high – but worth it, especially when four lives are in the balance.

 

Intruder Shot By Woman

A Trenton, New Jersey woman was forced to defend her life with a gun. A jilted lover broke into her house and she shot him in the thigh. The lovesick and ventilated Jemoine Morris was picked up by police and taken to the hospital. He has been charged with criminal mischief. As of now, the woman has not been charged, but the New Jersey investigation is ongoing.

 

Cabby Fights Back

A Sebastian, Florida cab driver is alive and well after being held at knifepoint by two would-be robbers thanks to being armed. The two men had hailed the cab on early Saturday morning and then held a knife on the driver as they attempted to rob him. The cabby drew his handgun and shot one of the men. After the shooting, both men fled the scene. However, police were able to follow the blood trail and find them. The cabby identified the wounded man as the one who had held the knife on him. The wounded man was given medical assistance but died on his way to the hospital.

 

Wrong Movers

Two guys were helping a third guy move into his new Aurora, Colorado condo on Friday night. They were approached by three juveniles who attempted to rob the men at  gunpoint. As two of the men started to pull out their wallets, the third man pulled out his handgun and shot all three of the robbers. One juvenile died after being taken to the hospital, another is in serious condition, and a third was arrested on unrelated charges after he sought treatment for a shoulder wound at Aurora South Hospital. The movers were questioned by police and prosecutors and released without any charges.

 

Car Thief Held At Gunpoint

From listener John comes a tale of modern jurisprudence. Tye Wiegel was interrupted in the pursuit of his trade by a Willimantic, Connecticut resident.  Mr. Wiegel was attempting to steal the man’s car, parked in front of the man’s house. Wiegel declined to cease his attempts, so the resident went into his house, grabbed a handgun, and held the slow-on-the-uptake thief at gunpoint for the police.

Ol’ Tye is well known to the police and is said to be a heroin addict, no surprise there. Police stated that “This is not our first time dealing with him with car break-ins. He was just arrested not too long ago. He was also a suspect in a car break-in earlier today,” He has been charged with sixth-degree larceny, criminal attempt to commit the crime and second-degree breach of peace. For all that, he is held on only a $5,000 bond. Listeners are invited to speculate on how long this one man crime wave will remain behind bars.

 

Police said the homeowner was not hurt but cautioned other residents against confronting criminals.

Unfortunately, home takeovers are becoming increasingly common as thieves become more brazen and violent.  With the home invasion, kidnapping, extortion, torture and murder of the Savopoulous family in Washington, DC, the Statfor Group has written an excellent article on Surviving a Home Invasion. Hi,

 

Let me start by thanking you for your podcast.  I listen to several different podcasts on a variety of topics, but I rank yours among the most anticipated each week.

 

From time to time someone mentions holding a bad guy at gunpoint until the police arrive. The question I have is how do you do that?  If I were the sort of person who makes a living divesting other people of their possessions, and I were to encounter an armed person not inclined to be a victim, I believe I would simply turn my back, raise my hands in the air and say in a loud clear voice “I’m going to walk away now, I’m not a threat to you.  If you shoot me you will be convicted of murder, if you try to stop me or even touch me you will be convicted of assault.  In either case you will also end up in civil court where me or my family will sue you for everything you and your family have or ever will have.  I’m leaving now, and you would be stupid to try to stop me.” In fact, based on recent news coverage, you could almost make the same speech to a Police Officer.

PS, If you ever get tired of listening to podcasts, I suggest checking out librivox.org.  They have a catalog of hundreds, maybe thousands of books that have passed into the public domain, which are read by volunteers and available free of charge.  Jules Verne, Edger Rice Burrows, all the books you were supposed to read in high school literature class, books by authors you’ve never heard of, etc.  Most books date back to the early 1900’s or before. It is quite educational listening to hundred year old books and hearing the different attitudes and cultures of the past.  Its a wonderful resource for anyone who spends a lot of time in an activity which would benefit by the addition of mental stimulation.

Hey Alan,

 

Thanks for writing in!  I just got home and have added your email to our show notes for Sunday’s show.

 

A few thoughts on your email, I will of course repeat these on the show.

 

#1 if they do stop what they are doing and slowly back away, you are correct that since they aren’t a threat that you could be convicted of murder if you do shoot. However there are a few circumstance where you are morally obligated to shoot a retreating felon EVEN if the threat has stopped. If you attend a MAG40 class this will be discussed. Let me just say that the chances are so remote to the extreme to be say while the chances are not 0 they are close.

 

#2 Holding someone at gunpoint is all about control and command.  Believe me that if I were to boost my voice out good and loud in the proper tone that I can make someone absolutely believe that if they twitch in the wrong way that I am able and prepared to shoot them.

 

#3 We need to differentiate the severity of what you are attempting to stop (or in the case of our conversation have just stopped). If they have just kicked down your door and have maybe stolen something… Let them go. If they have already killed, that is another story.

 

There really is no black and white here.

 

Finally on the point of police, you do seem to have a point with that considering all of the negative publicity in the mainstream media lately, however I really wouldn’t want to be the one to try it.  😉

There were 27 shootings in Baltimore over the Memorial day weekend. 19 people were robbed in New York City’s central park. Chicago had 12 people shot to death and an additional 47 shot and wounded over the same weekend.  Our oh-so-caring politicians had to show sympathy for this flood of blue-city blood.  Josh Earnest, the White House press secretary, called for more gun control.

 

I pointed out that the violence is the symptom, not a cause.  The cause is the failed policies of deep-blue cities like Baltimore,  Detroit, New York City and Chicago.  You can’t fix stupid with gun-control.

 

I also spoke to a friend of mine.  He is a local spark plug and gets things started and done.  He started one step at a time, so I wrote an article called The Painless Ladder of Self-Defense Activism.

I just want to mention a short post I did about the Brady Center lawyers on a case in Wisconsin. They have already had to withdraw from one case because they violated pre-trial publicity rules of the Wisconsin Bar. Now it looks like they will have to withdraw from another case in Milwaukee over the same issue. Their conduct is being alleged to be prejudicial to a fair jury. It looks like another misstep by the Bad Apple lawyers from the Brady Center.

Seg 1- Personal news from each participant

 

John – Last weekend, I went to a family reunion. I got to see cousins whom I hadn’t seen in 30 years or more. Afterwards, we took time to visit the cemetery in which my dad and my grandparents were buried. Being this is Memorial Day weekend, I want to recognize those who served our country and died in its service. I think it is important to remember these men and women. My dad didn’t die while on active duty but did have to take a medical retirement due to non-combat health issues. I do think he had a reduced life span due to the stresses of his service as have many other veterans.

 

On the firearms front, I added a Spanish FR-8 to the collection thanks to Ken S., a fellow NC gunny, I met through Facebook. The FR-8 is a Mauser 98 design adopted by Spain in the 1950s. Given they didn’t have enough CETME auto rifles, some Spanish soldiers were issued these rifles which had some of the same features as the CETME including being in the 7.62 Nato caliber.

Rob– It has been a while.  It is good to hear you again.  I shot the chiappa rhino revolver when I was down in Louisiana.  I bought and shot the Browning 1911-22 for my students with small hands.  (use of external safties) Competed in two IDPA matches.  One with my 1911 and the second with my Glock 19.  That was fun and I learned a lot.  John, I added the slightly extended magazine release and slide release to my 19.  I like the combat sights.  Thank you for those suggestions.

 

Got my concealed carry permit from Arizona.  I also had two awards at a dinner we had with the San Diego Chapter of Gun Owners of California.  One was a service award.  They also had a shooting simulator at the banquet. I won a T-shirt for having the best time that hour.  In fact I was the third or fourth fastest shooter competing, but sometimes it pays to be lucky and shoot after the rush.

