Earlier this month, the U.S. Drug Enforcement Administration (DEA) indicted seven people and seized 11,000 pounds of marijuana destined for the midwest states. It also confiscated 30 kilograms of cocaine that was bound for several small towns in Alberta. New office holders were sworn in after the recall of two Colorado state senators.  They said they’ll uphold the constitution AND listen to their constituents.
Colorado is restarting the recall effort on Senator Evie Hudak.  During the debate on Colorado gun laws, Hudak told a rape victim, “And yet because this individual was so large, was able to overcome you even with your skills, chances are that if you had had a gun, he would have been able to get that from you and possibly use it against you.”

Hi Paul,
I always clear the chamber of firearms before relinquishing control with one exception. Handguns that I keep in handgun safes throughout my house are in condition 2. I think the benefit outweighs the risk. The safes are anchored so they cant be jostled around and they are always locked.  I can not see how there would ever be a accidental discharge except fire and hopefully the safe will contain that discharge. Thanks for a great show and would like to hear if you guys think there is a  flaw in my thinking.

Paul dry practices in a truck cab.

Rob took some dry practice instruction for an AR and was reading the course syllabus for a four day rifle course.  Couldn’t go to the course because he has a cold.
Frank joined a new range in his neighborhood and took his wife out on a shooting date.  Shooters, NJ.

News:
Sticks- Chino CA, PD needs to learn the 4 basic rules of gun safety.  A police motorcycle officer was giving a drug safety lecture at an elementary school.  Three elementary students were taken for medical treatment after one of their classmates snuck behind the officer and pulled the trigger on his AR while it was racked on the motorcycle.   Impact fragments cut some students.
Rob- I don’t fault the patrolman.  I fault the training officer
Paul- I want the gun unloaded unless it is physically controlled by the officer.

Paul- Interpol Chief is starting to see the light on armed citizens stopping terrorists.
“Societies have to think about how they’re going to approach the problem,” Noble said. “One is to say we want an armed citizenry; you can see the reason for that. Another is to say the enclaves are so secure that in order to get into the soft target you’re going to have to pass through extraordinary security.”
Does TSA make you feel secure?  Do you think they are really going to x-ray every rack of clothes that enters a department store and scan every cart of supplies headed to the food court of your local mall?  Armed citizens are the solution.

Rob- SAF files an unusual legal petition:  The Second Amendment Foundation filed a petition in the case of Palmer v. District of Columbia.  The case was originally filed in 2009 and is still awaiting a ruling by the federal district court.  Original suit brought by attorney Alan Gura.

Frank- Grass Roots North Carolina threatens lawsuit   North Carolina’s most vocal gun rights group is threatening to sue Raleigh if it doesn’t update signs in city parks that tell visitors firearms aren’t allowed.

Frank- Not that they are going to go anywhere, but there are two new pro-gun bills in the House of Representatives.

Rep. Steve Stockman from Texas introduced:
HR 35 which would repeal the gun ban that keeps teachers and school administrators defenseless.  The bill would thus protect heroes like Assistant Principal Joel Myrick who have actually used a gun to stop a school shooter.
HR 3199 would repeal the ban that keeps servicemen defenseless on military bases.

Rob wrote an article about good men (and women) with guns.
Rob- We forget that good men and women prevent mass murder and really do save many lives.  I forgot how often this happens, so I did some research that was published by JPFO.

Frank- After a years investigation, Mark Witaschek was arrested and charged for having illegal ammunition in Washington DC.  He had an antique black powder firearm that doesn’t have to be registered.  The way the law is written, you can’t have the lead balls for the antique gun because the lead balls are considered ammunition components.  He was arrested for having ammunition for a gun that was not registered, in fact for a gun you can not register because it is an antique.

He had one shotgun shell that was a dud and one rifle cartridge.  For that, the DC police executed a no-knock warrant with a battering ram, tossed his house and caused ten thousand dollars in damage.  This is the sort of crap you’d expect from a redneck southern sheriff in the 1950s.  This is now mainstream and simply politics by other means.

Rob: Guns and Ammo ranked the states from worst to best for concealed carry.
Arizona is the best and Washington DC is the worst.
North Dakota is number9, Arkansas is number 26.  Nebraska 35, NJ 48, CA 50.
Sorry, Toby.  NEBRASKA not South Dakota.

Paul: Concealed carrier may have stopped mass shooting in Arizona!  What we know is that a 27-year-old man got at an argument at a party in Glendale, AZ and was asked to leave. He returned a short time later with a rifle, fired several shots in the air to terrify party-goers, and then leveled the muzzle at the party.  That is when a 39-year-old partygoer pulled his handgun and shot the 27 year old holding the rifle.  The shooter did not try to leave and waited for the police to arrive.