 

I was on Lock and Load Radio with Bill Frady.  I’ll be on his show again next Friday to talk about one of my blog articles.  I also finished a book by gun blogger Jim Curtis.  I finished the first book in his Grey Man series.

-A federal judge said Washington DC is again breaking the law.  A year ago DC was told its laws denying concealed carry were unconstitutional.  Then the city passed permit regulations that were so restrictive only one person in four thousand would be granted a concealed carry permit.  Judge  Frederick J. Scullin Junior said that was probably illegal and issued an injunction against DC’s regulations.  Quoting Judge Scullin,

 

“The District of Columbia’s arbitrary ‘good reason’/’proper reason’ requirement.. goes far beyond establishing.. reasonable restrictions. Rather, for all intents and purposes, this requirement makes it impossible for the overwhelming majority of law-abiding citizens to obtain licenses to carry handguns in public for self-defense, thereby depriving them of their Second Amendment right to bear arms.” End quote

DC Police chief Cathy Lanier said of the ruling “It’s not a huge impact for us. We haven’t had a huge number of applicants,” Chief Lanier said during an interview Tuesday on NewsTalk with Bruce Depuyt. “Our residents have been pretty clear this is not something that they wanted. A very small number of D.C. residents have applied for concealed carry.”

-Besides hearing cases for the district of columbia, Judge Scullin hears cases for the northern district of New York.  Before he became a lawyer and a judge, Judge Scullin served active duty with the United States Army as a paratrooper, airborne ranger, and as an infantry commander with the 173rd Airborne Brigade in the Republic of Vietnam.  What do you think Judge Scullin might do to the New York SAFE act and the concealed carry laws in New York City?

 

-We have another court case to talk about.  The US Supreme Court in an unanimous decision said someone convicted of a crime may sell their guns to a third party so long as the accused never takes possession or control of the firearms.  The case started when a border patrol agent was convicted of smuggling drugs.  The FBI seized the agents guns, and then refused to sell them to a third party.  The court said the FBI acted illegally and that they must release the firearms for sale or transfer.  I guess some parts of the government have to obey the law after all.

-We received news that United Parcel Service recently changed its policies.  UPS will no longer ship silencers.. even to FFL licensees.  This has always struck me as bizarre.  The US outlaws the same mufflers that are required for hunting in other countries.  We restrict mufflers that are sold over the counter in Europe.  Until our government comes to its senses, check how you ship your silencers.

-We’ve seen some state legislatures pass new firearms restrictions.  That is why we have to ask if background checks work at all?  Last week was national law enforcement week.  Of all the officers shot and killed last year, half of them were shot by felons who were prohibited from having a firearm.  The criminals used stolen guns so the thugs never went through a background check.  Criminals simply don’t obey the law.  If background checks don’t stop criminals, then who is inconvenienced and perhaps deterred from buying a firearm?  Gun laws only inconvenience honest gun owners.  Is that failure a flaw in the law.. or is it a feature that was designed in from the start?

-We have another story about a proposed gun law that won’t work.  New Jersey Representative Bonnie Watson Coleman is 70 years old.  She is a Democrat and was elected last year.  She introduced a bill in congress to restrict the sale of ammunition online.  The bill requires you to buy ammunition from federally licensed ammunition dealers.  It requires these dealers to confirm the identify of their customers with a photo identification.  It also requires the dealers to tell the US attorney general if anyone purchases more than 1,000 rounds within five consecutive days.

 

Rob- I typically order large lots of ammunition to reduce their shipping costs.  Do I become a terrorist of the month?

 

This bill will do nothing to stop crime or terrorism.   A terrorist can simply buy 100 rounds a day for days on end.. or buy from several different distributors.  In addition, our borders are wide open and millions of people and millions of pounds of drugs cross the border each year.  Smuggling ammunition to criminals would never be noticed.  Congresswoman Coleman’s bill has not chance of passage, but it will earn her campaign dollars from Bloomberg.

Democrats Urge Background Checks on All Guns Sold At Gun Shows

Some of Bloomberg’s other useful idiots have reintroduced the Gun Show Loophole Closing Act. This old bill once again claims to close the nonexistent gun show loophole by requiring background checks on all gun purchases. However, this bill hides a devious twist: it requires the transfer to be reported to the US Attorney General. That’s the office once controlled by Eric Holder, now under Loretta Lynch, that has become one of the most politicized and lawless of the federal government.

 

This bill, like the Jersey Democrat’s bill to create a database of ammunition purchasers, is part of the push by anti-gun Democrats to identify the armed citizen. The reasons behind their efforts must be chilling for those that still believe in the Bill of Rights. Please contact your Representative and urge a no vote on this insanity.

 

John – I’m ashamed to say Carolyn Maloney is a NC native.

 

-Our friend Jeff Knox pointed out that the impossible has happened.  The media tells us that gun owners are both dangerous AND impotent.  We’re called dangerous gun nuts who could kill hundreds of people.  We’re also told that a citizen with a discretely carried handgun is powerless to stop a violent criminal or terrorist.  Jeff points out where the impossible happens time and again.  It happened in Garland, and Chicago, and at the New Life Church in Colorado, and at dozens of other examples of firearms used for self-defense.  It IS possible to stop violent criminals, stop terrorists and stop deranged individuals bent on hurting innocent people.  That is to meet the attacker with deadly force. -Some of the media understands firearms.  Author Katie Pavlich writes at Town Hall.  Katie reports on a very liberal Texas woman who bought a gun.  The Texas lady made her choice to own a  gun because of two factors: Personal security and fun.  The liberal Texan had five burglaries at her home.  The break ins cost more than money; they stole her piece of mind.  To quote her, I would wake each time a squirrel ran the perimeter of my backyard fence, convinced someone was coming for me. My dreams were all of victimization, or revenge.  Close quote.

 

Then she bought a gun, and everything changed. First, she was shamed by her fellow liberals when they found out she was a gun owner.  Second, she also felt safe living in her home again.  The gun resting on her nightstand became her sleep aid.  We could have told her, but I glad she learned before she was injured.

Feral Youth

A Brooklyn McDonald’s was the scene of an attack that is unfortunately becoming too common. A pack of youths turned on a man trying to break up a fight between two girls. To shouts of KILL HIM!, twenty to forty school-aged teens beat and kicked the man, putting him into the hospital with life-threatening injuries. Several McDonald’s employees and another man were also assaulted. The attack was recorded by a boy shouting “Kill him right now!” and laughing. He posted the scene on Facebook, where it went viral.

No arrests have been made. Community activists are, of course, appalled, as required by their trade.  A Brooklyn mother said she’s disgusted and scared for her children. “To see something like that … it’s scary.”

It is scary – especially to someone who may be faced with a pack of these feral youths. Be aware, plan ahead – and avoid places where these types of kids congregate.

 

-Here is some good news from Oklahoma.  The legislature recently passed a law allowing trained school staff to carry on campus.  The bill’s sponsor was Representative Jeff Coody.  He said, “..the thinking has always been that if we eliminate guns, it makes it a safer place. The only problem is you cannot eliminate those (people) who are not willing to comply with the law. A gun-free zone is a target(…), a soft target.”  Representative Coody’s bill was supported by the Professional Oklahoma Educators.  These educators said the bill quote “(gives) options to school districts to protect their students.We cannot play games anymore. Rob-  That is great news because of the reason they passed the bill.

Paul- It sounds like Oklahoma is catching up with Arkansas, Colorado, Idaho, Kansas, Mississippi, Oregon, Utah, South Dakota and Wisconsin.