Sunnyvale is about to get bitch-slapped if this new law passes.  Sunnyvale voters on Nov. 5 will decide on Measure C, a wide-ranging gun control ordinance that cracks down on gun possession and ammunition sales. If it passes, Sunnyvale gun owners would be required to report firearm theft to the police within 48 hours, lock up their guns at home and get rid of magazines that hold more than 10 rounds. In addition, gun dealers would have to keep logs of ammunition sales.

This is forcing an anti-gun culture into law.  Can you say “Lawsuit!”

Answer- Use the one with which you’re most familiar.  I think both are tube feed, so other rifles might have a competitive advantage, but this isn’t a competition.  You will learn the essential fundamentals of rifle marksmanship no matter which firearm you bring.. and some awesome history.  Bring the gun you love.

Paul,I just listened to Episode 172, in which you mentioned not taking hollow-points into New Jersey. FYI, hollow-points are not illegal by themselves. NJ treats hollow-points like a hate crime. It is not illegal to hate someone for any ridiculous reason. It is just “extra illegal” to cause them harm because of this hate. In the same way, it is “extra illegal” to commit a crime in NJ while in possession of hollow-points. My (Utah) carry instructor semi jokingly said that he uses hollow-points for self defense for the additional reason of charging the bad guy for possession of hollow-points after being shot while committing a crime.Mike in NJ

I bought a box of tin 22lr bullets in a plastic box. A quick search for led free 22lr ammo shows several options. But also mentions long waits.

Question, I guess really for Sticks.
Appleseed sounds great. Located some within a couple of hours. Problem, the gun.
The description sounds like a commercial for the 10/22. Magazine changes required? Kind of hard to change out a tubular mag in the time change, if you understand what I’m getting at.
I have 2 .22s, one I gave my father a long time ago, a Win 290 autoloader, and the one I want to use, a Marlin 39. Have nothing against getting a 10/22 except the money it would cost and quite frankly the lack of fun factor. Much prefer working the lever than just pulling a trigger. Guess it is the influence of growing up watching the likes of “The Rifleman” and “Wanted Dead or Alive”
Is it possible to do one of these courses with a tubular magazine? Truthfully, with as much history involved one would think that more traditional guns would be feasible. While I’m not as fast as Chuck I’m not that slow, much practiced at it. 10 cans at 20 yards in 20 to 30 seconds not that hard.
FWIW, also hate scopes on a lever gun. Do have a nice aperture sight on it.

I posted an article about Illinois corruption where a naive federal judge thought he could force the Illinois legislature to allow concealed carry. Silly Judge. What happened next? The Chicago City Council required that all stores with a liquor license post “no gun” signs. Think about this. ANY business that the city controls or licenses can be made to prohibit firearms. How long until state inspectors do the same thing? Illinois gun owners continue to need our support.

NSSF Modern Sporting Rifle study
The newly released update of the report—NSSF Modern Sporting Rifle Comprehensive Consumer Report 2013—shows these characteristics remain true, with much of the data falling within the range of the earlier report. Nearly 22,000 owners of AR- and AK-platform modern sporting rifles participated in the survey, which was commissioned by NSSF and conducted by Sports Marketing Surveys. Among the findings were that most modern sporting rifles were purchased from an independent retail store, with the average cost $1,058, which is $25 less than the average from the 2010 study. The preferred calibers were not surprising—.223/5.56mm for the AR platform and the usual 7.62mm x 39mm for AK-platform rifles. The new report shows 35 percent of MSR owners had some military or law enforcement background—a figure lower than the 44 percent in the 2010 report.
“The owner base for modern sporting rifles has expanded,” said Jim Curcuruto, NSSF’s director of industry research and analysis. “MSRs have been among the most popular selling firearms in recent years. While the rifle remains popular with those who have military or law enforcement experience, ownership has expanded to other gun owners. Given the popularity and versatility of MSRs, I don’t think that will come as a surprise to anyone.” Additional findings in the report include:
Of those who own only one MSR, 49 percent said they purchased their first in 2012 or 2013, with 82 percent of recent purchases AR-platform rifles.
The amount owners spent on accessorizing their ARs rose from an average of $211 to $381.
Those who own multiple MSRs are more active shooters, with 92 percent target shooting, almost 50 percent of them hunting and 19 percent using them in competition.
Those who own 4 or more MSRs are more likely to own an AK-platform MSR.
Over a third of MSR owners gained interest in the rifle through a friend.