 

-There is more good news from Minnesota.  Minnesota Governor Mark Dayton signed several pro-rights bills into law.  At first the governor threatened not to sign these bills.  These bills had bipartisan support and the governor signed them.

 

  • Minnesota now recognizes concealed carry permits from several other states.  It now has reciprocity with 15 other states up from only 4 states.  That includes North Dakota citizens with a class-one permit.
  • They legalized firearms mufflers so gun owners can both own mufflers and use them for hunting or sport shooting.
  • They allow carry permit holders to bring handguns into the state Capitol area without requesting permission in advance.  In this case the Capital included a ten block by ten block area, but not anymore.
  • These new laws restricted the government’s ability to seize firearms from the public after a state emergency is declared.  This limits the ability of the police to seize firearms unless the person is arrested … and an arrest requires probable cause.
  • They allowed the purchase of long guns from any state.

-A similar law passed last week in Florida.  Florida Governor Rick Scott signed a bill allowing Florida residents to carry concealed firearms –without a permit– during an emergency evacuation.  This permitless carry lasts for 48 hours. The 48-hour period may be extended per the governor.

 

-Laws matter.  Chicago politicians created gun-free zones.  Chicago politicians created drug prohibition.  Chicago politicians crushed industry with high taxes and regulations.  That is a well known recipe for disaster.  49 people were shot last weekend in Chicago.  I’m sorry. http://gunsnfreedom.com/gun-control-fail-chicago-had-49-shot-over-past-weekend/5138

 

-We have two more judicial rulings to report.  The first said that legal open carry is not probable cause for a police officer to make an arrest.  The Sixth Circuit Court of Appeals ruled that open carry is not justification for an officer to stop, arrest, identify and question an individual.  The judge went further.  He said that the officer’s qualified immunity did not extend to detaining an individual who was lawfully open carrying a firearm.  That means officers can be sued and they are personally liable for court costs and damages.  That decision, if it stands, would put some teeth into the law protecting firearms owners.

-Listener Anthony Lucafo emailed us the link for this story. A 5th grader is in a bit of trouble in his New Jersey public school. It seems that he brought some ammunition to school. Ammunition for a NERF gun.  While pulling a late slip out of his pocket a foam projectile designed to be fired from a Nerf gun fell to the floor in front of a teacher. This violated the school’s zero tolerance policy for weapons. However as the late Billy Mays would say “but wait theres more!” our young nerf gunslinger had MODIFIED the ammunition! Our young nerf marksman had stuck a toothpick into the round so that it would stick when he fired the round towards the ground! That made the nerf ammo now a “self contained weapon” by the school’s definition. Of course the school immediately moved to expel the obviously dangerous young man, but eventually decided that a 5 day in-school suspension would suffice along with a mark on the student’s “permanent record”

 

Paul – zero tolerance means zero intelligence. It is the single most lazy way to administrate any group.

 

-Let’s end the news on a positive note.  A New Jersey Appellate court ruled that cities in New Jersey may not require added forms from firearm applicants beyond the forms that the state requires.  This is the third such decision from the New Jersey appellate court.  I hope we can now prosecute government officials who unlawfully harass New Jersey firearms applicants with additional paperwork.

Rachel Malone– Licensed open carry passed in both the Texas House and Texas Senate.  Then the senate passed the house bill.  This was the bill Rachel was working on for the last four years.  The Senate passed an amendment so open carry is not probable cause.  One concern was racial profiling of open carriers.

Does it include a provision that removes qualified immunity if a police officer arrests someone who is openly carrying?

This open carry bill may require confirmation in the Texas House.

Some Senators will take credit, but will deny they let the bill sit.

So You Woke Up Stupid This Morning?

“Honestly: That is one less guy I got to worry about bothering my mom when she’s out grocery shopping,” That’s how an Atlanta resident summed up his use of a firearm to stop a robbery.  He had pulled into a store’s parking space when a scruffy 61-year-old man slipped into the passenger seat and announced the car-jacking. The victim pulled his firearm and held the perp facedown on the asphalt until the police arrived, all the while laying down a line of smack talk. Our favorite: “So you woke up stupid this morning?”  When police arrived, you can see the victim wave them over and put his gun down. The police officer shakes his hand before slapping the cuffs on the suspect.

This textbook, and stylish, DGU was recorded on several cell phones; it’s the 21st Century after all. We add our commendations to this everyday hero – he’s a good son.

 

Armed robber changed his mind and wished concealed carrier a good day.

-A 49 year old concealed carrier had finished his dialysis appointment at a doctor’s office and was on his way to his car. A young man came out of the woods near the clarkston michigan doctors office carrying a revolver and demanded the concealed carrier’s wallet. at this point the concealed carrier drew his own gun and asked the 20 year old hispanic male “do you really want to do this?” The would be armed robber told his intended victim to “have a nice day”, then turned and ran back into the woods.

 

-A Pennsylvania woman was abducted and assaulted by her ex-boyfriend for over 20 hours.  The woman escaped and ran outside at about 10 in the morning.  Fortunately, neighbors heard the victim scream when she was attacked again in her backyard.  Rather than simply be a good witness, one neighbor grabbed his handgun and stopped the attack.  Neighbors moved the victim to the front yard to wait for an ambulance.  The attacker was held at gunpoint until police arrived.  The attacker was charged with Criminal Trespass, burglary, and Attempted Homicide.  The gun owner said he would do the same thing again in a heartbeat with no second thoughts and no reservations.  He has his concealed carry permit.

-A man broke into a Memphis home at two in the morning.  The family woke up when they heard breaking glass.  The homeowner grabbed his gun.  When he found the intruder standing inside his home, the homeowner shot the intruder in the head.  The intruder was taken to the hospital in critical condition.  Police have not filed any charges against the homeowner.

-We’ve all heard the joke about criminals failing the victim selection process.  Well this is one of those stories.  Two men tried his carjack a doctor in Jackson, Mississippi.  The doctor was getting ready to attend a shooting competition and was loading up his truck.  The doctor was taken by surprise.  He was ordered at gunpoint to drive to a nearby bank and withdraw some cash.  The doctor complied, but was able to grab one of his handguns.  He shot and killed one of his attackers.  The other attacker fled on foot.  The shooter had the presence of mind to neither pursue a fleeing criminal nor shoot him as he fled.

Another Triumph For California’s Legal System

What can you say to a Redding, California woman who was forced to defend herself against a likely armed sex offender, freshly paroled from a weapons charge, wearing a GPS bracelet, probably high on an illegal substance, who had just escaped from deputies holding him at gunpoint? You can only shake your head at the awesome effectiveness of the California legal system.

 

Parolee Dillon Carmelo escaped deputies by reaching into his clothing as if he was going for a gun and fleeing into the neighborhood’s backyards. The deputies informed those nearby of the dangerous felon on the loose. Against the advice of California’s elite, resident Jennifer Doolittle armed herself and went into the backyard to get her dogs inside. There, she was confronted by Carmelo, who popped over a fence and moved toward her acting as if he was reaching for a weapon.

 

Doolittle fired several times, striking Carmelo and stopping the attack. Carmelo continued to struggle until subdued by a Sheriff’s K-9. It is not known at this time if the woman will be charged. A civil suit is almost a certainty.

Several of the Polite Society’s staff can attest to California’s collapsing catch-and-release legal system. It’s why we urge every citizen to be armed, trained and aware. It’s also a big part of why California wants desperately to disarm it’s citizens.

A 77 year old homeowner was in the shower recently when he heard strange noises. He got out of the shower to see what was going on and came face to face with 2 burglars. Apparently our guud guy had a handgun close to him in the shower as he exchanged gunfire with the burglars killing one and the other was sent to the hospital, but the condition of the second bad guy wasn’t known. One boy next door became concerned and called his father. The youngster told his dad that there were police everywhere and he had locked himself in the house. Another neighbor told reporters that she had recently been a victim of a burglary and had lost $80,000 in jewelry. The neighbor said of the homeowner who defended himself  “I think he’s 100 percent correct,They went to burglarize his house. And it’s not the first time he was burglarized.”

 

Don’t Torque-Off the Old Guys (Plural/ Nonsexist) part 2

Once again, we bring you a Tale of the Old Guys. Showing that it’s important to work together in a marriage as well as in a self defense situation, a couple of retirees successfully fought off two armed attacker at their Thomaston, Georgia home. Only a month before they had endured a home-invasion where they were tied-up and robbed at gunpoint. It seems that assault only made them mad — and ready for the next attack.

 

When the wife opened the garage door in the morning, the same two suspects ran at her from the nearby woods, waiving handguns. The Old Gal drew her own gun and whistled a couple of rounds at the suspects. The Old Guy ran to the porch and added his own fire against the suddenly unenthusiastic robbers, who reversed course with all due haste.

Kashif Mohammad, 20, and Daitrelle Saffo, 21, were arrested exiting the woods. They are facing a slew of felony charges, including Armed Robbery and Kidnapping. It is certain they’ll remember one critically important lesson: Don’t Torque-Off the Old Guy — and Gal.

Since the last show, the issue of ridding North Carolina of our pistol purchase permit system has started to attract a lot of attention. The gun prohibitionists along with the NC Sheriffs Association are fighting to keep the law. Bloomberg is funding a media campaign to keep the law. I wrote a somewhat provocative post entitled, “If you support a law based on racism, are you a racist?” There is no question that the law mandating pistol permits was drafted with the intent to keep African-Americans unarmed and subservient to the white, segregationist Democrat power structure of NC. My conclusion is that supporting a law based upon such heinous intent does make you at least a little bit racist.

John – I played hooky on Friday afternoon and went to our local Wildlife Resources Commission range. I got to test out my new ultra-lightweight AR-15 and my Ruger LC9s Pro You do have more felt recoil with a very lightweight AR but it was not objectionable. Even during rapid fire, I was able to stay on target easily. I did run into some trouble with the feed with the magazines. PMags were generally fine but I had trouble getting the first round to feed with the GI-type mags. After the first round feed, then no more trouble. As for the Ruger LC9s, I ran a box of ammo through it without any failures. I still have some more to go before it has passed the reliability test for being a carry gun. As I wasn’t shooting for accuracy but reliability, I’ll have to leave how accurate it is until a later report. I will say that I love the trigger.

The Who’s Pete Townshend Won’t Get Fooled Again

Us old farts now have one more reason to like Pete Townshend, guitarist of the long-running supergroup: the Who.

 

On the eve of the Who’s 50th anniversary tour, Rolling Stone asked Townshend about the threat of Islamic radicals. The rockstar related; “I do think it’s very important that we keep our ammunition ready. I do feel there is nothing to worry about as long as we’re willing to protect ourselves. Whether it comes to our door in a Charlie Hebdo scenario or in a 9/11 scenario, we need to keep calm and to honor our own sense of values and justice and law and the way that we want to live.”

Townshend also called Huff Post’s Arianna Huffington “A dimwitted woman.”

It’s obvious that Pete Townshend Won’t Get Fooled Again.

Federal Judge Throws Out SAF Challenge to Washington’s I-594

A Federal judge has thrown out the Second Amendment Foundation’s lawsuit challenging Washington’s Bloomberg inspired Universal Registration scheme. I-594 is a poorly written law, designed to confuse the law-abiding and potentially criminalize the everyday use of firearms. There is no agreement in the law-enforcement arena on how this vague law should be enforced, if at all.

 

The George W. Bush appointed judge did quite a few legal pirouettes in declaring that the plaintiffs had no standing. The plaintiffs were denied standing as they were not being prosecuted or at immediate risk of prosecution. The fact that gun owners in Washington were intimately affected by the overbroad law was ignored. By the judge’s logic, a citizen would need to be charged with violating the law before they would have standing in court.

 

Alan Gottlieb, of the Second Amendment Foundation, expects to appeal. “It is mind boggling that a law-abiding citizen evidently must put their civil rights, not to mention their clean criminal record, at risk before a court can rule whether a law is constitutional,” Gottlieb observed. “Because the state has refused to prosecute violators does not diminish the constitutional threat of this law,” he stressed. “This is 2015, not the Dark Ages.”

 

Gottlieb and his legal team will continue to pursue justice in this case.

 

Oregon Prepares to Enact SB 941

Bloomberg’s Universal Registration mischief has surfaced in another state. Oregon’s SB 941, largely based on the anti-gun Colorado and Washington laws, has passed both legislative houses and is now on Governor Kate Brown’s desk. The signature of the hard-left governor is certain, probably only being delayed to arrange the celebratory press event.

It is expected that the Oregon bill will create the same uncertainty and confusion that Bloomberg inflicted on Colorado and Washington. The reaction is also likely to be the same, with lawsuits, protests, recalls, and a political shift toward the right.

Oklahoma May Soon Allow Trained Personnel to Carry in School

Many have noted that salt water seems to cause insanity. This certainly explains coastal Washington, Oregon, California, New Jersey and Miguel Gonzalez of Florida. (Hey, Miggy!)

 

Landlocked Oklahoma is exhibiting significant signs of sanity in passing a bill that would allow trained personnel to carry arms on school grounds.  The Oklahoma House voted in favor of legislation allowing a school district’s board of education to designate a school employee to attend an armed security guard training program or reserve peace officer program and pay for the training. The legislation has only to be signed by Governor Mary Fallin for it to become law. The governor has not indicated if she will sign the bill, but she has previously backed gun rights expansion in the state.

 

Hopefully, Sooners will soon be able to actively protect their most important treasures.

 

South Carolina May Be Poised To Enact Permitless Carry

Constitutional Carry is rapidly gaining momentum. South Carolina’s House recently passed a bill on its second reading allowing permitless carry by the margin of 90-18. The bill is likely to pass a third reading, and  then go before the state Senate where it will face challenges. Governor Nikki Haley has said that she would sign a constitutional carry bill, so she would presumably sign a partial reform such as this one.

 

This bill is not constitutional carry, as it does not allow open carry. South Carolina is one of only six states that prohibit open carry.  A powerful Republican Senate committee chair has said that open carry personally offends him. We urge all South Carolinians to tune-up this curmodgeon and immediately contract their other political representatives in support of this bill.

North Carolina’s Demanding Moms Are Worried

Bloomberg’s astroturfing Demanding Moms swept up all the hoary old platitudes when they visited the North Carolina Legislature this week. Their panties are in a wad over a bill to remove the sheriffs’ criminal background checks of pistol permit applicants. The sheriff checks are an unnecessarily expensive step as they duplicate the federal automated NICS background checks.

 

We urge all North Carolinians to immediately contract their political representatives to support HB 562. You might also ask your sheriff why he opposes it..

 

John – I’d like to expand on this a bit. The pistol permit purchase system was put into place in 1919 with a wink and a nod. It was designed to keep undesirables from obtaining handguns. In 1919 North Carolina that meant blacks, union organizers, Yankee carpetbaggers, and the like.