Topic 3- Anti-Gun bills SIGNED INTO LAW law by California Governor Jerry Brown

Requires a licensed psychotherapist whose patient makes a serious threat of violence against a reasonably identifiable victim or victims to report that threat to local police within one day; police must then notify the state Justice Department within a day of receiving the report.  (Imagine the huge open door of lawsuits with he said vs she said claims.  Good for the California trail attorneys no doubt.)
Bans conversion kits that allow people to turn regular magazines into high-capacity magazines.  (No one knows what this means, but they passed it and signed it.  Police are exempt of course.)
Require long gun purchasers to earn a California Firearms Safety Certificate like those already required of handgun owners.
Expands the crime of “criminal storage” to include keeping a loaded firearm within premises where a prohibited person is likely to gain access and actually accesses and causes injury.  (The prosecutor and judge will decide what is likely and reasonable.  Can you say Show Trial?)
Makes it a crime to leave a loaded firearm somewhere a child is likely to be able to get it without permission.  (The prosecutor and judge will decide what is likely and reasonable.  Can you say Show Trial and law suit?)
Tightens gun safety laws on safe storage to include households where someone is prohibited from owning a gun; also allows additional time for Department of Justice background checks.  (Did someone in your house have pain meds prescribed after surgery?  Were they prescribed a sleeping aid after the death of a loved one?  Welcome to the People’s Republik of Kalifornai.)
Allows someone who’s temporarily prohibited from owning or possessing a firearm to transfer firearms in his or her possession or ownership to a licensed firearms dealer for storage.
Provides that only an individual person, not an organization, may be issued a permit to possess an assault weapon, .50 BMG rifle or machine gun.  (Anti NFA trust legislation.  Kind of makes it hard for my defense contractor employer, though)
Bans use of lead ammunition in hunting by mid-2019.  (Everything is covered from the 22 rifle used to hunt skunks on the farm to the .177 pellet rifle used to hunt rats and crows.  It is not clear if carrying the ammunition is a crime, shooting it is a crime, or killing the animal is a crime.  Each may be illegal under the  description of “hunting”.)
My cowardly sheriff will certainly enforce these laws.

Anti-Gun bills VETOED by Governor Brown
Would have required gun owners to report a gun theft or loss to police within seven days of knowing about it.
Would have added all semi-automatic rifles with detachable magazines to the state’s list of banned assault weapons.
Would have essentially banned gun shows at the Cow Palace by requiring they be approved by San Francisco and San Mateo supervisors.
Would have updated the definition of an illegal shotgun to include a shotgun with a revolving cylinder and a rifled bore.
Would have expanded list of convicts who can’t legally own guns to include those with multiple drug or alcohol crimes, street gang members and others.
You may only buy “California approved handguns” (except for police) Would have tightened exemptions to the law prohibiting purchase of handguns that haven’t been tested and deemed safe by the state.
Would have given Oakland an exemption from state pre-emption so it can pass its own stricter gun registration or licensing statutes.

I loved the last episode, just like all the rest, with Brian Aitken.  During the interview the law regarding hollow points was brought up and that Brian would be breaking one law or another, no matter what he did with the ammo.  I was thinking about that this morning and it occurred to me, we have the Constitutional right to keep and bear arms, but stores need permission to sell us those arms.  In some instances that permission is only given on a case by case, gun by gun, basis.  Is the government trying to make us buy guns from places other than stores, where there would be no background check, with the crazy laws?

Wouldn’t it be nice if laws were simple and “common sense”?  And didn’t need whole libraries to hold all the books!
Keep up the wonderful show.  We’re glad you are back Paul, happy to have Rob join, sorry to see Brian go and the Ewok and Michigander are just fun to have along for the ride.

I got two when they came out last year, I decided to get more when they came out again this year. This year instead of just plain color kilts they added camp kilts, so I ordered some of those also.
Last years kilts fit well, lots of pockets for mags, knives as and other EDC stuff, I was packing two .45’s at our “June Faire”, no one knew but me,:-) 🙂
The thing I like about these kilts is that they are machine wash, hang dry, no more dry clean only, this trucker likes that!!! 🙂 🙂 🙂 🙂 🙂 🙂

Topic 1 Brian Aitken interview
Brian, when did you begin your adventure with New Jersey’s gun laws?