 

ATF accepts the pistol purchase permits as a substitute for the NICS checks. A study in 2013 by the Charlotte Observer showed that there were over 60 people in one county alone who had been issued pistol purchase permits who were now prohibited individuals. The permits are good for 5 years from date of issue and, until 2 years ago, sheriffs were not required to keep track of the people who had been issued them. The objection that some sheriffs have now to ending the permit system – which they won’t admit – is that they will lose a source of revenue separate from what is given them by county governments.

 
Designer of 3-D-Printed Gun Challenges Feds
For a variety of telling reasons, the ability to print out firearms using common 3-D printers and everyday materials has frightened the government.  With his Liberator, Cody Wilson has designed an all plastic gun that could be made in a 3-D printer. Within days of its internet release, the Obama State Department claimed a violation of the International Traffic in Arms Regulations and ordered the plans removed from the website.  Now the government has seized ownership of The Liberator. (Irony, much?)

 

This week, the Second Amendment Foundation has filed a lawsuit against the government charging the violations of  Wilson’s First, Second and Fifth Amendment Rights. The government is engaging in behavior that denies Wilson’s due process. The SAF is compelled to file the action because the bureaucracy is evidently playing games and it’s time for these agencies to behave. SAF also wants to publish the information about three-dimensional printing of firearms on its web site as educational material for its 650,000 members, supporters and general public.

 

Wilson’s goal was to invalidate the government’s “unconstitutional” hold on gun technology. Alan Gottlieb of the SAF contends: “The right to keep and bear arms includes the ability to acquire or create arms. John Lott, president of the Crime Prevention Research Center, states that “3-D printers mean an end to any gun control. The government is not going to be able to ban magazines for guns, or ban guns themselves, and the notions of background checks would be even more impossible to do. I understand why government wants to regulate this, but it is too late. Technology moves faster than government.”

Jesse Jackson blames full-auto AK-47s for Chicago Violence

 

Rev. Jesse Jackson, his Rainbow PUSH organization, and the Demanding Mommies held a demonstration outside of Chuck’s Guns in suburban Cook County, Illinois. Between the gun prohibitionists and a counter protest by members of the Illinois State Rifle Association, there were about 100 people there. Jackson blamed the violence in Chicago on full-auto AK-47s and other such full-auto weapons, saying, “There is no place in the city streets for AK47s, there’s no place for full automatic weapons.  Street gangs are more well armed than the police are.”

 

We don’t know where Jesse gets his facts but of the 125 murders year to date in Chicago, none were committed with a full-auto firearm of any sort. We won’t go into the fact that full-auto weapons have been regulated by the National Firearms Act since 1934.

Garland Texas Policeman Stops Terror Attack

This week saw terror come again to American soil. Two ISIS affiliated terrorists sought to kill hundreds of people expressing their free speech rights by drawing the Prophet Mohammad.  The attack was stopped cold, ended by a policeman with a tremendous amount of bravery and skill — and a commonly available pistol.

 

A sixty-year-old Garland, Texas traffic cop responded to the gunfire that wounded his partner. From the available reports, he advanced into their rifles, wounding one terrorist, killing the second, then shot the first one again as he reached for a backpack possibly containing explosives. Details are very sketchy at this time, but in overhead pictures it’s possible to see the trail of shell casings left as the policeman took the fight to the terrorists.

 

There are lessons aplenty in this incident. It appears now that the dead were not directly sponsored by any foreign terror organization. That is not the good news it may seem. The two were radicalized through social media, choosing to achieve ISIS’ ends on their own. ISIS infected malcontents could appear anywhere across the US in large individual numbers. With ISIS training camps a few miles from the deliberately opened southern border, better arms and training could easily be provided to enhance the skills of those sorry individuals.

ISIS boasts that they have 71 soldiers in 15 different states, with targets in 5. By chance or design, those five states are amongst the most gun restrictive. Concealed carry would be limited there, along with other defensive advantages of the gun culture. Several commentators have noted how much the Garland situation looked like an IPSC stage. Could Texas’ vibrant gun culture have contributed to the success of the gentleman? Would an anti-gun environment have hurt?  We know which way we would bet.

Garland is very much an everyman’s triumph. An aging traffic cop armed with a common Glock pistol defeated two armed and armored terrorists. He is the very definition of the heroes in our Don’t Torque-Off the Old Person series. The skills and equipment to make a difference are well within the grasp of the common man and woman. All of us will need to take them in hand. We need to get armed, frequently train, practice, carry everywhere, and stay alert. There is no telling where we will be when the balloon goes up the next time.

 

Armed Citizen Saves Police Officer
An armed citizen acted to save a police officer being beaten by a dangerous criminal. During a foot chase of a home robbery suspect, the policeman had his baton taken and used against him. The officer was hit on the head as many as twelve times, causing a large gash. Into that desperate situation stepped a citizen, who shouted at the thief to stop. The citizen backed up his demand with a drawn gun.

 

The suspect and his confederate were placed under arrest.  The downed officer was taken to the local hospital. He was later released and is expected to make a full recovery.

 

We certainly commend the civic minded civilian hero for his actions and bravery.

 

Home Invader Shot By Hunter

In a suburb of Boulder, Colorado, a home-invader ignored a really big clue, and paid for his inattention. Roberto Zamora, 19, was stalking the well-to-do neighborhood that night. Several homeowners had already called 911 about his attempts to break into their homes. The house he finally choose for his adventure was odd, as it had a trophy visible to all: a magnificent Elk head mounted high on the wall. Most would have taken this as a clue that the house had a firearm along with someone who knew how to use it. Many robbers would have shied off. Not this criminal.

 

Zamora made his intentions clear by trying to break-in a rear window. The homeowner armed himself while his wife added to the 911 calls to the cops. Zamora reversed his attack and burst through the glass front door. The victim was knocked to the ground, there was a struggle, a shot, and Zamora fell dead with a single bullet wound to the chest.

The homeowner and his wife spoke to 911 again. The owner calmly told the dispatcher he had shot the suspect. “Everything’s fine. You just need to get the cops here.” The victim held onto his gun until told to put it down by the 911 dispatcher. When the cops finally arrived, the owner told them he shot because he feared for his life. The Boulder District Attorney’s Office will determine if the shooting falls under Colorado’s Castle Doctrine, dismissively referred to as the “Make My Day” law by much of the local media.

 

Even in this upscale neighborhood, the cops arrived a lifetime too late. When they did finally arrive, they were simply historians, armed for their own protection. The homeowner’s decision to arm himself possibly — probably — saved him and his wife from serious injury or death at the hands of a seemingly unstable intruder.

 

Police Shoot Victim of Home Invasion

The Initial armed citizen/ police contact is fraught with danger. Especially when shots have been fired and the adrenalin is screaming in everybody’s viens.  A Hollywood, South Carolina homeowner was shot in the neck by responding deputies when he failed to put down the firearm in his hands.

Deputies were called to the home by reports of an ongoing armed home invasion. They observed two cyclist pedalling away from the scene, but naturally focused on the man at the backdoor with a gun. In the first confusing seconds, the man was ordered to drop the gun, and then shot by a deputy when he did not comply. In the ambulance, the homeowner said he had been in a gunfight with two men who escaped on bicycles. He had been on the phone with the 911 operator for about nine minutes, but dropped the line to defend himself. Another 911 call from a woman reported shots fired.

One of the cyclists has been caught and charged with first-degree burglary and attempted murder. The homeowner has been operated on, but his condition is not known at this time.

What is known, that in the chaotic situation that is a self-defense shooting, it’s important to realize that the cops cannot know what is going on or who the players actually are. It is absolutely essential that the victim not appear threatening. The police orders are to be followed immediately. Plan accordingly.

 

Armed citizen not going to be charged after review of a January shooting in a Waffle House.

 

Back in January we covered a shooting in a Waffle house restaurant. At the time it wasn’t certain whether the man who defended himself would be charged. After a thorough review the Florida state’s attorney’s office announced this week that they will not charge Jerharrd Williams in the case.  There is video of the shooting that was released, and it looks as though Mr Williams was going “by the book after the shooting. Even to the point of after the shooting and the danger had passed he laid down the gun and called police.

 

WWII Vet Tunes-Up a Punk – DTOOP  (This Goes Last in the DGUs)

Finally, in another of our continuing “Don’t Torque-Off the Old Guy or Gal” series, we have the heartwarming story of an older gentleman doing his part to help educate the youth of America.

 

A 95-year-old Manchester, New Hampshire resident saw a young man eyeing him in the local pharmacy. The observant old guy wasn’t too shocked when the thug tried to rob him in the neighboring credit union parking lot. The thief made repeated grabs for the wallet kept in a zippered pocket. That wallet was precious to victim, it contained a credit card, license and his grandchildren’s pictures; to him, worth fighting for.

Did we mention the Old Guy was a World War II veteran, a soldier, and had fought on Bloody Okinawa?

 

“He wasn’t very aggressive — but I was.” Arthur Kemberis remembers. “I probably hurt him a little bit.” Indeed. The thug got tuned-up several times with Arthur’s metal walking cane; taking 3 or 4 thumps to the shoulder. A passerby finally intervened, saving the feckless thief from additional embarrassment. He’s still on the run, but the police have an excellent surveillance photo of the punk.

After all that he’s endured, Old Guy Arthur isn’t taking any more chances; “My .357 Magnum will be with me all the time.” A note to thieves thinking about preying on the Greatest Generation: It’s dangerous to Torque-Off the Old Guy.

Don’t take this wrong, I listen to your show as I drift off to sleep because I almost feel I know your people and you are just comforting , I also listen at least once at work to make sure I catch the whole podcast in full, to make sure I hear everything said, Thank you ALL

 

Rob wanted us to mention one of his slow facts blog posts he made this week. He wrote about the 7th Circuit decision that we covered last week and extrapolated that the ruling could FORCE people to buy guns as the majority opinion in the Pew Research poll showed that people felt safer in the home when there was a gun there. They used opinion in the decision, but used the minority opinion.  Therefore since the wrong opinion was used it could be turned and force those that do not believe in guns to possess them. That is our VERY short synopsis of his column, go read it for yourself at slow facts dot wordpress dot com

Congressman Mike Rogers of Alabama has offered an excellent amendment to the act which funds the Dept of Defense. He is proposing that the approximately 92,000 1911s that the government still has in storage and which costs them about $200,000 annually to store, be transferred to the Civilian Marksmanship Program for sale. I think this proposal is worthy of our listeners support. Of course, you have to meet certain marksmanship standards and be a member of a CMP affiliated club to be able to purchase anything from the CMP.

John – I had a hearing exam on Monday. I have tinnitis or ring in the ears that is due to exposure to loud noise when I was younger. I did something stupid but that was common back then – I shot without hearing protection. Now I have both ringing in the ears and high frequency drop out. I’m sure there will come a time when I need hearing aids. In other firearm related personal news, I finally weighed the lightweight AR I built. Without optics and a backup rear sight, it comes in at 5 lb, 12 oz. With those attached, I’m still only at 6 lbs 2.7 oz. I just need to find time to try it at the range! I’m also gathering parts now to make a retro style AR. This AR building is addictive!

 

Rob- I was in Los Angeles earlier this week, so I dropped in and heard Alan Korwin speak.  Alan owns and runs Bloomfield press.  He wrote many books and has a great blog called page nine.  Doris started the group, Children of Jewish Holocaust Survivors and the group Jews can shoot.  Alan spoke about what to do after you’ve defended yourself.  That was interesting, and the audience was interesting.  Also, Doris gave me a great hat.  I shot IDPA and mentored another group of doctors for their first shots.  Someone brought a FN 5.7 and they let me shoot it.  It is loud, but doesn’t have much recoil.

 

Paul – RANT

 

I need to go off a bit here. I had a friend and dedicated fighter for our rights post a video to my wall asking if he knew who the person was that was in the video that he posted. The video was of a single person doing an “open carry” demonstration of the sidewalk in front of the federal courthouse in Sioux Falls. The video came in 2 parts and never showed the face of the person who recorded the video. I did not recognize the voice of the person and so I replied and said that I didn’t although the kid was a bit of a ummm jerk. I said worse on Facebook, but I keep the show very family friendly.

 

It turns out that I do know the person. They replied on Facebook and let’s just say that the butthurt was strong in that one.

 

Let me take just a minute here and let me let you know how I feel about open carry, although for many of you this may be a bit of going over well trodden ground I think that it is important.  Actually let me read a post I made to facebook and I will continue on after that.

 

I support your Second Amendment rights, I believe that you have the right to posses and peacefully use any weapon that you can afford. This includes everything from the 10-22 to the F-22. I also support your 1st Amendment rights to say whatever you feel, to worship whatever God you believe in and associate with whomever you chose to.

My hobby and part time side business ( Polite Society Podcast) relies and advocates heavily on both of those rights guarantees the Constitution offers.

However if you are one of those that are being a jerk about your 1st and 2nd Amendment rights, doing some of the myriad of things that hurt us. Things such as open carrying in a manner that causes public alarm; carrying a rifle in a place of business (some leniency given to those in Texas and other states where open carry of handguns isn’t allowed);, or making videos while egging police on just to hopefully make a “YouTube celebrity” out of yourself while using a fake name you are hurting us badly.

I use my real name both here on Facebook and on my show. I don’t hide behind some made up moniker. If you cannot put your real name to what you are doing, if you would not be proud to have your social media posts displayed to your parents, to your preacher, to your doctor or to your grandchildren (whether or not they agree with you) then PLEASE for the love of God DON’T post them!

A lot of people have “friended” me on Facebook because of the show. Thank you to all of you who have, even if I haven’t met you personally or interacted with you often. If you think that I might be referring to you in this post then it’s possible that I am. I beg of you to please look at what you are doing and think to yourself “Is what I am doing going to alarm someone who may be neutral to our fight and make them think that the other side may be right?” (end of FB post)

 

I support your right to open carry. I open carry my handgun while at home. I have participated in organized open carry walks. If done correctly open carry can be a powerful tool to help us. If done incorrectly it can be a tool for Bloomberg’s demanding mommies, CSGV (coalition to stop gun violence, and the Law Center to Prevent Gun Violence? )and others to point and say “look at the loonies that they have! Even worse, it can make the average citizen who votes, and is neutral to our side turn away from us.

 

While you are open carrying EVERYTHING that you do is magnified. If you are polite and respectful, if you are dressed well and well groomed, and if you inspire confidence in those around you that helps us.

 

If however you are a jerk to those that you interact with, if you are untidy or unkempt, or most importantly if you instil fear you are doing more damage than demanding mommies or the brady bunch ever has.

 

Again I ask, if your actions could be seen to intimidate PLEASE think twice about doing them.

Paul- Leading the news we have conflicting statements from Baltimore Mayor Stephanie Rawlings-Blake.

 

The mayor said the following in a press conference when things started to get ugly in her city. (Audio clip #1)

 

After getting some criticism she then decided that she never actually said that at all, and that we were just twisting her words. (audio clip #2)

 

-Paul- this is classic Progressivism. She is going on as if nothing ever happened. Making it up as she goes along. I would suggest Mayor Rawlings-Blake that you mark the block that your personal residence is on as a place set aside as room to destroy That sounds like a better balance to me than places where hard working people are trying to make a living.