Brian moved from Colorado to New Jersey.  He asked the police for instructions on transportation of firearms and ammunition.  He was pressured by the police for a search of his loaded car.  The police threatened to put him in a psychiatric hospital on a 72 hour hold so they could search his car.  He was falsely arrested and prosecuted. (Mirandized after two hours!)  He wouldn’t accept a plea deal.  Before trial, a New Jersey family court declared him a dangerous person, so he had his visitation rights revoked and he can’t see his son. Brian was tried, convicted, and served time in a New Jersey prison on felony firearms violations.

Brian’s sentence was commuted, but not overturned. The appeals court reversed two of the three charges, but upheld the third.  There is no legal way to transport ammunition in NJ when you move from house to houlse.

We talked about licensed carriers last week.  Some of the first responders in the Nairobi Mall attack were described as “Members of a local gun club” and as “off duty police”.  Perhaps they are both.  One was wearing an IDPA patch on his vest as well as shooting glasses.  My guess is that he heard gunfire and grabbed his gear from his car.  Click on the picture for a larger image.Nairobi first responders

The gun-control crowd says guns are dangerous.  Now we have data from the last three years that shows gun owners are much SAFER than the general public.  We already knew that gun owners are more law abiding than the police.  Dean Weingarten looked at domestic homicides in Florida.  He found that people with carry licenses are 10 times safer than the general public, and three times safer than police.

Emily Miller exposed how the DC police would allow Diane Feinstein to parade “Assault weapons” in front of the TV cameras, but the NRA couldn’t bring a hunting rifle to a congressional hearing to point out that is was NOT an assault weapon.  Laws for them and laws for us.

From NY mugging- An SUV beats three aces. Call the cops immediately.  The SUV stopped because the tires had already been slashed, so it appears the tires were slashed before the SUV ran over the motorcycle rider.  The average attack is 2.3 persons against one.  Tell me again how 7 shots is enough?  The best backup gun is a trained partner.
Up to 5 undercover NY PD officers were riding with the biker gang and they witnessed the beating.
Paul – discussion on protective driving and defensive driving. It’s much the same as the use of defensive firearms.  Trained at truck driving school when tractor trailers were being hijacked.  Defensive driving on a dirt track.
Main points on protective driving vs safe driving
1) In defensive driving your main goal is to prevent collisions and keep you and the occupants of your vehicle safe, in protective driving you have been threatened and are using the vehicle as a tool to regain the safety of you and the occupants of the vehicle – BIG Difference.
2) The vehicle is a FAR more effective tool for defense than almost anything else INCLUDING A FIREARM. If you doubt me look at the physics of the collision, you get FAR more impact from a 2500 pound car at 20 mph than a 1 ounce projectile at thousands of feet per second.
3) Momentum is your friend. If you are being physically threatened don’t stop for anything. I don’t care if your tires are GONE, you can still stay safe running on the rims, and a bad guy will play hell trying to get through a locked door at even 10 MPH.
4) You aren’t Dirty Harry, you cannot shoot and drive at the same time, leave the gun in the holster until the car cannot move anymore.
You can run Autocross with SCCA.  Costs you an 80 dollar helmet.

Terrorist bombing in Nairobi, Kenya- Kenya is learning the lessons from this terrorist murder in Nairobi, lessons the rest of the world learned from the massacre seven years ago in Beslan Russia. Disarmed civilians are an easy and irresistible target for terrorists.  These mass murders make the government look impotent.  This is the first, not the last attack because disarmed Kenya is full of such targets.  There is not an alternatives to an armed citizenry.  The seeming alternative is a strict police state, but a police state is precisely what failed so miserably at Beslan where 380 people were killed.

Government shutdown follies.
The Obama administration has to make the 13 percent budget cut pretty painful.  If the budget cut doesn’t hurt, then the voters might decide to keep the government smaller.  Include a list of ridiculous closures by the administration, like no fishing in the florida keys since the fish and game officials can’t prove you’re taking a legal catch.

Proposed 28th amendment to the US constitution-
All  sitting members of Congress, both the House and the Senate, are ineligible for re-election for life if the federal government spends or assumes liabilities that exceed the tax revenues received during the previous fiscal year.  Re-election to occur the next November.

My (Paul) personal theory,  Dump the Departments of Energy, Federal Aviation Administration, Labor, Education,and Commerce. While we are at it, how about trashing the EPA, OSHA and the FMCSA. (←that is the Federal Motor Carrier Safety Administration for us stationary types.)  Turn the TSA over to private companies at the airports and pass 2 constitutional amendments, 1) the congress MUST spend less than the combined tax receipts for the previous year and 2) all laws passed by congress apply equally to congress.
These things will never happen, but it would fix the problem.
Will the French Republicans support this?  I doubt it!