 

We are going to take a quick side trip here. while perusing Facebook one evening I came across a video that puts the Police violence thing in perspective. Here is some audio. (Audio clip #3)

 

-Paul-  A couple of things about this caught my attention. First that they looked not just at deaths but at all charges of excessive force by officers, Second that they broke things down by contact.

I am one that doesn’t respond well to percentages and so did some of my own math on the figures they presented. If 2000 people are contacted in one form or another by police 1 person will file an excessive force complaint. Of all the complaints only 8 percent had merit, so if police were to contact 25000 people on average only 1 complaint of excessive force would have any merit. That is a DAMN good track record.

 

Rob- there are 20 gang murders for every gun related homicide that involves a policeman.  The vast majority of the police involved shootings are ruled to be justified by self-defense.  That puts violence into perspective.

 

Rob-  Taxes and regulations in Baltimore drove businesses out of the city.  Unemployment jumped.  Addiction rose to record levels.  Fatherlessness rose as young men could not find jobs and start families.  People who still had jobs left Baltimore because of increasing crime.  The price and quality of housing crashed, just as it has in Detroit.  While all of this was happening, the city, state and federal governments poured extraordinary amounts of money into housing projects and schools.  Now a black drug addict whose mother was a drug addict was injured by a mostly black police force controlled by black politicians.  People rioted and burned stores owned by koreans. Government policies killed Baltimore.. and now they are looking for someone to blame.  The politicians will blame racism.. and propose the police wear body cameras.

 

Let’s also ask every elected official to wear body cameras too.. with another camera placed in their office.  That is leading by example.  Anything else is politics as usual.

Waiting periods

There are several myths about gun control.  The first is that waiting periods save lives.  A waiting period is the delay between purchasing a firearm and taking possession of it,.  It has been called a “cooling off” period that could stop impulsive actions.  That doesn’t make sense if the buyer already owns a gun.  That is what a Federal Judge said in California, but California politicians appealed the judge’s decision anyway.

 

One Wisconsin lawmaker finally had the courage to state the obvious about waiting periods.  Wisconsin Senator Van Wanggaard served as a traffic investigator and graduated from the Racine police academy.  He said waiting periods don’t work.  Studies backed him up.  Waiting periods don’t change the overall suicide rate or homicide rate.  Some studies found a decrease in violence while other studies found an increase in violence associated with waiting periods.  The results hinge on a critical distinction, are we disarming a violent criminal.  or a potential victim.  The proposed change in Wisconsin law eliminating waiting periods goes to the Wisconsin Assembly and then, hopefully, to Governor Scott Walker for his signature.

 

Background checks fail again

Background checks are another gun-control myth.  Making honest gun owners re-register their firearms is somehow going to stop criminals from getting a gun.  Would it stop car theft if we had to go to the department of motor vehicles so I could drive your car?  Mandatory background checks are being proposed in the Oregon legislature.  Background checks are already mandatory in Washington state so we can see if they are effective.

 

Despite their gun prohibitions, the impossible happened this week in Thurston, Washington.  A high school student brought a gun to school and started shooting.  He was tackled by a teacher, and no one was injured.

The student was sixteen years old, so couldn’t own a gun.

The student was on probation, so couldn’t touch a gun.

Thank goodness Washington State has mandatory background checks so the student couldn’t take someone elses gun.. but he did.  Detectives say the student wanted to commit suicide by cop.

It looks like gun prohibition doesn’t work, but that won’t stop bigoted anti-rights politicians.

 

– In New York state, any pretext is good enough for another firearms restriction.   Now an Amish man is suing New York because of state gun laws.  New York requires a background check whenever guns change hands.  The background check requires a photo identification card.  The Amish don’t have photo identification, so now they can’t buy or sell guns in New York.  Tell me again who new york laws are protecting us from?? from the Amish?

 

– In Vermont, Bloomberg’s anti gun groups were pushing for mandatory background checks each time you took possession of a gun.  They spent almost 138 thousand dollars promoting the legislation.  Pro-rights groups spent only 20 cents for every bloomberg dollar.. and the pro-rights groups won.  There are no mandatory background checks in Vermont.  That took work from vermont gun owners.  Well done!

Rob- 7th Circuit Upholds Assault Weapon Ban

On Monday, the Seventh Circuit Court of Appeals upheld an Illinois city’s ban on so called assault weapons and high capacity magazines. This stunning ruling specifically dismisses the Constitution, the Bill of Rights and recent case law and instead relies upon the presumed feelings of the public. The majority of the three judge panel held that “if a ban on semi‐automatic guns and large‐capacity magazines reduces the perceived risk from a mass shooting, and makes the public feel safer as a result, that’s a substantial benefit.” In other words, if some the public can be convinced that the ban could make them safer, it’s OK; facts be damned. It’s hard to imagine a more incoherent legal justification.

In his dissenting opinion, the third panel judge wrote that the ruling is “at odds with the central holdings of Heller and McDonald: that the Second Amendment protects a personal right to keep arms for lawful purposes, most notably for self-defense within the home.”

 

This issue will almost certainly go before the Supreme Court at some time. For the citizens of Highland Park, Illinois, and of this nation, we can only hope it’s soon.

Gary- Two  judges side with the politicians to give them more power.  Judges say all it takes is a good sounding headline to justify disarming the public.  The uninformed public will “feel safer” after they read the political spin.

 

Anti-Gun Researcher Refuses to Debate Dr. John Lott

The research director for Bloomberg’s astroturfing Everytown for Gun Safety, recently refused to debate gun law researcher John Lott. While we can’t blame Bloomberg’s mouthpiece for being chicken, after all, Dr. Lott is a force of nature with facts and statistics, his refusal to talk face-to-face is telling: antis just don’t have the facts on their side.

 

C-SPAN invited both gentlemen to discussed a recent Pew Research Center study that found more Americans now think protecting gun rights is more important than controlling gun ownership. Everytown’s Mr. Alcorn declined  to appear at the same time as  Dr. Lott, resorting to personal attacks to explain his refusal. Alcorn was allowed to appear after Dr. Lott, completely eliminating every possibility of give and take.

 

Lott said he was disappointed someone from Everytown wasn’t willing to discuss the Pew Center’s findings. The Pew study showed Americans who had once worried about crime and favored strict gun control, now wanted no more laws or even to loosen gun restrictions. “In short, we are at a moment when most Americans believe crime rates are rising and when most believe gun ownership — not gun control — makes people safer,” wrote Pew’s Andrew Kohut. “Every country in the world that’s banned guns has seen an increase in murder rates,” said Dr. Lott, president of the Crime Prevention Research Center and the author of “More Guns, Less Crime: Understanding Crime and Gun Control Laws.” Lott said that with more stories about defensive gun use being distributed in the new media, people are catching up to research on the issue. He reiterated that predictions of gun control advocates have never come to pass.

 

Spreading the word of lawful defensive gun uses is a big part of what we do here at the Polite Society Podcast.  It seems we are helping to make a difference.

 

Michael Moore Relies on the 2nd Amendment?

Big screen fabulist, virulent anti-gunner, noted hypocrite and left-wing barking moonbat Michael Moore may be supporting Michelle Obama’s claim that chronic obesity can lead to early-onset senility.

 

Very early Thursday morning, the big chunk took to Twitter to demand the immediate release of every African-American in prison for drug or nonviolent offenses. For his next belly-flop into insanity, Moore imperiously demanded that all police instantly disarm. Oddly enough, he justified that stupidity by noting; “We have a 1/4 billion 2nd amendment guns in our homes 4 protection.” Although true, that’s very odd reasoning from someone who wants the public’s firearms seized at gunpoint by the police. However, apparently even that blind pig can find an acorn of 2nd Amendment truth once in a while.

XX- The news media won’t call it a defensive gun use, but we saw it in Ferguson, Missouri.  We saw it again this week in Baltimore, Maryland as well.  We saw stores smashed, looted and burned during riots.  We also saw store owners protect their businesses by standing there with a firearm.. and with no shots fired.

A Baltimore Sun reporter left his Crips gang member protection and was maced by a looter demanding his cell phone. The attack was stopped when the reporter ran to a store owner with a shotgun.  More guns, less crime.

 

Tennessee Homeowner Shoots Robber

An East Knox County, Tennessee homeowner was startled awake early Wednesday morning by the sound of breaking glass. From his bedroom, the homeowner saw an intruder climbing through a living room window. The owner fired once, and the robber fell backwards. Police found the perpetrator dead on the porch.

The late James Melvin Vinson had accumulated an extensive criminal record in his 40 years, including multiple theft and drug charges. At the time of his final crime, he had two outstanding warrants; for theft and for violating the parole that put him back on the street once again. Mr Vinson was the very definition of an outlaw; largely unrestrained by the legal system.

 

The homeowner is not expected to face charges. Under Tennessee’s Stand Your Ground law the man was within his rights when he used a gun to defend his home and his family.

 

Misuse of a Citizen’s Firearm

With rights come responsibility. A North Carolina man failed to use his rights responsibly in a shoplifting incident at a store. A man ran from the Beasley Power Equipment store with a pilfered a chainsaw. The thief jumped into a vehicle with two others while being pursued by the store owner’s son. They sped off after the son brandished the pistol and ordered them to stop. Two shots were fired at the departing vehicle and the driver was hit in the head. The store employee reported those facts to a 911 operator, along with an admission that he had seen no firearm. Their conversation, of course, was being recorded.

 

Our DGUs usually show the proper lifesaving use of firearms. For educational purposes, we do comment when their use could have been better. As such, we must point out when someone is legally and morally wrong when employing a weapon.

 

Most states hold that firearms can only be used in the defense of one’s self and others. A fleeing thief is simply not a danger to the CCW holder. Only a few states allow deadly force in defense of property; North Carolina is probably not one of them. In any case, a chainsaw cannot be equated with a human life. The pistol owner simply should not have fired in that situation. He should have been a good witness and reported the license plate numbers to the police.

The driver has been hospitalized in critical condition, his two confederates charged with felony theft. At this time, the shooter is under investigation by the district attorney. The shooter and his business will almost certainly face civil lawsuits. Self-defense classes like Massad Ayoob’s MAG 20 would have would have certainly made this mistake less likely.

 

Homeowner Shoots Two in Second Home Invasion in a Week

In the warped world of the criminal, they can come to feel they own something merely by desiring it. This can lead to repeated, seemingly improbable, attempts to possess the thing. This may be what happened to a California homeowner this week.

 

In the normally peaceful Pittsburg, California neighborhood, a homeowner shot and killed two home invaders Friday evening. This was the second time in a week that their home had been a burglarized. In the earlier incident, four people had been arrested. At this time, it is not known if the two deceased were somehow related to the earlier incident.

 

A neighbor wondered if there was a the connection between the two home invasions. “There’s no way of knowing,” he said. “They broke in and ransacked the place, and maybe they saw something they liked and came back.”  “If I was in (the homeowners) position, I would have done the same thing,” he said.

Salt Lake City Warning Shot

A his and her burglary team broke into a pricy Salt Lake City area home Monday morning. Alerted by the family’s dog, a neighbor called 911 and the homeowner grabbed a gun. At one point, the homeowner fired a warning shot, chasing the duo out of the house – and straight into the arms of the arriving police. Authorities report that the suspects have previous criminal histories.

 

Warning shots are rarely a good idea. The self-defense use of a firearm is usually limited to life or death situations. If the victim has time for a warning shot, almost by definition the situation cannot be that critical. That bullet has to go somewhere, perhaps threatening someone in the home or some distance away. And the victim has thrown away a significant portion of their life-saving device’s resources.

 

Quality formal training may have kept the homeowner from making this possible error. That being said, we commend the homeowner, the neighbor and police for the happy resolution to this home invasion.

 

Store manager shoots would-be robber in East Houston

The manager of an East Houston Cash-n-Carry was assaulted in the front door of his store Thursday morning. A robber put a gun to his back and demanded his cash. It apparently wasn’t the manager’s first rodeo, as underneath the package in his arm – he held a legally concealed handgun.

 

In that extreme situation, the manager used his gun and put two or three shots into the chest of the armed robber. The robber died at the hospital. An accomplice may have fled the scene in a getaway vehicle.

 

The robber paid the ultimate price for nothing, as the manager’s bag didn’t contain the hoped-for cash, instead only toiletries. To the good, the manager was able to stop the theft of his own life through his foresight and preparedness.

 

Utah CCW Stops Carjacking

 

A Utah CCW holder stopped a carjacking at a Macy’s in Orem, Utah on Saturday and ended a crime spree. The unidentified CCW holder, a 31 y.o. male,  had been shopping and came out into the parking lot to see a woman screaming as she was being pulled out of her Mercedes. The carjacker had stolen a truck earlier and was “trading cars”. The CCW holder ordered the carjacker out of the car. The carjacker then lunged at the man and tried to take his firearm upon which he was shot and killed. Police are treating this as a legitimate use of deadly force and are not charging the CCW holder. The carjacker, whose name is being withheld pending an autopsy, was wanted on several felony warrants. Police are searching for two other accomplices who fled.

 

Houston CCW Stops Carjacking

Wednesday evening a man was sitting in his vehicle in downtown Houston when two men asked for a ride. The motorist naturally refused and the two men left, but they came back. At gunpoint, the driver was ordered to kneel behind the car. When both men got in, the victim drew his legally possessed CCW and fired at the driver. The 30 year old carjacker died a short distance away, his accomplice escaped on foot.

 

The case will be referred to the grand jury to determine what, if any, charges will be filed.

 

Man Shoots Attacker With Attacker’s Gun

And lastly, a hapless New Orleans thief was shot with his own gun after his armed robbery attempt went dramatically sideways. The intended victim was having none of the assault, won the struggle for the gun, and immediately employed it in self-defense.

Good on the victim for turning the tables on the feckless thief. However, it’s usually best if you bring your own concealed weapon, rather than relying on the perpetrator to supply one for you.

Great show. I was surprised to hear that more firearm genre radio programs could not be recalled, so allowe me. There is the “Lock Stock and Daria” out of Rhode Island (local), “On Target” broadcasting out of Illinois (local), Georgia Carry.org out of Atlanta (Local), now these are just off the top of my head. But you all are correct Gun Talk was the first nationally (key word) syndicated radio show and it was decades before they were challenged. As with National Media’s bias towards gun self defense stories, what they are not realizing or unwilling to realize is that local media has to report such events in their news cycle. What happens is average Joe one night watches the local channel 5 and learns of a single mother with two kids suffer a home invasion possibly ending with death, the following week average Joe watches a story of an 85 year pistol packing Ethel putting six in a bad guy saving her sick husband’s life. Now average Joe starts to think, and begins to talk to friends and so on and so on, the whole time national media sit in their New York bubble believing they are controlling the message, and fortunately with new gun friendly media that is no longer a true statement.

Keep pumping them out, I’ll keep listening.
